ENTITLED AN ORDINANCE VACATING AND ABANDONING
A FIFTY FOOT (50) BY TWENTY FOOT (20) ALLEY
LOCATED BETWEEN LOTS ONE (1) AND TWELVE (12),
BLOCK SIX (6), CUCHIA ADDITION TO THE CITY OF
BEAUMONT, AND MORE PARTICULARLY DESCRIBED
HEREIN; PROVIDING THAT SUCH ABANDONING SHALL
IN NO WAY EFFECT A CERTAIN EASEMENT FOR
GENERAL UTILITY PURPOSES, DATED -NOVEMBER 13,
19683 AS SET FORTH HEREIN.
WHEREAS, Wallace L. Downs and wife, Frankie 0. Downs
and Elizabeth Brunette, have requested that the alley
located between Lots One (1),and Twelve (12), Block Six (6),
Cuchia Addition to the City of Beaumont, as more particularly
described herein, be vacated and abandoned; and,
WHEREAS, said request has been referred to the
Planning and Zoning Commission of The City of Beaumont for
examination and approval, and the same has been.approved by
said commission; and,
WHEREAS, it appears to the City Council that it is
to the best interest of The City of Beaumont and benefit of
the public that the hereinafter described alley be vacated
and abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT, TEXAS:
That the following alley located between Lots One. (1) and
Twelve (12), Block Six (6), Cuchia Addition to The City of
Beaumont be and the same is hereby vacated and abandoned and
that title to said portion of said vacated and abandoned
alley shall revert to and become the property *,f the person
entitled thereto, as provided by law, said portion being
described as follows:

BEINGa piece of land lying in Block six
(6) of the Cuchia Addition to the City of
Beaumont, Jefferson County, Texas, and being
more particularly described as follows:
BEGINNING at a point in the west right-of-
way line of the Elba Street fifty (50) foot
right-of-way, said point being the northeast
corner of Lot one (1.), Block six (6), Cuchia
Addition to the City of Beaumont, Jefferson
County, Texas;
THENCE in a westerly direction a distance of
fifty (50) feet to a point for corner, said
point being the northwest corner of Lot one
(1), Block six (6), said addition;
THENCE in a northerly direction a distance
of twenty (20) feet to a point for corner,
said point being the southwest corner of Lot
twelve (12), Block six (6), said addition;
THENCE in an easterly direction.a distance of
fifty (50) feet to a point for corner, said
point lying in the west line of the Elba Street
fifty (50) foot right-of-way.and also being
the southeast corner of Lot twelve (12), Block
six (6), said.addition;
THENCE in a southerly direction along the west
right-of-way line of Elba Street a distance of
twenty (20) feet to the place of beginning.
Provided, however, that the vacating and abandoning of said
alley shall not be construed as abandoning and shall in no
way.affect the easement for general utility purposes granted
on November 13, 19681) by Wallace L. Downs and wife, Frankie
0. Downs and Elizabeth Brunette, to The City of Beaumont
across property in the Cuchia Addition to The City of
Beaumont, Jefferson County, Texas; the rights granted in
said easement for general utility purposes being expressly
reserved.
