ENTITLED AN ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS, BY AMENDING SECTION 15-43 REQUIRING GARBAGE CONTAINERS; PROVIDING SPECIFICATIONS FOR GARBAGE CONTAINERS; PRO- VIDING A PENALTY; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That Section 15-4 of the Code of Ordinances of the City of Beaumont, Texas, be amended to read as follows: "Sec. 15-4. Garbage containers required; specifications. (a) Every owner or occupant using or occupying any building, house, or structure within the corporate limits of the city, for residence, church, school, lodge, commercial, business, or other purposes, shall provide and maintain garbage containers of sufficient number and size to hold the garbage that will normally accumulate on the premises. (b) Such containers shall be not less than ten nor more than thirty gallon capacity, constructed of metal or plastic, with a tight fitting lid or cover that is not attached and with handles sufficiently strong for workmen to empty con- veniently; provided that nothing herein shall prohibit the use of plastic bags as garbage containers so long as said plastic bags are at least one and one-half (1 1/2) milsin thickness, have a capacity of not more than thirty (30) gallons, and are tied or closed securely. The city in no way shall be responsible for damage to plastic containers. The top of such containers shall be larger in diameter than the bottom to prevent garbage from sticking to the sides. Every such owner or occupant shall place all garbage which has accumulated on his premises in such container." 2. That any person who violates any provision of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished as provided in Section 1-8 of the .Code of Ordinances. o- 71 /9 d-1- 71 69, 3. That all Ordinances and parts of .Ordinances in conflict here- with are hereby repealed to the extent of such conflict. 4. That if any section, subsection, sentence, clause or phrase of this Ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this Ordinance, and to such end the various portions and provisions of this Ordinance are declared to be severable.
