HOUSTON LEAGUE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED ttR-111 TO I?C-191; AND BY J CHANGING THE CLASSIFICATION OF A 12.905 -ACRE TRACT OF LAND IN THE F. BIGNER SURVEY IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED 11R-ltt TO "C-111; PROVIDING FOR SEVERABILITY, AND PROVID- ING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tracks of land, presently zoned 1tR-111, Single -Family Dwelling District, to ttC-It, Neighborhood Commercial District, to wit: Three tracts of land in the A. Houston League, City of Beaumont, Jefferson County, Texas, described as follows: Tract No. 1: Beginning at a point 776t West of the intersection of the North right-of-way line of old Sour Lake Road and the West right-of-way line of North Major Drive in the A. Houston League, Jefferson County, Texas; THENCE West 4171 to point for corner; THENCE North 4781 to point for corner; THENCE East 4171 to point for corner; THENCE South 4787 to the point of beginning, containing 4.576 acres, more or less; Tract No. 2: Beginning at a point 776? West of the intersection of the North right-of-way line of old Sour Lake Road and the West right-of-way line of North Major Drive in the A. Houston League, Jefferson County, Texas; 1nr,1Vl.G o uuu-L1 J V • L,u vllc -11 - Road to a point for corner; THENCE West 4171 along the centerline of old Sour Lake Road to a point for corner; THENCE North 301 to a point .for corner; THENCE East 4171 to the place of beginning, containing 0.287 acres of land, more or less; Tract No. 3: Beginning at a point West 7761 and North 4781 from the intersection of.the North right. -of -way line of old Sour bake Road and the West right--of-way line of North Major Drive in the A. Houston League, Jefferson County, Texas; THENCE North 1221 to point for corner; THENCE East 4171 to point for corner; THENCE South 1221 to point for corner;, THENCE West 4171 to the point of beginning and con- taining 1.168 acres of land, more or less; and by changing the zoning classification of the following described property, pr.6sently zoned itR=-11T, Single --Family Dwelling District, to ttC«-ltt, Neighborhood Commercial District, to wit: Being a 12.905 -acre tract of land in the F. Bigner Survey, Beaumont, Jefferson County, Texas, being located between the Eastex Freeway (North 11th Street or U. S. Highway 69x-96-287) and Concord Road, and being Northwest of Treadway Road, and comprising a portion of the abandoned Southern Pacific (S.& E.T.) Railroad right of way, and being more particularly described as follows: BEGINNING at a point in the Southwest line of the former (now abandoned) Southern Pacific Railroad right of way, said point lying in the Eastex Freeway, and said point being located from the intersection of the Northeast right--of-way line of the Eastex Freeway and the South- west line of the said abandoned railroad by the follow- ing course: South'420 021 E., 168.8 feet; and said point'being also located from the intersection of the North line of the F. Bigner Survey,(South line of Thos. Spear League) and the Southwest line of said abandoned railroad by the following course: South 420 021 East, 2,154.5 feet; THENCE North 420 021 West along the Southwest line of the abandoned Southern Pacific Railroad, at a distance of 1,474.7 feet pass the East line of dedicated but, not opened Crow Road and at 1,535.5 feet pass the West line of said road, and continuing for a total distance of 2,154.5 feet to point for corner in the North line of the F. Bigner Survey and the South line of the Thos. Spear Survey; Tn,bAuL aue zasL crossing a.Lagona.L.Ly une auai uui uu railroad for a distance of 134.6 feet; THENCE South 421 021 East along the Northeast line of abandoned railroad for a distance of 475.2 feet; THENCE South 590 221 East for a distance of 195.9 feet; THENCE South 60° 20t East along a line parallel to and 150 feet from the Southwest line of Concord Road for a distance of 1266.8 feet to a point for corner which bears South 280 43t West a distance of 150 feet from a point in the Southwest line of Concord Road which is located Northwesterly a distance of 968 feet from Treadway Road measured along the Southwest line of Concord Road; THENCE South 280 43t West, at a distance of 484.9 feet pass the Northeast line of abandoned railroad, and continuing for a total distance of 590.8 feet to the point of beginning, containing in area 12.905 acres of land, more or less; and the official Zoning Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use'of the property herein- above described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affect- ing any portion of the property described hereinabove shall be de- clared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beau- mont, Texas.
