ENTITLED AN ORDINANCE AMENDING CHAPTER 35 OF THE
CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY ADDING
A NEW 'SECTION TO BE NUMBERED SECTION 35--4.1,.PRO-
VIDING FOR THE WITHDRAWING AND SUBSTITUTING OF
TAXICABS; PROVIDING A PENALTY; PROVIDING FOR SEV-
ERABILITY; AND REPEALING ALL ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:

That the Code of Ordinances of Beaumont, Texas, is hereby
amended by adding a new Section 35--4.1, said Section to read as
follows:
'?Section 35-4.1. Withdrawing and substituting
taxicabs.
If at any time any taxicab which has been
regularly licensed under the provisions of this
chapter, is to be withdrawn or replaced by another
and different motor vehicle, the same may be done
after making written application to the city
manager and securing his approval thereof. Such
approval shall be based upon the city clerk and
chief of police having a complete record of such
substitution and the city manager being satisfied
that all rules and regulations of this chapter
have been complied with; provided, that upon re-
fusal of the city manager to approve said appli-
cation, the applicant may within ten days there-
after, appeal in writing to the city council.

That any person or corporation violating any of the terms.
and provisions of this ordinance shall be subject to the same
penalties provided for in Section 1--8 of the Code of Ordinances
of Beaumont, Texas.

That if any section, subsection, sentence, clause or phrase
of this ordinance or the application of same to a particular set of
persons or circumstances should for any reason be held to be invalid,
such invalidity shall in no wise affect the remaining portions
of this ordinance, and to such end various portions and provi-
sions of this ordinance are declared to be severable.
4•
That all ordinances and parts of ordinances in conflict
herewith are hereby repealed.
