BE IT ORDAINED BY THE,CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 2 of the Code of Ordinances of the City of Beaumont be amended by repealing the present'Chapter 2 of said Code of Ordinances and enacting a new Chapter 2 in lieu thereof, which said new Chapter 2 shall read as follows: 0- 1IR -- &3 "Sec. 2-1. Department of Community Development. "A Department of Community Development is estab- lished to be under the control and direction of the Director of Community Development, who shall be appointed by the City Manager and be subject to the orders and directions of the City Manager. The Director of Community Development shall have charge of planning and zoning, environmental control, and building inspections. He shall per- form such other duties as may be delegated to him from time to time by the City Manager. "Sec. 2-1.1. Division of Planning and Zoning. "Within the Department of Community Development, there is hereby established a Division of Planning and Zoning, the head of which shall be the Direc- tor of Planning and Zoning. The division shall _ perform such duties with reference to planning and zoning as are authorized under the charter and ordinances of the City and applicable state laws, and such other duties as may be assigned to that division by the Director of Community Devel- opment or by the City Manager. The Director of Planning and Zoning shall coordinate the work of and assist the City Planning and Zoning Commission in the performance of its duties. The Director shall have direct supervision over the adminis- trative details of the Ci�-.y Planning and Zoning rM Commission and the Board of Adjustment and shall supervise the keeping of their records. The Division of Planning and Zoning shall be respon- sible for the enforcement of the City's zoning ordinances. "Sec. 2-1.2. Division of Environmental Control. "Within the Department of Community Development, there is hereby established the Division of Environmental Control, the head of which shall be the Environmental Control Administrator. The duties of this division shall be to administer a program of enforcement of those regulatory ordinances of the City involving physical envi- ronment, including, but not limited to, minimum housing, junked automobiles, and weed control; to make inspections to determine the existence of violations of the City's zoning ordinances; and to perform such other duties and functions as may be assigned to it from time to time by the Director of Community Development or by the City Manager. 01Sec. 2-1.3. Division of Building Inspections. "Within the Department of Community Development, there is hereby established the Division of Building Inspections, the head of which shall be the Building Inspections Administrator. The Division of Building Inspections shall be respon- sible for the enforcement of all ordinances re- lating to building, plumbing, and electrical wiring of all buildings or structures being erected or altered, or in which the plumbing or electrical wiring is being installed or altered.; for inspecting all such buildings and structures; for the issuance of permits therefor; and for such other activities as may be necessary to the en- forcement of ordinance provisions relating thereto. The Building Inspections Administrator shall per- form such other duties as may be delegated to him from time to time by the Director of Community Development or the City Manager." "Sec. 2-2. Department of Finance and Administration. "There is hereby established the Department of Finance and Administration, the head of which shall be the Director of Finance, who shall be the City Manager. The City Manager may appoint a Finance Officer to perform the duties of the office. The Director of Finance or his designated Finance Officer shall have charge of accounting, auditing, taxation, purchasing and central stores, data processing, and -2- .. -5.3 fleet maintenance. The Finance Officer shall report to the Director of Finance and shall per- form such other duties as may be delegated to him from time to time by the Director of Finance. "Sec. 2-2.1. Division of Accounting. "Within the Department of Finance and Administration there is hereby established the Division of Account- ing, the head of which shall be the Chief Accountant. He shall be responsible for processing, recording, and reporting information on the financial position of the City and results of operations of all funds and groups of accounts of the City, for preparation and safekeeping of all books and records of accounts of the City, and for.maintaining records sufficient to establish adequate control of assets of the City of Beaumont. He shall perform such other duties and functions as shall be delegated to him by the Director of Finance or the Finance Officer. "Sec. 2-2.2. Division of Auditing. "Within the Department of Finance and Administration, there is hereby established a Division of Auditing, the head of which shall be the Internal Auditor. The Internal Auditor shall be responsible for determining the adequacy of the system of internal control, ver- ifying and safeguarding assets, checking on the re- liability of the accounting and reporting system, ascertaining compliance with the established policies and procedures, and appraising performance of activ- ities and work programs. The Internal Auditor shall perform such other duties and responsibilities as may be delegated to him from time to time by the Director of Finance or the Finance Officer. "Sec. 2-2.3. Division of Taxation. 