AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSI- FICATION -OF FIVE (5) ACRES OF LAND LOCATED 'IN THE HEZEKIAH WILLIAMS, JR. SURVEY, ABSTRACT 57, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN PRESENTLY ZONED "R-2.11 AND IIC-111 TO IIC-111; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1 That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon. -the Zoning Map of the City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned "R-211 and IFC -111, Two Family and Multiple Dwelling and Neighborhood Commercial District, respectively, to FIC -111, Neighborhood Commercial District, to -wit: BEING 5 acres of land located along and adjacent to the north line of Lucas Drive and along and adjacent to the west line of Pine Street, and being out of the Hezekiah Williams, Jr., Survey, Abstract 57, Beaumont, Jefferson County, Texas, and described as follows: BEGINNING at a galvanized pipe at the inter- section of the north line of Lucas Drive and the west line of Pine Street at the southea9t corner of a 38.071 acre tract set aside in the Wilson-Bordages, et al, partition; THENCE north 890 39' 00" west along the north line of Lucas -Drive and the south line of the 38.071 acre tract, a distance of 418.49 feet to a point for corner; THENCE north.000 21' 0091 east, a distance of 383.11 feet to a point for corner; 7.2- a7 THENCE south 890 39' 00" east, a distance of 718.53 feet'to a point for corner in the west line of Pine Street and the east line of the 38.071 acre tract; THENCE south 380 25' 00" west, along the west line of Pine Street and the east line of the 38.071 acre tract, a distance of 486.62 feet to the place of beginning, containing five (5) acres of land, and also including half the right-of-way width of abutting streets, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Qor 1-i nn 9 That in all other respects the.use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas adopted August 19, 1958, effective October 19, 1958, as amended. Section 3 That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described herein- above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Qor+f inn A That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
