HomeMy WebLinkAboutORD 73-34LLJ/im/4/27/73 ORDINANCE NO. 73-34 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 2.3642 ACRE TRACT OF LAND OUT OF LOT 7 OF THE UNRECORDED WIESS PARK SUBDIVISION IN THE C. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R -IA" TO "R-211; PRO- VIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of the City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zone classification of the following described tract of land, presently zoned "R-lA",.Single Family Residential District, to 11R-211, Two Family and Multiple Dwelling District, to -wit: Being a 2.3642 acre tract of land out of Lot 7 of the unrecorded Wiess Park Subdivision of the C. Williams Survey, Beaumont, Jefferson County, Texas, and being more particularly described as follows: BEGINNING at the northeast corner of said Lot 7 of Wiess Park Subdivision, said corner being the intersection of the south line of Calder Avenue with the west line of Pinchback Road, said corner being also south 36.6 feet from the centerline of pavement of said Calder Avenue; THENCE with the west line of said Pinchback Road, south 297.8 feet to a 1/2 inch steel pin for corner; THENCE north 88 degrees 28 minutes west 269.8 feet to a 1/2 inch steel pin for corner, said corner being in the west line of said Lot 7 of Wiess Park Subdivision; (and old fence bears west 5.0 feet); THENCE with the west line of said Lot 7, north 3 degrees 25 minutes west parallel to and approximately five feet from said old fence, 0-13-3V --/- 7� a7 4� N s 390.0 feet to a point for corner, said corner being south 3 degrees 25 minutes east 30.2 feet from the centerline of Calder Avenue; THENCE with the south line of Calder Avenue as follows: South 86 degrees 50 minutes east 163.77 feet, THENCE South 55 degrees 02 minutes east 158.0 feet to the PLACE OF BEGINNING AND containing 2.3642 acres of land, more or less, and also including half the width of the abutting street rights-of-way, and the official zoning map of the City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances. of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described herein- above shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in said Chapter 42 of the Code of Ordinances of Beaumont, Texas. .