1°Within the Department of Finance and Administration, there is hereby established the Division of Taxation, the head of which shall be the Tax Assessor and Collector. The Tax Assessor and Collector shall per- form the duties imposed upon the office of assessor and collector of taxes by the charter and ordinances of the City of Beaumont and by the laws of the State of Texas. With the consent of the Director of Finance, he shall appoint such deputies and employees as may be required for the performance of the duties of his office, and shall perform such other duties and func- tions as may be delegated to him from time to time by the Director of Finance or the Finance Officer. 5919 11 "Sec. 2-2.4. Division of Purchasing and Central Stores. "Within the Department of Finance and Administration, there is hereby established a Division.of Purchasing and Central Stores, the head of which shall be the Purchasing Agent. The Purchasing Agent shall be responsible for writing specifications for solicita- tion of bids for purchase contracts; issuing purchase orders; ordering and receiving materials, supplies and equipment for inventory; distributing inventory to the various departments upon request; maintaining adequate inventory control; and maintaining adequate records to accomplish inventory control. He shall perform such other duties as might be delegated to him from time to time by the Director of Finance or the Finance Officer. "Sec. 2-2.5. Division of Data Processing. "Within the Department of Finance and Administration, there is hereby established a Division of Data Pro- cessing, the head of which shall be the Data Pro- cessing Manager. This division shall be responsible for converting information received from the various city departments into a machine-readable format, for processing such information, for reporting and dis- tributing the information to the departments, and for maintaining current files and historical records for the City. The division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Finance or the Finance Officer. "Sec. 2-2.6. Division of Fleet Maintenance. "Within the Department of Finance and Administration, there is hereby established a Division of Fleet Maintenance, the head of which shall be the Fleet Maintenance Administrator. This division shall be responsible for the maintenance and repair of motor - operated city equipment, except equipment assigned to the Fire Department or Public Bus System; for the establishment and operation of a preventive maintenance program; for the keeping of books and records relating to the cost of maintenance and repair; for recommending to the Director of Finance a schedule for replacement of city equipment; and for such other duties and functions as may be delegated to it from time to time by the Director of Finance or the Finance Officer." -4- 0 "Sec. 2-3. Health Department. "There is hereby established a Department of Health, the head of which shall be the Director of Health. The Department of Health shall provide general admin- istrative supervision to all public health activities to safeguard and improve the general health of the City, shall be responsible for coordinating public health services and applying sound public health practices, shall be responsible for the recording of vital statistics, shall have charge of the pound pen, and shall enforce all health laws within its jurisdiction. The department shall perform such other duties as may be delegated to it from time to time by the City Manager." "Sec. 2-4. Library Department. "There is hereby established the Library Department, the head of which shall be the Library Director. The Library Department shall be in charge of planning, organizing, directing and coordinating all activities of the city library system and shall perform such other duties as may be delegated to it from time to time by the City Manager." "Sec. 2-5. Department of Parks and Recreation. "There is hereby established a Department of Parks and Recreation, the head of which shall be the Director of Parks and Recreation. This department shall be responsible for maintenance of all parks and playgrounds belonging to the City, supervision of all public recreation and entertainment activities carried on under the control of the City, maintenance of all equipment necessary for the maintenance of all parks and playgrounds belonging to the City, for collection of fees, and the arrangements for rentals for all park and playground facilities, and shall perform such other duties and functions as may be delegated to it from time to time by the City Manager." "Sec. 2-6 Department of Personnel and Safety. "There is hereby established the Department of Per- sonnel and Safety, the head of which shall be the Director of Personnel and Safety. This department shall be responsible for planning, organizing, directing and coordinating the personnel and safety activities, including civil defense, of the City and for formulating personnel policies and procedures for the City.. The department shall perform such other duties as may be delegated to it from time to time by the City Manager." -5- • "Sec. 