HomeMy WebLinkAboutORD 73-35LN/im/4/27 /73 ORDINANCE N0. 73-35 ENTITLED AN ORDINANCE AMENDING CHAPTER 37, SECTION 37-139(f) PROVIDING FOR TWENTY-FOUR (24) HOUR AVAILABILITY OF VEHICLES REMOVED UNDER THE AUTHORITY OF SECTION 37-139; PRO- VIDING FOR A TOWING CHARGE OF SEVENTEEN AND 50/100 ($17.50) DOLLARS; PROVIDING FOR A STORAGE CHARGE OF TWO ($2.00) DOLLARS PER T1,1ENTY-FOUR (24) HOUR PERIOD OR FRACTION THEREOF; PROVIDING FOR A FIVE ($5.00) DOLLAR CHARGE FOR RELEASING VEHICLES UNDER CERTAIN CONDITIONS AND AT CERTAIN TIMES; PROVIDING FOR A TEN ($10.00) DOLLAR FEE WHEN A DOLLY IS NECESSARY TO TOW A VEHICLE; PROVIDING A TEN ($10.00) DOLLAR FEE.FOR RELEASING A VEHICLE AFTER ATTACHMENT'TO A WRECKER; PROVIDING FOR SEVER- ABILITY; PROVIDING A PENALTY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY'OF BEAUMONT, TEXAS: Section 1. That Section 37-139(f) of the Code of Ordinances of The City of Beaumont is hereby amended to read as follows: "(f) Any wrecker company removing a vehicle from a street or highway pursuant to the provisions of this section must make the vehicle available to the owner or operator on a twenty-four (24) hour basis. A wrecker company may charge not to exceed Seventeen and 50/100 ($17.50) Dollars for such towing and a storage charge not to exceed Two ($2.00) Dollars per twenty-four (24) hours of storage or fraction thereof. Wrecker companies may charge not to exceed Five ($5.00) Dollars for releasing vehicles to its owner or operator any time it is nec- essary to release the vehicle other than during normal working hours. This Five ($5.00) Dollar charge may be collected by wrecker companies only when such vehicle is released within one (1) hour of the request by the owner or operator. When the owner or operator does not appear within the specified 1 -hour time limit to reclaim the vehicle, the wrecker company may charge a Five ($5:00) Dollar -call out -fee when the vehicle is.reclaimed. The Seventeen and 50/100 ($17.50) Dollar towing charge applies to automobiles only, and does not apply to vehicles requiring a heavy duty wrecker. When it is necessary to use a dolly to tow a vehicle, an additional fee of Ten ($10.00) Dollars is authorized to be charged. A �- 73-35 -73 .3V wrecker company may charge up to Ten ($10.00) Dollars if a vehicle is released to the owner or operator after a vehicle is actually attached to the wrecker, but before the vehicle is moved." Section 2. If any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various provi- sions of this ordinance are declared to be severable.. Section 3. Any person who violates or fails to comply with any provision of this ordinance shall, upon conviction, be punished as provided for in Section 1-8 of the Code of Ordinances of Beaumont, Texas. Section 4. That all ordinances and parts of okdinances in conflict herewith are hereby repealed. PASSED by the City Council this the �_ day of , 1973. Mayor -
