HomeMy WebLinkAboutORD 81 I I/ J �-? .(.a•-1 �:ts1a{Ria �' ORDINANCE N0. 6 � —LIP $ ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON'THE ZONING MAP OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF THE PROPERTY OF THE SOUTHERN PACIFIC RAILROAD COMPANY, SAID PROPERTY COMPRISED OF SEVERAL TRACTS OF LAND LYING SOUTH OF AND ADJACENT TO THE EAST -WEST TEXAS & NEW ORLEANS (SOUTHERN PACIFIC) RAIL- ROAD COMPANY 100 -FOOT RIGHT-OF-WAY, BEING PART SUBDIVIDED LAND AND PART UNSUBDIVIDED LAND IN THE CITY OF BEAUMONT, JEFFERSON'COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED "R-3" TO "I-1"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: gPotinn 1_ That.Chapter 42 of the Code of Ordinances of Beaumont. Texas, and in particular the boundaries of the zoning dis- tricts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby____ amended by changing the zoning classification of the following described tract,of land, presently zoned "R-3" Modified-Two- Family odifiedTwo- Family and Multiple -Dwelling District to"I-1" Light Industrial District, to wit: All that property being in the�City of Beaumont, Jefferson County, Texas, being the property of the Southern Pacific Railroad Company, said pro- perty comprised of several tracts of land lying south of and adjacent to the east -west Texas & New Orleans (Southern Pacific) Railroad Company 100 -foot right-of-way, being part subdivided land and part unsubdivided land, and being more partidularly described as follows: Tract No . 1 Being a tract of land in the C. Williams League, said tract being..bounded on the north by the south line of the Southern Pacific Railroad Company 100 -foot right-of-way, bounded on the west by the east line of the Caldwood Cut -Off Ditch 200 -foot right-of-way, bounded on the east by the west line of Lots one.through three (1-3), Block two (2), Caldwood Acres Addition, and bounded on the south by the north line of Foxworth Place Addition, containing 4.64 acres of land, more or less; Tract No. 2 Being Lots one through three (1-3), Block two (2), Caldwood Acres Addition, containing 3.03 acres of land, more or less; Tract No. 3 Being Lot five (5), Block three (3), Caldwood Acres Addition, containing .81 acres of land, more or less; Tract No. 4 Being Lots one through ten (1-10), Block one (1), Caldwood.Acres Addition, containing 8.06 acres of land, more or "less; Tract No. 5 Being a tract of land out of Plat B-18, C. Williams League, known as Tracts 6 and 125, more particularly described as follows: Beginning at a point in the south right-of-way line of the 100 -foot Southern Pacific Railroad Company right-of-way, said point being the northeast corner of Lot one (1), Block one (1), Caldwood Acres Addition; Thence in a northeasterly direction along the south line of the Southern Pacific Railroad Company 100 -foot right-of-way a distance of 1835 feet, more or less, to a point for corner, said point being sixty-five (65) feet west of the east line of the C. Williams Survey, said point also being sixty-five (65) feet west of the west line of the Noah Tevis Survey; Thence in.a southerly direction a distance of 665 feet, more or.less, to a point for corner, said point being the northeast corner of Lot fifty (50), Block seven (7), Sunnyside Addition; Thence in a westerly direction a distance of 1045 feet, more or less, to a point for corner, said point being the northwest corner of Lot twenty, -nine (29), Block eighteen (18), Sunnyside Addition; Thence in a southerly direction a distance of twenty-five (25) feet to a point for corner, said point being the southwest corner of Lot twenty- nine (29), Block eighteen (18), Sunnyside Addition; Thence in a westerly direction along the north property line of Lot seven (7), Block eighteen (18), Sunnyside Addition a distance of 150 feet to a point, said point being the northwest corner of Lot seven (7), Block eighteen (18), Sunnyside Addition; Thence continuing in a westerly direction a dis- tance of 55 feet to a point for corner in the west right-of-way line of the Delmar Street 55 -foot right-of-way; -2- t., 'Fl _Y Thence in a southerly direction a distance of twenty-five (25) feet, more or less, to a point for corner, said point being the northeast corner of Lot forty-eight (48), Block eleven (11), Sunnyside Addition; Thence in a westerly direction along the north property line of Lot forty-eight (48), Block eleven (11), Sunnyside Addition, and continuing in a westerly direction along the westerly extension of same, a distance of 580 feet, more or less, to a point for corner in the east line of Lot one (1), Block four (4), Caldwood Acres Addition; Thence in a northerly direction a distance of 461.5 feet, more or less, to the place of be- ginning, containing 24.24 acres of land, more or less. Tract No. 6 Being a portion of the Southern Pacific 100 -foot right-of-way bounded on the west by the east line of the 200 -foot Caldwood Cut -Off Ditch and bounded on the east by a line sixty-five (65) feet west of the east line of the C. Williams Survey, said Southern Pacific Railroad right-of-way being south of and adjacentto the south line of the Caldwood Addition and also south of and adjacent to an unsubdivided tract of land, said unsubdivided tract lying between the present east line of the Cald- wood Addition and the present west line of the Colonial Manor Addition. The above named tracts and lots containing 50.190 acres of land, more or less, and one-half of the abutting street right. -of -way. and the official zoning map of The City of Beaumont is hereby amended to reflect such changes. gPrtinn 7_ That in all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described here- inabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the pro- perty described herein. -3- That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas.