2-7. Department of Public Works. "There is hereby established the Department of Public Works, the head of which shall be the Director of Public Works. This department shall be respon- sible for engineering, general construction, and maintenance of streets and drainage for the City; for collection and removal of solid waste and trash; and for performing such other duties as may be delegated to it from time to time by the City Manager. "Sec. 2-7.1. Division of Engineering. "Within the Department of Public Works there is hereby established the Division of Engineering, the head of which shall be the City Engineer. This division shall be responsible for keeping accurate maps, plats and records of all public works, lands or property owned or used by the City; for advising the City Council and other City departments on all engineering matters referred to it; for, making re- ports, upon request of the City Council or the City Manager, regarding public improvements, repairs of streets, bridges and sidewalks, and such other work as the City Manager may request, and shall make suggestions to the City Manager regarding same as shall, in its judgment, seem best and proper; and for performing such duties as are provided by law or ordinance. This division shall perform such other duties and functions as may be delegated to` it by the Director of Public Works or the City Manager. "Sec. 2-7.2. Division of Streets and Drainage. "Within the Department of Public Works, there is hereby established the Division of Streets and Drainage, the head of which shall be the Superin- tendent of Streets and Drainage. This division shall be responsible for the construction and care of all public streets, alleys, and driveways in the City, and with keeping the same clean; for keeping all gutters and drains and all public streets functioning properly and free from defects; and for maintaining storm sewer systems within the City in good repair. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Works or the City Manager. "Sec. 2.-67.3. Division of Solid Waste. "Within the Department of Public Works, there is hereby established.the Division of Solid Waste, the head of which shall be the Superintendent of Solid Waste. This division shall be responsible for collection, removal, and disposal of solid waste, trash, and refuse as required by the pro- visions of this Code of Ordinances and applicable health laws. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Works or the City Manager." "Sec. 2-8. Department of Building Maintenance and Operations. "There is hereby established the Department of Building Maintenance and Operations, the head of which shall be the Building Maintenance Director. This division shall be responsible for the main- tenance of all buildings owned or used by .the City of Beaumont, including fixtures and accessories to such buildings; for the remodeling of such build- ings upon the direction of the City Manager; for the operation of the telephone switchboard; and for administering the rental of public buildings. This department shall perform such other duties and functions as may be delegated to it from time to time by the City Manager." "Sec. 2-9. Department of Public Utilities. "There is hereby established the Department of Public Utilities, the head of which shall be the Director of Public Utilities. This department shall be responsible for the maintenance, repair and operation of the water production and dis- tribution system and of the wastewater disposal system of the City. This department shall per- form such other duties and functions as may be delegated to it from time to time by the City Manager. "Sec. 2-9.1. Division of Water Production. "Within the Department of Public Utilities, there is hereby established the Division of Water Production, the head of which shall be the Superintendent of Water Production. This division shall be responsible for the purification of the City water supply, in- cluding the maintenance of plants, buildings and equipment; for consultation with engineers and others regarding expansion or modification programs, and checking plans and specifications; for coordination of the water treatment activities with related utility, engineering and public health activities. This divi- sion shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. -7- "Sec. 2-9.2. Division of Water Distribution. "Within the Department of Public Utilities, there is hereby established the Division of Water Dis- tribution, the head of which shall be the Superin- tendent of Water Distribution. This division shall be responsible for the construction, maintenance, and repair of the water distribution system, in- cluding mains, valves, hydrants and services; for the plans, layouts and direction of maintenance and construction crews of the water distribution system; for the investigation and adjustment of service complaints; and for recommendations to the City Manager for operation and expansion of services and installation of mains. This division shall per- form such other duties and functions as may be dele- gated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.3. Division of Customer Services. "Within the Department of Public Utilities, there is hereby established the Division of Customer Services, the head of which shall be the Utilities Commercial Administrator. This division shall be responsible for the billing, collection and accounting activities for city furnished utilities; for preparation of departmental budget operating records and reports; and for handling customer complaints and adjustments as necessary. