HomeMy WebLinkAboutORD 36 GGENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES .OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAPOF THE CODE OF ORDINANCES OF_BE.AUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 3.996 -ACRE TRACT OF LAND IN THE A. WILLIAMS LEAGUE, BEAUMONT, JEFFERSON COUNTY) TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED 1tC--11T TO ttI--11t; -PROVIDING FOR SEVERABILITY; AND PROVIDING.A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter..42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, re- ferred to in Section 42«-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned ttC--ltt, Neighborhood Commercial District, to trI-lit, Light Industrial District, to wit: BEING a 3.996 --acre tract of land in the A. Williams League, Beaumont, Jefferson County, Texas, cunpris-- ing Tracts Nos. 192 and 130 of Acreage Plat D-12, said 3.996 -acre tract being bounded on the North by Dollinger Road, on the South by the relocated S. & E. T. Railroad, on the West by the Prater Addition, and on the East by the former Port Realty Co. Tract No. 134; and being more fully described as follows: BEGINNING at a concrete monument in the South line of Dollinger Road, said monument marking the Northeast corner of Perry McFaddin Tract No. 192 and Northwest corner of'Tract No. 134; THENCE S. 000 361E. along :East line of McFaddin tract for distance of 408.8 feet to point in North line of relocated S. & E.T. Railroad; THENCE N. 69° 551 W. along North line of railroad and South line of McFaddin tract for distance of 312.2 feet to Southwest corner of McFaddin tract; THENCE N. 730 571 W. along North line of railroad and along South line of Bassard tract (or Tract No. 130) for distance of 233.7 feet to Southwest corner of Bassard tract and in the East line of Prater.Addi- tion; 1'nr;N L;r, N . 15 3U t W . along the West 13.ne of bassard tract and East line of Prater -Addition for distance of 236.7 feet to point in South line of Dollinger Road; THENCE N. 84° 151 E. along South line of Dollinger Road and along North line of Bassard tract for a distance of 204.0 feet; THENCE S. 88° 141'E. continuing along -'South line of Dollinger Road and also along North line of McFaddin tract for a distance of 374.0 feet to place of be- ginning; CONTAINING in area 3.996 acres of land, more or less; and including one half the widths of bounding street and railroad right of way; and the official Zoning Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property herein- above described shall be subject to all of the applicable regula- tions contained in Chapter 42 of the Code of Ordinances of Beau- mont, Texas, adopted .,August 19, 1958, effective October 19, 1958, as amended. !Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordi- nances of Beaumont, Texas.
