ORDINANCE NO. 5
ENTITLED AN ORDINANCE VACATING AND ABANDONING
A FIFTEEN FOOT (15') WIDE UTILITY EASEMENT
BEING DESCRIBED AS THE NORTH FIFTEEN FEET
(N 15') OF THE SOUTH TWO HUNDRED SEVENTY-FIVE
FEET (S 275') OF THE WEST ONE-HALF (W 1/2) OF
LOT TWO (2) OF FANNIN STREET ADDITION TO THE
CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, on the 2nd day of September, 1960, H. B.
Black and Travis B. Whitaker conveyed to the City of Beaumont,
Gulf States Utilities Company, and Southwestern Bell Telephone
Company, a_general utility easement across the following des-
cribed property
The north fifteen feet (N 15') of the south two
hundred seventy-five feet (S-.275') of Lot Two
(2) of Fannin Street Addition to the City of
Beaumont, Jefferson County, Texas, according to
map or plat of record in the office of the
County Clerk of Jefferson County, Texas; and
WHEREAS, the Grantors were the owners of the south
two hundred seventy-five feet (S 275') of the east one-half
(E 1/2) of Lot Two (2) of said Fannin Street Addition, but
owned no interest in the south two hundred seventy-five feet
(S 275') of the west one-half (W 1/2) of Lot Two (2) of said
Fannin Street Addition, and therefore their purported con-
veyance to the City of Beaumont of any interest in the south
two hundred seventy-five feet (S 275') of the west one-half
(W 1/2) of Lot Two (2) of said Fannin Street Addition was
void and of no effect;, and,
WHEREAS, the City of Beaumont has not used and has no
plans to use the easement conveyed across the said south two
feet
hundred seventy-five/(S 275') of the west one-half (W 1/2)
of said Lot Two (2) of Fannin Street Addition; and,

WHEREAS, the purpose of this ordinance is corrective
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY OF BEAUMONT, TEXAS:
That that certain fifteen foot (15') wide utility easement
described as follows:
Being the north fifteen feet (N 15') of the
south two hundred seventy-five feet (S 275')
of the west one-half (W 1/2) of Lot Two (2)
of Fannin Street Addition to the City of
Beaumont, Jefferson County, Texas, according
to map or plat thereof of record in the office
of the County Clerk of Jefferson County, Texas,.
be and the same is hereby vacated and abandoned, and that title
to such property shall revert to and become the property of
persons entitled thereto, as provided by law; and the City of
Beaumont hereby relinquishes any and all right, title and
interest it had or may have in.and to such easement.