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.4. Division of Sanitary Sewer Maintenance. "Within the Department of Public Utilities, there is hereby established the Division of Sanitary Sewer Maintenance, the head of which shall be the Superin- tendent of Sanitary Sewer Maintenance. This division shall be responsible for sewer maintenance activities, including the construction, maintenance and repair of sewers, manholes, and forcemains; for planning, laying out and directing the work of maintenance and con- struction crews; for investigating and adjusting com- plaints on service; for recommending alterations and expansions of service and installation of sewage systems; and for inspection of construction work. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.5. Division of Water Reclamation. "Within the Department of Public Utilities, there is hereby established the Division of Water Reclamation, WE the head of which shall be the Superintendent of Water Reclamation. This division shall be respon- sible for the operation and mechanical maintenance of the wastewater treatment plant and lift stations and all activities relating to the treatment of wastewater for consultation and recommendations regarding expansions or modification of the wastewater treatment plant and lift stations; and for coordina- ting wastewater treatment activities with related utility, engineering and public health activities: This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager." "Sec. 2-10. Police Department. "There is hereby established the Police Department, the head of which shall be the Chief of Police. The Police Department shall be responsible for the pro- tection of the health, life and property of inhabit- ants and visitors of the City, and for the enforce- ment of all laws within its jurisdiction. The Police Department shall be composed of a detective division, a uniform division, and such other bureaus and divi- sions as may be necessary. The Police Department shall perform such other lawful duties and functions as may be delegated to it from time to time by the Chief of Police or the City Manager." "Sec. 2-11. Fire Department. "There is hereby established the Fire Department, the head of which shall be the Fire Chief. The Fire Department shall be responsible for the sole command of fires and all persons within the vicinity of fires; for taking proper measures to extinguish fires; for the protection of property from fires; for the preservation of order and observance of the laws, ordinances and regulations relating to fires and the prevention of same; and the inspection of oil and gas installations. The Fire Department shall perform such other duties and functions as may be delegated to it from time to time by the Fire Chief or the City Manager." 1°Sec. 2-12. Traffic and Transportation Department. "There is hereby established the Department of Traffic and Transportation, the head of which shall be the Director of Traffic and Transportation. This depart- ment shall be responsible for traffic signs, traffic signals, parking meters, street lighting, traffic counters, controllers, school protection programs, street name signs and other transportation programs including Public Transportation. The department shall perform such other duties and functions as may be delegated to it from time to time by the City Manager. "Sec. 2-12.1. Division of Public Transportation. "Within the Department of Traffic and Transportation, there is hereby established the Division of Public Transportation, the head of which shall be the Transit Operations Supervisor. This division shall be respon- sible for the maintenance and operation of the public bus system, consisting of all rolling stock, per- sonnel and maintenance facilities. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Traffic and Transportation or the City Manager. "Sec. 2-12.2. Division of Traffic Operations. "Within the Department of Traffic and Transportation, there is hereby established the Division of Traffic Operations, the head of which shall be the Superin- tendent of Traffic Operations. This division shall be responsible for the installation, modification and maintenance of all traffic control devices, including traffic signals, signs, parking meters, street mark- ing, and the daily records that are necessary for division and department operations. The division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Traffic and Transportation or• the City Manager." "Sec. 2-13. Transfer of Employees between Departments and Divisions Authorized. "In order to expedite the work of any department and to administer an increase in duties which may evolve upon any department, or to cope with periodical seasonal changes, the City Manager is hereby empowered to transfer employees temporarily from one department to perform similar duties in another department. Similarly, each department director shall have the power to transfer employees from one 'division to another within his department. This section shall not be construed to permit transfers of employees in