BIGNER SURVEY, IN,BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED 1°R-1" TO `oC-111; PARCEL NO. 2 CONTAINING 1.879 ACRES OF LAND, MORE OR LESS, OUT OF THE F. BIGNER SURVEY, IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED 11R-1" TO "R-2"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Sec tion 1. _v.% r-.3 That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zone classification of the following described tracts of land, Parcel No. l presently zoned "R-1", Single Family Dwelling District, to "C-111, Neighborhood Commercial District; and, Parcel No. 2 presently zoned "R-1", Single Family Dwelling District, to "R-211, Two Family and Multiple Dwelling District, to -wit: BEING two tracts or parcels of land out of the F. Bigner Survey in Beaumont, Jefferson County, Texas, said two tracts being out of a 6.135 acre tract of land out of tracts 3A & 9 of the Mrs. V. A. Collier Estate, F. Bigner Survey, Abstract #1, Beaumont, Jefferson County, Texas, said property being described in Jefferson County Deed Records in Volume 1749, Page 145, on deed dated September 14, 1972; said tracts or parcels being more described as follows: PARCEL NO. 1 BEGINNING at a 1" pipe at the southwest corner of said 6.135 acre tract described in Volume 1749, Page 145, Deed Records, Jefferson County, Texas; �73 - 2-0 2-1-3-.73 d 7 THENCE with the most southerly line of said 6.135 acre tract N 89041'56" E a distance of 191.90' to a point in the most southerly line of said 6.135 acre tract, to a point for corner; THENCE N 06°28'56" E a'distance of 122.79' to a 1/211 pin a -t the intersection of the second and third courses of said 6.135 acre tract, said point being the .point of beginning of the herein described Parcel No. 1; THENCE along said line at N 06028'56" E a distance of 472.51',to a 1/21' pin for corner at the intersection*of the thirdand fourth course of said 6.135'acre tract; THENCE N 09°41'04" E, 325.67', to a 1/2" pin; at the intersection of the ninth course and tenth course of said 6.135 acre tract, said point being the most northerly corner of the herein described Parcel No. 1; THENCE S 53°34'43" E, a distance of 66.28' with the tenth course of said 6.135 acre tract to a 1" pin for corner; THENCE S 38049'00:" E, 85.08' with the eleventh course of said 6.135 acre tract to a I" pin`, for corner; 1• THENCE S 00°49'44" E, 706.41'` with the twelfth" course of said 6.135 acre, tract to a 1/2." pin for corner; THENCE N 84°40' 20".; W: a the place of beginning, of land, more 'or�, less PARCEL N0. 2 distance of 226.069' to containing 3.038 acres BEGINNING at a l/211 -pin - at the intersection of the third course and fourth course.,of.the afore- mentioned 6.135 •!:acre tract for the most south-""' easterly corner of the herein described Parcel. No. 2; THENCE N 800,46104' W,:466.64' with the fourth course of said:'.6.135 acre tract to a 3/41' pipe in the easterly -right-of-way of Treadway Road,,. a street of sixty•foot (60') width; THENCE N 32°43'32" E, 276.49'•with the fifth course of said 6.135 acre tract and the easterly right-of-way of'Treadway Road to a 1/2" pin for the most northwesterly corner of the herein described Parcel No. Z;* THENCE S 58023'441"E, 152.29' with the sixth course of said 6.135 acre tract to a 1/201 pin for corner; THENCE S 29°40'16" W., 29.10' with the seventh course of said 6.135 acre tract'to a 1/2" pin for corner; THENCE S 66009'44" E, 170.30' with the eighth course of said, 6.135 acre tract to a 1/2" pin for corner; -2- THENCE N 26049'56" E, 210.10' with the ninth course of said.6.135 acre tract to a 1/2" pin for the most northeasterly corner of the herein described Parcel No. 2; THENCE S 09041'04" W, 325.67' to the point of beginning; containing in area 1.879 acres of land, more or less. The above two parcels of land contain a total of 4.917 acres of land. Zoning extends to the centerline of abutting streets, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described herein- above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code o.f Ordinances of Beaumont, Texas. 1973.
