HomeMy WebLinkAboutORD 72-43LN/gh/8/28/72f ORDINANCE 'NO. -LOL ENTITLED AN ORDINANCE ORDERING A SPECIAL ELEC- TION TO BE HELD IN THE CITY OF BEAUMONT, TEXAS, ON THE 26TH DAY OF SEPTEMBER, 1972 TO DETERMINE WHETHER THE CITY OF BEAUMONT SHALL BE AUTHORIZED TO SELL BY SEALED BIDS A PORTION OF THE LAND KNOWN AS CENTRAL PARK IN THE CITY OF BEAUMONT, TEXAS; NAMING THE PLACES AT WHICH SAID ELECTION SHALL BE HELD; APPOINTING JUDGES AND ALTERNATES TO PRESIDE OVER SAID ELECTION; PROVIDING FOR THE FORM OF NOTICE THEREOF; PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; AND PROVID- ING THE MANNER OF HOLDING SAID ELECTION. WHEREAS, the City Council of the City of Beaumont de- sires to sell 32 acres, more or less, of a portion of park lands belonging to the City of Beaumont known as Central Park; and, WHEREAS, the laws of the State of Texas requires the question of the sale of said park. land to be submitted to the qualified voters of the City of Beaumont; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That in accordance with the provisions of the laws of the State of Texas, a special election within the corporate limits of the City of Beaumont is hereby ordered to be held on the 26th day of September, 1972, to determine whether the City of Beaumont shall be authorized to sell a portion of park lands belonging to the City of Beaumont known as Central Park. Section 2. That legally qualified voters residing within the corporate limits of the City of Beaumont shall be entitled to vote at said election. Section 3. That said election shall be held in the City of Beaumont at the places designated in Exhibit "A" and the per- sons named in Exhibit "A" are appointed presiding judges and alternates for their respective voting boxes, with the author- ity to select and appmnt their own clerks. The presiding judge for each election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper conduct of the election, provided that not more than a total of five clerks'shall be appointed for each precinct. Section 4. That notice of said election shall be given as follows: (a) By posting the notice of election hereinafter prescribed, together with a copy of this ordinance at each of the places herein designated for holding said election, at least twenty (20) days prior to the date of holding said election; and, (b) By publishing said notice together with a copy of this ordinance in a newspaper of general circulation in this City on the same day in each of two successive weeks, not more than twenty-five (25) days nor less than fourteen (14) days before said election. Said notice shall be in the following form: "NOTICE OF SPECIAL ELECTION IN THE CITY OF BEAUMONT, TEXAS, TO DETERMINE WHETHER THE CITY SHOULD SELL 32 ACRES, MORE OR LESS, OF ITS PARK KNOWN -AS CENTRAL PARK. "Notice is hereby given that a special elec- tion will be held in the City of Beaumont, Texas, on the 26th day of September, 1972., from 7:00 a.m. to 7:00 p.m. to determine whether the City of Beaumont shall be author- ized to sell 32 acres, more or less, of its park known as Central Park.1° -2- Section 5. The form of ballot which shall be used in. said special election shall be substantially as follows: PROPOSE THAT 32 ACRES, MORE OR LESS, OF CENTRAL PARK SHALL BE SOLD FOR CASH. ALL MONEYS AC- QUIRED IN SAID SALE ARE TO BE USED TO PROVIDE PARK FACILITIES FOR THE CITY OF.BEAUMONT. THE PORTION OF CENTRAL PARK WHICH THE CITY DESIRES TO SELL IS GENERALLY DESCRIBED AS FOLLOWS: Being 32 acres, more or less, out of that tract of land bounded on the north by Fannin Street, on the east by Fourth Street and the Santa Fe Railroad, on the south by College Street and on the west by Eighth Street, said tract generally referred to as Central Park, said.tract being in the David Brown Survey, Beaumont, Jefferson County, Texas,.being more fully described as follows: Beginning at a point in the north line of the Central Park Properties, same being the south line of Fannin Street 80 foot right of way. Said point being located N89°59'40" E 1200 feet from the northwest corner of the Central Park Properties, being the intersection of the south line of Fannin and the east line of Eighth Street; Thence, North 89°58'40"E along the north line of the Central Park Property and the south line of Fannin Street a distance of 550 feet, more or less, to a point for corner; Thence, South 0°02'W along the extension of the west line of the Texas National Guard 2.5 acre tract extended north, a distance of 1201.75 feet, more or less, to a point for corner in the north line of the 50 foot reserved street widening strip, said point also being the southwest corner of the Texas National Guard 2.5 acre tract; Thence, South 89°59'W along the north line of the 50 foot reserved street widening strip a distance of 1551 feet, more or less, to a point for corner, said point being the southeast corner of the Cerebral Palsy Foundation's 3.3394 acre tract; Thence, North 0°04'E along the east line of the Cerebral Palsy Foundation's tract a distance of 727.33 feet to a point for corner in the south line of the Mental Health and Retardation 3.2713 acre tract, same being the northeast corner of the Cerebral Palsy tract; -3- Thence, North 89058'40"E along the south line, and its extension easterly, of the Mental Health and Retardation tract a distance of 1000 feet to a point for corner; Thence, North 0004'E a distance of 475 feet to the place of beginning and containing 32. acres of land, more or less. "FOR THE SALE" "AGAINST THE SALE" Section 6. That said election shall be held under and controlled by the provisions of the state laws governing elections.
