OF ORDINANCES OF BEAUMONT, TEXAS, BY AMENDING SECTIONS
10»3 AND 10.4 THEREOF; PROVIDING FOR SEVERABILITY, AND
REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS:
1.
That Section 10-3 of the Code of Ordinances of Beaumont, Texas,
be and the same is hereby amended to read as follows:
'LSec. 10..3. Same ---- Amounts on pleas of guilty.
ttWhenever the defendant, in any prosecution had in
the corporation court, shall plead ?guilty? to the
charge, the following items of costs shall be taxed
against and be paid by any such defendant:
'LFor each warrant of arrest or capias
executed, or arrest without warrant .... $2.00
1tCommitment ............................. 1.00
"Release ................................ 1.00
"Trial Fee .............................. 3.00
"Serving of any writ other than above... 1.00
"Summoning each witness ................. .75
"Approving bond ......................... 1.50
"Filing and docketing ................... .10
"Taxing costs ........................... .10.1t

That Section 10-4 of the Code of Ordinances of Beaumont, Texas,
be and the same is hereby amended to read as follows:
"Sec. 10.»4. Same --- Amounts on pleas of not guilty,
and on appeal from adverse jury verdict.
"(a) Whenever the defendant, in any prosecution had
in the corporation court shall plead ?not guilty? to
the charge, the following items of cost shall be taxed
against and paid by any such defendant upon conviction:
"For each warrant of arrest or capias
executed, or arrest without warrant .... $2.00
"Commitment ............................. 1.00
stRelease................................ 1.00
"Trial Fee... ............ o ............ 0. 5.50
tsSummoning each witness .................$ .75
"Serving any writ other than above...... 1.00
"Filing and approving each bond......... 1.50
"Filing and docketing ................... .10
"Taxing Costs ........................... .10..
tt(b) Whenever the defendant, in any prosecution had
in the corporation court, shall plead snot guilty? to
the charge and demand a trial by jury, and found
guilty, the following items of costs shall be taxed
against and be paid by any such defendant,.in addition
to the cost taxed by the preceding paragraph:
"Summoning jury .........................$1.00
tiJury fee ............................... 3.00.
"In the event the defendant shall prosecute an appeal
to the county court, the following items of costs
shall be taxed against and be paid by any such defend-
ant; in addition to the above costs:
"Filing and approving bond of appeal .... $1.50
"Preparing and filing transcript of
appeal ................................. 1 -50 -It

That if any section, subsection, sentence, clause or phrase
of this ordinance and the application of same to.a particular set
of persons or circumstances shall, for any reason, be found to be
invalid, such invalidity shall in no wise affect the remaining por-
tions of this ordinance, and to such end various portions.and pro-
visions of this ordinance are declared to be severable.

That all ordinances and parts of ordinances in conflict here-
with are hereby repealed.
PASSED by the City Council this 24th day of November, 1964.
