ENTITLED AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE PATH DAY OF JUNE, 1972, TO DETERMINE WHETHER THE PROPOSED MINIMUM SALARY OF $704 PER MONTH FOR FIREMEN AND POLICEMEN SHALL BE ADOPTED; NAMING THE PLACES AT WHICH SAID ELECTION SHALL BE HELD; APPOINTING JUDGES AND ALTERNATES TO PRESIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; AND PROVIDING THE MANNER OF HOLDING SAID ELECTION. WHEREAS, on March 15, 1972, a petition was filed with the City Council proposing a minimum salary of $704 per month for firemen and policemen and calling for an election to determine whether such proposed minimum salary shall be adopted, all pursuant to Article 1583-2, Vernons Texas Penal Code; and, WHEREAS, said petition was signed by a sufficient number of qualified voters of the City of Beaumont; and, WHEREAS, Article 1583-2 of Vernon's Texas Penal Code provides that if such a petition is filed, the City Council shall call an election within ninety (90) days after said petition has been so filed to determine whether said proposed minimum salary shall be adopted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That in accordance with the provisions of the laws of the State of Texas, a special election within the corporate limits of the City of Beaumont is hereby ordered to be held ''3 on the nth day of June, 1972, to determine whether the proposed minimum salary of $704 per month for firemen and policemen shall be adopted. �- 7 A—,2 -.2 - -7a 5� ORDINANCE NO. That legally qualified voters residing within the corporate limits of the City of Beaumont shall be entitled to vote at said election. Section 3. That said election shall be held in the City of Beaumont c", at the places designated in Exhibit "A01 and the persons named in Exhibit "A11 are appointed presiding judges and alternates for their respective voting boxes, with the authority to select and appoint their own clerks. The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks shall be appointed for each precinct. Section 4. That notice of said election shall be given as follows: (a) By posting the notice of election hereinafter prescribed, together with a copy of this ordinance,at each of the places herein designated for holding said election, at least twenty (20) days prior to the date of holding said election; and, (b) By publishing said notice together with a copy of this ordinance in a newspaper of general circulation in this City at one time, not more than twenty-five (25) days nor less than ten (10). days before said election. Said notice shall be in the following form: "NOTICE OF SPECIAL ELECTION IN THE CITY OF- BEAUMONT, TEXAS, TO DETERMINE WHETHER THE PROPOSED MINIMUM SALARY OF $704 PER MONTH FOR FIREMEN AND POLICEMEN SHALL BE ADOPTED. "Notice is hereby given that a Special Election will beeld in the City of Beaumont, Texas, on the th day of June, 1972, from 7:00 A.M. to 7:00 P.M. to determine whether the proposed minimum salary of $704 per month for firemen and policemen shall be adopted, all as is more -2- particularly set forth in the copy of the election ordinance passed by the City Council and attached hereto." Section 5. The form of ballot which shall be used in said Special Election shall be substantially as follows: "FOR THE PROPOSED MINIMUM SALARY OF $704 PER MONTH FOR FIREMEN AND POLICEMEN" "AGAINST THE PROPOSED MINIMUM SALARY OF $704 PER MONTH FOR FIREMEN AND POLICEMEN" Section 6. That said election shall be held under and controlled by the provisions of the State Laws governing elections. PASSED by the City Council this the ,day of 1972. ATTEST: City Clerk - -3-
