HomeMy WebLinkAboutORD 73-4KEWJr/im/1/15/73 r ORDINANCE NO. 7.1-4 ENTITLED AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT BY ADDING THERETO A NEW SECTION NUMBERED SECTION 12-14.1.1.; PROVIDING FOR PARTICIPATION IN THE TEXAS MUNICIPAL RETIRE- MENT SYSTEM BY THE DIVISION OF PUBLIC TRANSPORTATION; PROVIDING FOR REPEAL; AND PROVIDING FOR SEVERABILITY. WHEREAS, the City Council has heretofore elected to have the employees of all departments of the city government participate in the Texas Municipal Retirement System; and, WHEREAS, a new city department, the Division of Public Transportation, has been established; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEYAS: Section 1. That Chapter 12 of the Code of Ordinances of the City of Beaumont is amended by adding thereto a new Section 12-14.1.1., which said new Section 12-14.1.1. shall read as follows: "Sec. 12-14.1.1. Retirement System—Division of Pu is Transportation. "That, on behalf of the City of Beaumont, Texas, the City Council hereby exercises its option and elects to have the city and all of the employees of the Division of Public Transportation participate in the Texas Municipal Retirement System as provided in Chapter 75, Acts of the 50th Legislature, as amended, (Article 6243h of Vernon's Civil Statutes of Texas) effective January 1, 1973; and all of the benefits and obligations of such System are hereby accepted as to such employees. The City Manager is hereby directed to notify the Board of Trustees of the Texas Municipal- Retirement System that the City of Beaumont, Texas, has elected to have the employees of the above depart- ment participate in said System. Each person who becomes an.employee of such department on or after the effective date of participation of such department shall become a member of the Texas Municipal Retirement System as a condition of his employment. The City of Beaumont, Texas, may in the future refuse to add new departments or new employees to such System, but shall never discontinue as to any participants. In accordance 2 eC.I f) J . 41, with the provisions of the statute, the deposits to be made to the Texas Municipal Retirement System on account of current service of the employees of the several participating departments are hereby fixed at the rate of five percent (5%) of the earnings of each employee of said department, and in determining the deposits to be made on account of such service the maximum earnings of this city is full salary. The City Finance officer is hereby directed to remit to the Board of Trustees of the Texas Municipal Retirement System, at its office in Austin, Texas, the city's contributions to the System and the amounts which shall be deducted from the compen- sation or payroll of employees, all as required by said Board under the provisions of Chapter 75, Acts of the 50th. Legislature of the State of Texas, as amended, and the said City Finance officer is hereby authorized. and directed to ascertain and certify officially on behalf of the City of Beaumont, Texas, the prior service rendered to the said municipality by each of the employees of said departments, and the average prior service compensation received by each, and to make and execute all prior service certifications and all other reports and certifications which may be_required of the City of Beaumont, Texas, under the provisions of Chapter 75, Acts Regular Session, 50th Legislature, as amended, or in compliance with the rules and regulations of the Board of Trustees of the Texas Municipal Retirement System. Participation of the Division of Public Transportation shall be effective January 1, 1973." Section 2. That all ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 3. If any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held invalid, such invalidity shall in no way affect the remaining portions of this ordinance, and to such end the various pro- visions of this ordinance. are declared to be severable. 1973.
