HomeMy WebLinkAboutORD 71-38ORDINANCE NO. 91 - 32,/ ENTITLED AN ORDINANCE AMENDING CHAPTER 6, SECTION 6-36 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT, TEXAS; PROHIBITING DOGS AT LARGE; PROVIDING FOR PENALTY; REPEALING ALL ORDINANCES IN CONFLICT; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 6, Section 6-36 of the Code of Ordinances of the City of Beaumont be amended to read as follows: "Sec. 6-36. Dogs at Large Prohibited. It shall be unlawful for any dog to be at large within the City of Beaumont, Texas. Any dog on the streets, alleys or public places or on private premises not under the control of the owner, possessor, keeper or harborer of such dog within the City shall be considered to be at large in violation of this section, except a dog wearing a license tag issued to it and being under the control of a person by means of a leash of sufficient strength to hold such dog. A person who owns, possesses, keeps or harbors any dog that is found at large shall be in violation of this ordinance and shall be punished as provided in Section 1-8 of this Code of Ordinances." Section 2. Any person violating any, of the provisions of this section shall be guilty of a misdemeanor and shall be punished in accordance with Section 1-8 of this Code. Section 3. That all ordinances, or parts of ordinances, in conflict herewith are hereby repealed to the extent of the conflict only. Section 4. If a portion or provision of this ordinance be held invalid or unconstitutional, the validity of the remaining provisions shall not be affected thereby and for this purpose, the City Council of the City of Beaumont declares this ordinance to be severable.
