HomeMy WebLinkAboutORD 69 I IORDINANCE NO. r e ENTITLED AN ORDINANCE VACATING AND ABANDONING A DEDICATED TWENTY FOOT (20) ALLEY RUNNING EAST AND WEST FOR THREE HUNDRED FEET (3001), LYING EAST OF ELBA STREET AND BEING LOCATED IN BLOCK ONE (1) OF THE G. CUCHIA ADDITION TO THE CITY OF BEAUMONT, AS MORE PARTICULARLY DESCRIBED HEREIN; PROVIDING THAT SUCH ABANDONING SHALL IN,NO WAY EFFECT A CERTAIN EASEMENT FOR GENERAL UTILITY PURPOSES, DATED SEPTEMBER 13, 1968, AS SET FORTH HEREIN. WHEREAS, Randolph E. Leger and wife, Bertha 0. Leger, James A. White and wife, Myrna White, Clarence F. Speed and wife, Myrtis B. Speed, Jack T. Doiron and wife, Rose Marion Doiron, and Joe N. Fields and wife, Charlie M. Fields, have requested that the alley running east and west for three hundred feet (300'), lying east of Elba Street and being located in Block One (1) of the G. Cuchia Addition to -the City of Beaumont, as more particularly described herein, be vacated and abandoned; and, WHEREAS, said request has been referred to the Planning and Zoning Commission of The City of Beaumont for examination and approval, and the same has been approved by said commission;.and; WHEREAS, it appears to the City Council that it is to the best interest of The City of Beaumont and benefit of the public that the hereinafter described alley be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the following alley located in Block One (1) of the G. Cuchia Addition to The City of Beaumont, said alley running east and west for three hundred feet (300'), and lying east of Elba Street in The City of Beaumont, be and the same is hereby vacated and abandoned and that title to said portion of said vacated and abandoned alley shall revert to and become the property of the person entitled thereto, as pro- vided by law, said portion being described as follows: BEING a dedicated twenty (20). -foot alley running east and west for three hundred (300) feet, lying east of Elba Street and being located in Block One (1) of the G. Cuchia Addition to the City of Beaumont, Jefferson County, Texas, Map.Records, Volume 5, page 65, and more particularly described as follows: BEGINNING at a point in the most easterly right-of-way line of Elba Street fifty (50) foot right-of-way, said point being the southwest corner of Lot Twelve (12), Block One (1), G. Cuchia Addition'to the City of Beaumont; THENCE in an easterly direction along the southerly lot lines of Lots Seven (7) thru Twelve (12), Block One (1), said addition, a distance of three hundred (300) feet to a point for corner, said point being the southeast corner of Lot Seven (7), Block One (1), said addition, said point also being one hundred forty (140) feet south of a point in the most southerly right-of-way line of the Genoa Street fifty (50) foot.right-of-way; THENCE in a southerly direction a distance of twenty (20) feet to a point for corner, said point being the northeast corner of Lot One (1), Block One (1), said addition; THENCE in a westerly direction along the northerly lot lines of Lots One (1) thru Six (6), Block One (1), said addition, for a distance of three hundred (300) feet to a point for corner, said point being in the most easterly right-of-way line of the Elba Street fifty (50) foot right-of-way, said point also being the northwest corner of Lot Six (6), Block One (1), said addition; THENCE in a northerly direction along the east right-of-way line of the Elba Street fifty (50) foot right-of-way a dis- tance of twenty (20) feet to a point for corner, said point being the place of beginning, containing 0.137 acres of land, more or less. Provided, however, that the vacating and abandoning of said alley shall not be construed as abandoning and shall in no way affect the easement for general utility purposes granted on :September -.13, 1968, by Randolph E. Leger and wife, Bertha 0. Leger, James A. White and wife, Myrna White, Clarence F. Speed and wife, Myrtis B. Speed, Jack T. Doiron and wife, Rose Marion Doiron, and Joe. N..Fields and wife, Charlie M. Fields, to The City of Beaumont across property in the -2- G. Cuchia Addition to The City of Beaumont, Jefferson County, Texas; the rights granted in said easement for general utility purposes being expressly reserved.
