HomeMy WebLinkAboutORD 73-24LLJ/im/3/27/73 i 46 ORDINANCE N0. 73_24 AN ORDINANCE ADOPTING HOURS PROVIDED BY STATE LAW FOR CONSUMPTION AND POSSESSION OF ALCOHOLIC BEVERAGES AND FOR THE SALE OF BEER AND FOR THE SALE OF MIXED BEVERAGES IN COUNTIES OF 300,000 OR MORE POPULATION, ACCORDING TO LAST PRECEDING FEDERAL CENSUS; PROVIDING FOR A FEE TO BE PAID BY THE HOLDER -OF A STATE RETAIL DEALER'S ON -PREMISES LATE HOURS LICENSE; PROVIDING A PENALTY; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR. PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. The hours prescribed by the Texas Liquor Control Act, Article 666-4, (c)(1), Texas Penal Code, for the consumption in any public place and for the possession of any alcoholic beverage'in any public place for the purpose of consuming the same in such public place in counties of 300,000 or more population, according to the last preceding Federal Census, are hereby adopted and made effective in the City of Beaumont. 2. The hours prescribed by the Texas Liquor Control Act, Article 667-10, Texas Penal Code, for the sale of beer in counties of 300,000 or more population, according to the last preceding Federal Census, are hereby adopted and made effective in the City of Beaumont. 3. The hours prescribed by the Texas Liquor Control Act, Article 666-25, Texas Penal Code, for the sale of mixed beverages in counties of 300,00.0 or more population, according to the last preceding Federal Census, are hereby adopted and made effective in the City of Beaumont. 4. There is hereby levied, and the holder of a State Retail Dealer's On -Premises Late Hours License shall pay to the City, 0 -7,3 - 3-,27--73 ��3 before exercising any privilege by virtue of such Late Hours License, an annual fee in the sum of one-half (1/2) of the annual State fee for such Late Hours License. 5® That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reas.on be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. 7. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED by the City Council this day of 1973. - Mayor - -2-
