HomeMy WebLinkAboutORD 73-42LLJ/gh/5/31/73 ORDINANCE NO. 73-42 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR'THE BOUNDARIES`OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 2.3 ACRES, MORE OR LESS, TRACT OF LAND OUT OF THE C. WILLIAMS SURVEY IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-lA" TO "R-3.11; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT'ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particularthe boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, re- ferred to in Section 42-9 thereof, is hereby amended by changing the zone classification of the following described tract of land, presently zoned "R-lA", Single Family`Resdential District,.to "R-3", Modified Two -Family and Multiple Dwelling District, to -wit: Being a tract of land containing 2.3 acres, more or less, out of the C. Williams Survey in Beaumont, Jefferson County, Texas, and being more particularly described as follows: FOR PLACE OF BEGINNING, begin at the point of the S.W. intersection of Calder Avenue and Marceline Boulevard; THENCE, S.W. along the South ROW line of Calder Avenuea distance of 313.3 feet to the S.E. corner of the intersection of Calder Avenue and "V" Street for a point for corner; THENCE, South along the East line of the 50 -foot wide "V" Street ROW a distance of 350 feet to a point for corner at the S.W. corner of the herein described tract.of land; THENCE, East along the South line of the herein described tract a distance of 217.82 feet to a point for corner in the West ROW line of Marceline Boulevard; THENCE, in a northerly direction along the West ROW line of Marceline Boulevard a distance of 527.65 feet to the place.of beginning, said tract containing 2.3 acres of land, more.or less, and also including half the width of abutting street rights-of-way, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of.the property described herein- above shall be declared to be invalid, the same shall not Affect the validity of the zoning of the balance of the pro- perty described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
