LJ-4-,6" ENTITLED AN ORDINANCE AUTHORIZING THE PROPER OFFI- CIALS OF THE CITY OF BEAUMONT TO EXECUTE AND DELIVER A DEED, WITHOUT WARRANTY, TO THE CEREBRAL PALSY FOUNDATION, CONVEYING A PORTION OF CENTRAL PARK, IN BEAUMONT, JEFFERSON COUNTY, TEXAS, AS MORE PARTICU- LARLY DESCRIBED HEREIN, IN EXCHANGE FOR PROPERTY SITUATED IN BEAUMONT, JEFFERSON COUNTY, TEXAS, IN THE H. WILLIAMS SURVEY, AS MORE PARTICULARLY DE- SCRIBED HEREIN. WHEREAS, The Cerebral Palsy Foundation, of Beaumont, Jefferson County, Texas, has agreed to an exchange of property with The City of Beaumont, which involves The Cerebral Palsy Foundation, conveying to The City of Beaumont, a 12.497 acre tract, more or less, out of the East one half (2) of Block Eleven (11) of the subdivision of the West one half (2) of the H. Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, being more particularly described as follows, to wit: Being a twelve and four hundred ninety seven thousandths (12.497) acre tract of land lying west of Dowlen Road and north of Hall Road and being out of the east one half of Block 11 of the subdivision of the west one half of the H. Williams Survey, Abstract 56, Beaumont, Jefferson County, Texas, and being more particu- larly described by metes and bounds as follows: Beginning at a point in the north line of Hall road marking the southwest corner of the tract herein described, said corner being located South zero degree. forth --three minutes thirty seconds East (S 000 431 3011 E) a distance of six hundred fifty-three and zero hundredths (653.00) feet along the west line of the west one half of Block 11 of the subdivision of the west one half of the H. WHEREAS, the City Council finds that the property to be conveyed to The City of Beaumont by The Cerebral Palsy Foundation, is required for park purposes. That there exists a public need for suitable park and recreational facilities where the above property is located in that said property is located in an area where park and recreational facilities do not at present exist, but the public need for same does exist. That said property is adequate, suitable, and sufficient in all respects for park purposes and will be beneficial to the public as a whole, as a park. WHEREAS, the City Council further finds that the property to be conveyed by The City of Beaumont is no longer required for park purposes. That the abandonment, conveyance, and subsequent use thereof will not impair, in any respect, the remaining properties use'as a public park, in that there is adequate, suitable, and sufficient remaining park area and facilities for public use. That the change of use of the said property will be beneficial to the public; Now, Therefore: BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the Mayor be, and he is hereby authorized to execute and deliver for and on behalf of The City of Beaumont a Deed, without covenants or warranty of any kind, either express or implied, conveying to the Cerebral Palsy Foundation of Beaumont, Jefferson County, Texas, the following described property to wit: Being a strip of land two hundred (200) feet in width off the west side of what is now known as the City of Beaumont Central Park property (formerly known as the old Municipal Golf Course property) in the David Brown Survey, Jefferson County, Texas, and being more particularly described by metes and bounds as follows: Beginning at the intersection of the existing south line of Fannin Street (said street having an eighty (80) foot right of way) with the existing east line rive / S J Lout, r':LgILL, UL way auu L urineriy ueiiiV_ called Ninth Street), said point lying North 89 degrees 58 minutes 40 seconds 'East fifty (50) feet and South zero degree 04 minutes West twenty (20) feet from the original northwest corner of said old Municipal Golf Course property and said point also being in the present west line of the City of Beaumont Central Park property; Thence South zero degree 04 minutes West along the existing east line of said Eighth Street or the existing west line of said City of Beaumont Central Park property one thousand two hundred two and thirty-three hundredths (1202.33) feet to corner, said point lying fifty (50) feet north of the existing north line of College Street (said street having an eighty (80) foot right of way); Thence North 89 degrees 59 minutes East along a line parallel with and fifty (50) feet distant from the existing north line of said College Street two hundred (200) feet to corner; Thence North zero degree 04 minutes East along a line parallel with and two hundred (200) feet distant from the existing east line of said Eighth Street or the existing west li.ne.of said City of Beaumont Central Park property one thousand two hundred two and thirty --three hundredths (1202.33) feet to corner in the existing south line.of said Fannin Street; Thence South 89 degrees 58 minutes 40 seconds West along the existing south line of said Fannin Street two hundred (200) feet to the place of beginning. The above conveyance being subject to the following con- ditions and covenants, to wit: (1) That the property hereby conveyed by The City of Beaumont shall never be used'for private or commercial purposes, as such terms are commonly understood, but shall only be used for charitable purposes by charitable organizations engaged in the medical field and no buildings or improvements shall be constructed or maintained upon said property herein above described except for use for charitable medical purposes; such covenant and condition to be binding upon grantee, its successors and assigns. (2) That The City of Beaumont, shall have one (1) year from date of Deed conveying said property, to remove any and all of its facilities from said property. (3) That the Cerebral Palsy Foundation will furnish good, marketable title to the above described property being conveyed to The City of Beaumont, and a Title Insurance policy thereto, in an amount satisfactory to the City. In case of and upon any violation or nonobservance of the above covenants and conditions and thereupon the said conveyance shall be null and void and the property shall then and there wholly and absolutely revert without suit or re-- entry to The City of Beaumont, its successors or assigns; and no act or omission upon the part of any of the officers of The City of Beaumont shall be a waiver of the operation or enforcement of either said covenants or conditions. And the City Clerk is hereby authorized to attest to said instrument of conveyance and to affix the seal of The City of Beaumont thereto.
