HomeMy WebLinkAboutORD 15 GGENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAU- MONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A TRACT OF LAND APPROXIMATELY 3.0 ACRES IN SIZE OUT OF LOTS ONE (1) AND TEN (10), BLOCK TWO (2), FRENCH SUBDIVISION IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED TTR_ltt AND 'IC -11t TO "R--3"; AND BY CHANGING THE CLASSIFICATION OF A PORTION OF LOT FIVE (5), BLOCK FORTY-TWO (42), ARLINGTON ADDI- TION, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-211 TO "C-2tt; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42x-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, . presently zoned ttR-lTt, Single -Family Dwelling District, and "C-111, Neighborhood Commercial District, to "R --31t, Modified Two -Family and Multiple Dwelling Dis- trict, to wit: Parts of Lots 1 and 10 of Block 2, French Subdivision to The City of Beaumont, Jefferson County, Texas, more fully described as follows: Being that portion of Lots 1 and 10 of Block 2 of French Subdivision lying North of Delaware Street, East of Eastex Freeway, South of Blackmon Lane, and West of 16th Street, and being approximately 3.0 acres in size, and having approximately frontages as follows: Eastex Freeway 860 feet 16th Street 860 feet Delaware Street 150 feet Blackmon Lane 154 feet, and including one half of the widths of all bounding streets; and by changing the zoning classification of the following described property, presently zoned "'R-9211, Two -Family and Multiple Dwelling District, to ttC-21t, Central Commercial District, to wit: Being that portion of Lot No. 5 of Block No. 42 of Arlington Addition to The City of Beaumont, Jeffer- son County, Texas, which lies on the Southwest side of a line parallel to and 200 feet from the South- west line of Railroad Avenue, and including one half' of the widths of bounding streets and alleys; said tract being more fully described as follows: Beginning at the point of intersection of the center- line of the 50 -feet wide Irving .Avenue with the centerline of the extension of the 15 -feet wide alleys in Block Nos. 41 and 42; Thence South 880 561 East along the centerline of extension of 15P4feet wide alley in Block No. 42 and along the centerline of said alley for a distance of 32.1 feet; Thence south 37° 161 'East for a distance of 114.6 feet to point in South line of Lot No. 5 of Block No. 42, same being in the South line of a former 15 -.feet wide alley; Thence South 821 191 West along South line of Block No. 42 and along North line of Block No. 1 of Arling- ton Addition for a distance of 104.4 feet to a point in centerline of Irving Avenue; Thence North 010 041*East along the centerline of Irving Avenue for a distance of 105.8 feet to the place of beginning; and the official Zoning Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property herein -- above described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning af- fecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordi- nances of Beaumont, Texas. 1964.
