ORDINANCE NO. 73-9
ENTITLED AN ORDINANCE AMENDING CHAPTER 15
OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS, BY REPEALING SECTION 15-28 OF CHAPTER
15 AND ENACTING IN LIEU THEREOF A NEW
SECTION 15-28 OF CHAPTER 15; PROVIDING
NEW PERMIT FEES FOR SMALL, MEDIUM, LARGE,
MEDIUM LARGE AND EXTRA LARGE VEHICLES USING
THE SANITARY LANDFILL, AND BASING SAID FEES
ON THE SIZE OF THE VEHICLES INVOLVED AND
THE NUMBER OF LOADS PER WEEK SAID VEHICLES
UTILIZE THE LANDFILL; PROVIDING A PENALTY;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
That Chapter 15 of the Code of Ordinances of Beaumont,
Texas, be amended by repealing Section 15-28 and substituting
in lieu thereof the following new Section 15-28 to read as
follows:
"Sec. 15-28.- Duration, taxes and fees. -
"All permits shall be issued for annual
periods only, expiring on the thirty-first
(31st) day of December of each year, providing
that permits may be issued for fractional parts
of any year during which application is filed.
Exceptions to the annual fee will be granted to
out of. town contractors who need to dump material
on a one job basis that will be completed within
a calendar month. Such permits will be charged
one twelfth of the annual fee for that month.
The inspection and dumping permit fee for each
conveyance to be used by the applicant shall be:
(a) Small vehicles (1-3
capacity) such as z
trucks hauling:
2 or less loads/wk.
3 to 6 loads/wk.
7 or more loads/wk.

(b) Medium vehicles (4-7 cubic yard
capacity) such as 2 ton pick-ups
with built up sides, or small dump_
trucks, flat beds, van bodies, or

(c) Large vehicles (8-15 cubic yards
capacity) such as 14 yard dump
truck, flat bed with built-in sides,
stake body with built-in sides, or
small van body hauling:
2 or less loads/wk.

3 to 6 loads/wk.
$ 200/yr.
7 or.more loads/wk.
$ 500/yr.
(d) Medium -large vehicles
(over 16 cubic
yard capacity) such as
semi -trailer
truck, trailer truck
with van or
other 16 yard and larger
trucks
hauling:
2 or less loads/wk.
$ 400/yr.
3 to 6 loads/wk.
$ 600/yr.
7 or more loads/wk..
$ 800/yr.
(e) Extra large vehicles
(14 yard capacity
and larger) that haul
demolition material,
garbage packer trucks
(16 yard capacity
and larger), -or trucks
with roll -off
containers (15 yard capacity
and larger)
hauling:
2 or less loads/wk.
$ 500/yr.
3 to 6 loads/wk.
$1000/yr.
7 or more loads/wk.
$1500/yr.
"If applicant has more than one truck, but
only one truck will be used in a twenty-four hour
period for hauling to the city landfill then
only one permit is necessary. Permits of $500
or more maybe paid for in two (2) semi-annual
installments. All persons or businesses haul-
ing into the city landfill shall deposit such
material only in the place designated by the land-
fill foreman. Such dumping shall only be during
the hours of operation as set forth by the
Solid Waste Superintendent."
Section 2.
That any person who violates any provision of this
Ordinance shall, upon conviction, be punished as provided
in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
Section 3.
That if any section, subsection, sentence, clause
or phrase of this Ordinance or the application of same to
a particular set of persons or circumstances should for any
reason be held to be invalid, such invalidity shall in no

wise affect the remaining portions of this Ordinance, and
to such end the various portions and provisions of this
Ordinance are declared to be severable.
Section 4.
That all Ordinances and parts of Ordinances in
conflict herewith are hereby repealed.