violation of civil service law." "Sec. 2-14. Officers and their duties. "The officers of this City shall be such as are pro- vided for in the City charter and the ordinances of the City, and they shall perform the duties as are therein provided. It is the intention of the City Council in the enactment of this Chapter to provide exclusively for the City's administrative chain under the direction of the City Manager. All administrative -10- l offices or responsibilities not established by this Chapter or by the Charter, and which are not otherwise specifically signed to a department created by this Chapter, shall be deemed to be offices under the direct supervision and control of the City Manager, and he may assign same, at his discretion, to any department or division created by this Chapter." Section 2. That ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. That if any section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held to be invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end, the various portions and divisions of this ordinance are declared to be severable. This division shall be responsible for the maintenance and repair of motor - operated city equipment, except equipment assigned to the Fire Department or Public Bus System; for the establishment and operation of a preventive maintenance program; for the keeping of books and records relating to the cost of maintenance and repair; for recommending to the Director of Finance a schedule for replacement of city equipment; and for such other duties and functions as may be delegated to it from time to time by the Director of Finance or the Finance Officer." -4- 5-3 "Sec. 2-3. Health Department. "There is hereby established a Department of Health, the head of which shall be the Director of Health. The Department of Health shall provide general admin- istrative supervision to all public health activities to safeguard and improve the general health of the City, shall be responsible for coordinating public health services and applying sound public health practices, shall be responsible for the recording of vital statistics, shall have charge of the pound pen, and shall enforce all health laws within its jurisdiction. The department shall perform such other duties as may be delegated to it from time to time by the City Manager." "Sec. 2-4. Library Department. "There is hereby established the Library Department, the head of which shall be the Library Director. The Library Department shall be in charge of planning, organizing, directing and coordinating all activities of the city library system and shall perform such other duties as may be delegated to it from time to time by the City Manager." "Sec. 2-5. Department of Parks and Recreation. "There is hereby established a Department of Parks and Recreation, the head of which shall be the. Director of Parks and Recreation. This department shall be responsible for maintenance of all parks and playgrounds. belonging to the City, supervision of all public recreation and entertainment activities carried on under the control of the City, maintenance of all equipment necessary for the maintenance of all parks and playgrounds belonging to the City, for collection of fees and the arrangements for rentals for all park and playground facilities, and shall perform such other duties and functions as may be delegated to it from time to time by the City Manager." "Sec. 2-6 Department of Personnel and Safety. "There is hereby established the Department of Per- sonnel and Safety, the head of which shall be the Director of Personnel and Safety. This department shall be responsible for planning, organizing, directing and coordinating the personnel and safety activities, including civil defense, of the City and for formulating personnel policies and procedures for the City.. The department shall perform such other duties as may be delegated to it from time to time by the City Manager." -5- "Sec. 2-7. Department of Public Works. "There is hereby established the Department of Public Works, the head of which shall be the Director of Public Works. This department shall be respon- sible for engineering, general construction, and maintenance of streets and drainage for the City; for collection and removal of solid waste and trash; and for performing such other duties as may be delegated to it from time to time by the City Manager. "Sec. 2-7.1. Division of Engineering. "Within the Department of Public Works there is hereby established the Division of Engineering, the head of which shall be the City Engineer. This division shall be responsible for keeping accurate maps, plats and records of all public works, lands or property owned or used by the City; for advising the City Council and other City departments on all engineering matters referred to it; for making re- ports, upon request of the City Council or the City Manager, regarding public improvements, repairs of streets, bridges and sidewalks, and such other work as the City Manager may request, and shall make suggestions to the City Manager regarding same as shall, in its judgment, seem best and proper; and for performing such duties as are provided by law or ordinance. This division shall perform such other duties and functions as may be delegated to it by the Director of Public Works or the City Manager. "Sec. 2-7.2. Division of Streets and Drainage. "Within the Department of Public Works, there is hereby established the Division of Streets and Drainage, the head of which shall be the Superin- tendent of Streets and Drainage. This division shall be responsible for the construction and care of all public streets, alleys, and driveways in the City, and with keeping the same clean; for keeping all gutters and drains and all public streets functioning properly and free from defects; and for maintaining storm sewer systems within the City in good repair. