'03 e J ORDINANCE NO. -1Gr1�l63 ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE.ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CITY OF BEAUMONT REFERRED TO IN SECTION 42-»9 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS., BY CHANGING THE CLASSIFICATION OF A 5.438 -ACRE TRACT OF LAND IN THE ROSEDALE SUBDIVISION IN THE CITY OF BEAUMONT, TEXAS, IN THE THOMAS SPEAR LEAGUE, JEFFER- SON COUNTY, TEXAS, AT THE INTERSECTION OF EASTEX FREE- WAY AT COLE STREET AND ROSEDALE DRIVE, AS DESCRIBED HEREIN, PRESENTLY ZONED 11R-•ltt TO 11C--2; AND BY CHANGING THE CLASSIFICATION OF A 6.65 --ACRE TRACT OF LAND IN BLOCK 2 OF FRENCH HEIGHTS.SUBDIVISION IN THE DAVID FRENCH ESTATE IN THE A. WILLIAMS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AT THE INTERSECTION OF EAST LUCAS AND SANTA FE RAILROAD, AS DESCRIBED HEREIN, PRESENTLY ZONED 11R--111 TO t1C-111; PROVIDING FOR SEVERABILITY; .AND PROVID- ING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42.-9 thereof, is hereby amended by changing the zoning classification of the following described property, presently zoned 11R -l", Single -- Family Dwelling District, to.11C„211, Central Commercial District, to wit : BEING a 5.438 --acre tract of land in the Rosedale Sub- division.in The City of Beaumont, Texas, in the Thomas Spear League, Jefferson County, Texas, and including Lots 25 3 and west part of Lot 1 -of Block 3 of said subdivision, together with one half of bounding streets, described as follows: BEGINNING at a point of intersection of centerline of Eastex Freeway (U. S. Highway 69--96--287) and Cole Road; THENCE N. 46° 151 W. along centerline of Eastex Freeway and along line parallel with and,150 feet distant from' the westerly -line of Block 3 for a distance of 595.0 feet; FF THENCE N. 43° 454 E. for a distance of 150.0 feet; THENCE N. 890 2.31 E. along centerline of the 60 -foot wide Rosedale Drive for distance of 551.0 feet; THENCE S. 300 251 E. crossing Lot 1 for a.distance of 209.1 feet to point in centerline of Cole Street; THENCE S. 430 451 W. along centerline of 60 --foot wide Cole Street for distance of 478.2 feet to place of beginning; and by changing the zoning classification of the following described property, presently zoned ITR -11t, Single -Family Dwelling District, to TIC-1tT, Neighborhood Commercial District, to wit: BEING a 6.65 -.acre tract of land in .Block 2 of French Heights Subdivision of the David French Estate in the A. Williams Survey, Beaumont, Jefferson County, Texas, described as follows: BEGINNING at southeast corner of Block 2, same being in the southwesterly right-of-way line of Santa Fe Railroad; THENCE S. 870 031 W. along south line of Block 2 for a distance of 646 feet to point for corner; THENCE N. 47° 151 W. for a distance of 264 feet to point for corner; THENCE N. 420 151 E. along a line parallel to and 140 feet distant from.the southeasterly line of 60 -foot wide East Lucas Drive for a distance of 632.1 feet to point for corner in the southwesterly line of Santa Fe Railroad; THENCE S. 340 001 E. along southwesterly right-of-way line of said Railroad for a distance of 734.6 feet to place of beginning; containing in area 6.65 acres, more or less, which includes the City of'Beaumont 0.994 -acre tract (North elevated water storage tank site); and the official Zoni.ng'Map of The City of Beaumont is hereby amended to reflect such changes. Section 2. That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations con- tained in Chapter 42 of the Code of Ordinances.of Beaumont, Texas, .. A a - j�..IJ adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms.and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. Section 4. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
