HomeMy WebLinkAboutORD 71-23ORDINANCE NO AN ORDINANCE AMENDING SEC. 32-8 AND 32-9 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT ESTABLISHING SEWER SERVICE RATES, RULES AND REGULATIONS BOTH INSIDE AND OUTSIDE THE CITY LIMITS BY CHANGING SAID RATES AND REGULATIONS AND RULES EFFECTIVE JULY 1, 1971; PROVIDING FOR A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT -HEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That Sec. 32-8 and 32-9 of the Code of Ordinances of the City of Beaumont, Texas, are hereby amended, effective July 1, 1971, and from the effective date hereof read as follows : "Sec. 32-8. Service rates, rules and regulations - Inside City Limits. "The following rates, rules and regulations are hereby established and shall be enforced and collected by the City Council for sewer service furnished within the corporate limits of the city: "(1) The following metered rates based upon water measured through meters approved by the waterworks department shall be effective: (a) Minimum Charge, First 1,500 gallons . . . . . . .$ 1.50 (b) Next 8,500 gallons. .30 per M gallons (c) Next 10,000 gallons . . . . .29 per M gallons (d) Next 10,000 gallons . . . . .28 per M gallons (e) Next 10,000 gallons . . . . .27 per M gallons (f) Next 10,000 gallons . . . . .25 per M gallons (g) Next 50,000 gallons . . . . .24 per M gallons (h) Next 100,000 gallons. . . . .23 per M gallons (i) Next 100,000 gallons. . . . .22 per M gallons D - 7 /- -2.3 - 22- -7/ ZO (j) Next 100,000 gallons . . . . .20 per M gallon (k) Next 100,000 gallons . . .15 per M gallon (1) All over 500,000 gallons . . .10 per M gallon "(2) No flatrate connections shall be made to the sewer system of the city except in those instances in which sewer service is available and water service from the waterworks system of the city cannot be made available to the customer by an extension of three hundred (300) feet of water line, or less, in which cases the following rates shall be effective: (a) $3.50 per month for each single-family residence or each dwelling unit in multiple dwelling units. (b) $10..00 per month for each commercial customer. (c) The rate for each industrial customer will be determined by the sewer department, based upon the -amount and strength of the effluent to be received by the sewer system from such customer as determined by the metered return flow, which metering shall be at customer's expense. "(3)All bills shall be computed at the herein prescribed rates and shall be payable within thirty days from the date of such bills, which is also the date of reading the meter. "(4)Failure or refusal by any customer to pay any bill to the sewer department, or its authorized representatives upon demand, shall constitute a breach of contract, and water and sewer service may, within ten days from notice of such failure, be discontinued to the customer, and, at the discretion of the Director of Water Utilities, such service shall not be renewed until the customer has paid all delinquent bills, plus the following applicable service charge(s): For cutting service and locking meter . . . . . . . . . . . . . . $ 4.00 For replacing a broken lock . . . . . . . 7.00 For removal of a meter . . . . . . . . . 12.00 For killing tap (cutting off service at main line) . . . . . . . . . . 35.00 Protest.of charges on file with the sewer department shall not in any manner alter or extend the purposes of this subsection. -2- 1 "(5) In computing the charge where a single water meter services more than one dwelling unit, the total consumption of water, as measured by the meter, shall be divided by the number of units served and the rates set forth in the schedule in subsection (1) of this section shall then be applied as though each unit had a separate meter in making the charge; provided, however, that a minimum charge of one dollar and fifty cents per unit per month shall be made." "Sec. 32-9. Same -.Outside city limits. "No -sewer service shall be furnished any subdivision outside the city limits of the city unless and until a plan, plat or replat shall have been first approved in the manner and by the authorities provided for in Article 427b, Tex. Civ. Stat., and Article 974a, Tex. Civ. Stat. If such a plan, plat or replat shall have been so approved in accordance with the said state statutes, the city council may, if it is deemed advisable, furnish sewer service to premises outside the city limits of the city, under the following rules: "(1) Any person residing outside of the city limits desiring to use sewer service shall make application to the sewer department requesting service, which shall state the location of the premises to be served. Such application shall be made upon blanks furnished by the city clerk and shall be signed by the agent or owner of the property to be served, and he will become liable for charges for sewer service furnished. "(2) Sewer service to consumers outside the city limits shall be rendered at the following rates: Same as inside the city limits plus twenty-five per cent each month. When service is on, a minimum charge of two dollars per month shall be made. . "(3) Failure or refusal by any customer to pay any bill to the sewer department, or its authorized representatives upon demand, shall constitute a breach of contract, and water and sewer service may within ten days from notice of such failure, be discontinued to the customer, and, at the discretion of the Director of Water Utilities, such service shall not be renewed until the customer has paid all delinquent bills, plus the following applicable service charge(s): For cutting service and locking meter . . .$ 4.00 For replacing a broken lock . . . . . . . . .7.00 for removal of a meter . . . . . . . . . . 12.00 For killing tap (cutting off service at main line . . . . . . . . . . . 35.00 5911 ;'IFS", t / "(4) The city council may make contracts with owners of suburban property for extensions of mains to such property and for connections of such mains to the sewer system of the city; providing nothing in this section shall be construed to compel the city council to give service to any customer outside of the city limits. Sewer service through any suburban line shall not be sold to customers living outside the city limits at a rate less than is charged by the city for service inside the city limits." 2. That any person who violates any provision of this Ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 3. That if any section, subsection, sentence, clause or phrase of this Ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this Ordinance, and to such end the various portions and provisions of this Ordinance are declared to be severable. 4.