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Works or the City Manager. "Sec. 2"7.3. Division of Solid Waste. "Within the Department of Public Works, there is hereby established.the Division of Solid Waste, the head of which shall be the Superintendent of Solid Waste. This division shall be responsible for collection, removal, and disposal of solid waste, trash, and refuse as required by the pro- visions of this Code of Ordinances and applicable health laws. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Works or the City Manager." "Sec. 2-8. Department of Building Maintenance and Operations.' "There is hereby established the Department of Building Maintenance and Operations, the head of which shall be the Building Maintenance Director. This division shall be.responsible for the main- tenance of all -buildings owned or used by the City of Beaumont, including fixtures and accessories to such buildings; for the remodeling of such build- ings upon the direction of the City Manager; for the operation of the telephone switchboard; and for administering the rental of public buildings. This department shall perform such other duties and functions as may be delegated to it from time to time by the City Manager." "Sec. 2-9. Department of Public Utilities. "There is hereby established the Department of Public Utilities, the head of which shall be the Director of Public Utilities. This department shall be responsible for the maintenance, repair and operation of the water production and dis- tribution system and of the wastewater disposal system of the City. This department shall per- form such other duties and functions as may be delegated to it from time to time by the City Manager. "Sec. 2-9.1. Division of Water Production. "Within the Department of Public Utilities, there is hereby established the Division of Water Production, the head of which shall be the Superintendent of Water Production. This division shall be responsible for the purification of the City water supply, in- cluding the maintenance .of plants, buildings and equipment; for consultation with engineers and others regarding expansion or modification programs, and checking plans and specifications; for coordination of the water treatment activities with related utility, engineering and public health activities. This divi- sion shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. -7- "Sec. 2-9.2. Division of Water Distribution. "Within the Department of Public Utilities, there is hereby established the Division of Water Dis- tribution, the head of which shall be the Superin- tendent of Water Distribution. This division shall be responsible for the construction, maintenance, and repair of the water distribution system, in- cluding mains, -valves, hydrants and services; for the plans, layouts and direction of maintenance and construction crews of the water distribution system; for the investigation and adjustment of. service complaints; and for recommendations to the City Manager for operation and expansion of services and installation of mains. This division shall per- form such other duties and functions as may be dele- gated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.3. Division of Customer Services. "Within the Department of Public Utilities, there is hereby established the Division of Customer Services, the head of which shall be the Utilities Commercial Administrator. This division shall be responsible for the billing, collection and accounting activities for city furnished utilities; for preparation of departmental budget operating records and reports; and for handling customer complaints and adjustments as necessary. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.4. Division of Sanitary Sewer Maintenance. "Within the Department of Public Utilities, there is hereby established the Division of Sanitary Sewer Maintenance, the head of which shall be the Superin- tendent of Sanitary Sewer Maintenance. This division shall be responsible for sewer maintenance activities, including the construction, maintenance and repair of sewers, manholes, and forcemains; for planning, laying out and directing the work of maintenance and con- struction crews; for investigating and adjusting com- plaints on service; for recommending alterations and expansions of service and installation of sewage systems; and for inspection of construction work. This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager. "Sec. 2-9.5 Division of Water Reclamation. "Within the Department of Public Utilities, there is hereby established the Division of Water Reclamation, lF.11 the head of which shall be the Superintendent of Water Reclamation. This division shall be respon- sible for the operation and mechanical maintenance of the wastewater treatment