HomeMy WebLinkAboutORD 26 GGENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT,.TEXAS,.AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAU-- MONT, TEXAS, BY CHANGING THE CLASSIFICATION OF TWO TRACTS OF LAND OF APPROXIMATE -LY 16.357 ACRES IN SIZE IN THE W. B. DYCHES SURVEY, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PR-ESENTLY ZONED "R« -l" TO ItC-21t; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42"9 thereof, is hereby amended by changing the zoning classification of the following described tracts of land, presently zoned ItR-11�, Single --Family Dwelling District, to "C --21r, Central Commercial Dis- trict, to wit: BEING Two (2) -Tracts of land in the W. B. Dyches Survey in The City of Beaumont, Jefferson County, Texas, comprising a total of 16.357 acres of land, more or less, and being designated herein Tracts I arid':' II, more fully described as follows: TRACT I. BEING a 7.138 acre tract of land in the W. B.,Dyches Survey located at the northwest corner of Stonetown Road and Best Road, and lying south of Pine Island Bayou and west of Old County (Silsbee) Road, described as follows: BEGINNING at the most westerly southwest corner of that 7.138 acre tract conveyed to Henrietta Theresa Harris, et vir, by warranty deed in Volume 653, Page 636 of the Deed Records of Jefferson County, Texas, said corner lying i:n,.:;the north line of Stonetown Road; THENCE South 57° 001 East along the north line of Stonetown Road ;for a distance of 479.4 feet for a point for corner; THENCE North 630 42t East continuing along the north line of Stonetown Road for a distance of 130.7 feet to a point for corner in the west line of the Old County (Silsbee) Road, said road being 60 feet wide; THENCE North 010 321 East along the west line of the aforesaid road for a distance of 597.2 feet to point for corner; -, Lam uonuinuing along the west line of road for a distance of 13.5 feet to point for corner; THENCE North 22° 191 East continuing along west line of road for a distance of 203.0 feet to point for corner in the south bank of Pine Island Bayou; THENCE North 380 371 West along the south bank of Pine Island Bayou for a distance of 184.3 feet to point for corner; THENCE North 000 171 West continuing along bank of Bayou for a distance of 37.3 feet to point for corner; THENCE South 330 001 West along the westerly line of the herein described 7.138 acre tract to the place of beginning; And also including one half of the width of all bounding streets and bayou right of way. TRACT II. BEING a 9.219 acre tract of land in the W. B. Dyches Survey, said tract alsd being the First Lift Plant Site of the Lower Neches Valley Authority B. I. Canal, said tract lying North of Stonetown Road, West of the abandoned Southern Pacific Railroad, South of the Pine Island Bayou and East of the Old County (Silsbee) Road; described as follows: BEGINNING at the southwest corner of the herein de- scribed tract, said point being the intersection of the north line of Stonetown Road with the east line of the 60 feet wide Old County (Silsbee) Road; THENCE North 010 50 East along the east line of said road for a distance of 561.6 feet to point for corner; THENCE North 220 221 East continuing along the east line of said road for a distance of 174.5 feet to point for corner in the south bank of Pine Island Bayou; THENCE South 55° 301 East along south bank of bayou for a distance of 337.0 feet; THENCE South 750 161 East continuing along south bank of bayou for a distance of 230.4 feet to point for corner in the west line of the abandoned Southern Pacific Railroad; THENCE South 08° 061 East along the west line of said abandoned railroad for a distance of 636.5 feet to point for corner same being the southeast -.corner of the herein described tract-.- THENCE ract; THENCE North 770 121 West along the north line of Stonetown Road and along the south property line of the I..N.V.A. plant site for a distance of 181.0 feet; THENCE North 760 551 West continuing along north line of said road for a distance of 184.76 feet; THENCE North 760 451 West/continuing along the north line of said road for a .distance of 327.5 feet to the place of beginning; And also including one half of the widths of all bounding streets and bayou right of way; and the official Zoning Map of The City of Beaumont is hereby amended to reflect such change. Section 2. ,That in all other respects the use of the property herein- above described shall be subject to all of the applicable regula- tions contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning af- fecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penal- ties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
