ORDINANCE NO. 73-29
ENTITLED AN ORDINANCE AMENDING CHAPTER 23
OF THE CODE OF ORDINANCES OF THE CITY OF
BEAUMONT, TEXAS, BY ADDING A NEW SECTION
23-45 PROHIBITING THE SALE, OFFER OF SALE,
DELIVERY OR GIFT TO ANY PERSON UNDER SEVEN-
TEEN (17) YEARS OF AGE OF CERTAIN TYPES OF
GLUE, CEMENTS, AND PAINTS; MAKING IT UNLAW-
FUL FOR ANY PERSON TO INHALE THE VAPORS OF
SUCH GLUES, CEMENTS AND PAINTS; PROVIDING A
PENALTY; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
Section 1.
Chapter 23 of the Code of Ordinances of the City of
Beaumont, Texas, is hereby amended to add a new Section
23-45 to read as follows:
"Sec. 23-45. Sale delivery or gift of certain
glues, cements and paints.
"(a) Except as- o-therwise provided herein, no
person shall sell, offer for sale, deliver
or give to any individual under the age of
seventeen (17) years any glue, cement or
paint commonly known as model airplane glue,
plastic cement, household cement, cement,
spray paint, or any other similar substance,
if such glue, cement or paint contains one
or more of the following volatile solvents:
1. Toluol
2. Hexane
3. Trichlorethylene
4. Acetone
5. Teluene
6.. Ethyl Acetate
7. 'Methly Ethyl Ketone
8. Trichloroethane
9. Isopropanol
10. Methyl Isobutyl Ketone
11. Methyl Cellosolve Acetate
12. Cyclohexanone
13. Toluene
"(b) The provisions of Sec. 23-45(a) of this
ordinance shall not apply where the glue, cement,
or paint is sold, delivered or given to an
individual under the age of seventeen (17)
years by the parent or legal guardian of that
individual.
"(c) The provisions of Sec. 23-45(a) of this
ordinance shall not apply where the glue,
cement or paint is sold, delivered or given
simultaneously with and as part of a kit
used for the construction of model air -

planes, model boats, model automobiles,
model trains or any other similar models.
"(d) It shall be unlawful for any person to
inhale the vapors of any glue, cement or paint
containing one or more of the solvents named
in Sec. 23-45(a) hereof with the intent.of
obtaining intoxicating or narcotic effects
thereby."
Section 2.
That any person who violates any provision of this
ordinance shall upon conviction be punished a.s'provided in
Section 1-8 of the Code of Ordinances of Beaumont, Texas.
Section 3.
That if any section, subsection; sentence, clause
or phrase of this ordinance or the application of same to
a particular set of persons or circumstances should for
any reason be held to be invalid, .such invalidity shall in
no wise affect the remaining portions of this ordinance and
to such end -the various portions and provisions of this
ordinance are declared to be severable.
Section 4.
That all ordinances and parts'of ordinances in con-
flict herewith are hereby repealed.