plant and lift stations and all activities relating to the treatment of wastewater for consultation and recommendations regarding expansions or modification of the wastewater treatment plant and lift stations; and for coordina- ting wastewater treatment activities with related utility, engineering and public health activities; This division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Public Utilities or the City Manager." "Sec. 2-10. Police Department. "There is hereby established the Police Department, the head of which shall be the Chief of Police. The Police Department shall.be responsible for the pro- tection of the health, life and property of inhabit- ants and visitors of the City, and for the enforce- ment of all laws within its jurisdiction. The Police Department shall be composed of a detective division, a uniform division, and such other bureaus and divi- sions as may be necessary. The Police Department shall perform such other lawful duties and functions as may be delegated to it from time to time by the Chief of Police or the City Manager." "Sec. 2-11. Fire Department. 1PThere is hereby established the Fire Department, the head of which shall be the Fire Chief. The Fire Department shall be responsible for the sole command of fires and all persons within the vicinity of fires; for taking proper measures to extinguish fires; for the protection of property from fires; for the preservation of order and observance of the laws, ordinances and regulations relating to fires and the prevention of same; and the inspection of oil and gas installations. The Fire Department shall perform such other duties and functions as may be delegated to it from time to time by the Fire Chief or the City Manager." "Sec. 2-12. Traffic and Transportation Department. "There is hereby established the Department of Traffic and Transportation, the head of which shall be the Director of Traffic and Transportation. This depart- ment shall be responsible for traffic signs, traffic signals, parking meters, street lighting, traffic counters, controllers, school protection programs, street name signs and other transportation programs including Public Transportation. The department shall y perform such other duties and functions as may be delegated to it from time to time by the City Manager. "Sec. 2-12.1. Division of Public Transportation. "Within the Department of Traffic and Transportation, there is hereby established the Division of Public Transportation, the head of which shall be the Transit Operations Supervisor. This division shall be respon- sible for the maintenance and operation of the public bus system, consisting of all rolling stock, per- sonnel and maintenance facilities. This division shall perform such other duties and functions as may be delegated to it from time to time by'the Director of Traffic and Transportation or the City Manager. "Sec. 2-12.2. Division of Traffic Operations. "Within the Department of Traffic and Transportation, there is hereby established the Division of Traffic Operations, the head of which shall be the Superin- tendent of Traffic Operations. This division shall be responsible for the installation, modification and maintenance of all traffic control devices, including traffic signals, signs, parking meters, street mark- ing, and the daily records that are necessary for division and department operations. The division shall perform such other duties and functions as may be delegated to it from time to time by the Director of Traffic and Transportation or. the City Manager.1° "Sec. 2-13. Transfer of Employees between Departments and Divisions Authorized. "In order to expedite the work of any department and to administer an increase in duties which may evolve upon any department, or to cope with periodical seasonal changes, the City Manager is hereby empowered to transfer employees temporarily from one department to perform similar duties in another department.. Similarly, each department director shall have the power to transfer employees from one 'division to another within his department. This section shall not be construed to permit transfers of employees in violation of civil service law." "Sec. 2-14. Officers and their duties. "The officers of this City shall be such as are pro- vided for in the City charter and the ordinances of the City, and they shall perform the duties as are therein provided. It is the intention of the City Council in the enactment of this Chapter to provide exclusively for the City's administrative chain under the direction of the City Manager. All administrative -10- offices or responsibilities not established by this Chapter or by the Charter, and which are not otherwise specifically signed to a department created by this Chapter, shall be deemed to be offices under the direct supervision and control of the City Manager, and he may assign same, at his discretion, to any department or division created by this Chapter." Section 2. That ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. That if any section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to a particular person, or to a particular set of circumstances, should for any reason be held to be invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end, the various portions and divisions of this ordinance are declared to be severable.
