HomeMy WebLinkAboutORD 63 I IORDINANCE N0, g –, 7 ENTITLED AN ORDINANCE AMENDING CHAPTER 37 SECTION 37-58.2 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS; ESTABLISHING PRIMA FACIE SPEED LIMITS UPON CERTAIN STREETS OR PORTIONS OF STREETS WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF; BY ADDING PORTIONS OF TRAM,BROUSSARD, DOWLEN, OLD VOTH, AND BIGNER ROADS, AND GLADYS AND CALDER AVENUES; TO THE 11SCHEDULE" OF SPEED LIMIT REGULATIONS OF SECTION 37-58.2; PROVIDING A PENALTY; PROVIDING FOR SEVER- ABILITY; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That section 37-58.2 of the Code of Ordinances of Beaumont, Texas, is hereby amended to read as follows: Sec. 37-58.2. Same—Changed in certain zones. It is hereby determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the street or portion thereof described in the schedule below is greater in some cases and less in some cases than is reasonable or safe under the conditions found to exist upon such street or portion thereof, and it is hereby declared that the prima facie speed limit upon that street or portion thereof described in the schedule below shall be as therein stated, when signs are erected giving notice thereof. S C H E D U L E In accordance with this section, and when signs are erected giving notice thereof, the prima facie speed limit shall be as set forth in this schedule at all times, upon that street or portion thereof specified herein: Direction Maximum Speed Street Limits of Zones of Travel In Miles Per Hour Washington Boulevard (a) From the west right-of- way line of Eleventh East Street to a point fifty & feet (50') west of the West relocated Hillebrandt Bayou bridge. 35 mph (b) From a point 50' west of the relocated Hille- East brandt Bayou bridge to & . the east right-of-way West line of FM 364 (Major Drive): Tram Road (a) From the west right-of- way line of 01d Voth East Road to 50' west of the & west right-of-way line West of FM 364 Extension. (b) From a point 50' west of the west right-of-way East line of FM 364 Extension & to the west City Limits. West Broussard Road (a) From the northerly right- East of -way line of Tram Road & to the west City Limits. West Dowlen Road (a) From the north right-of- way line of Calder Avenue North to a point 100' north of & the north right-of-way South line of Gladys Avenue. (b) From a,point 100' north of the north right -of- North way line of Gladys Avenue & to a point 200' south of South the center line of Cole Road. (c) From a point 200' south of the center line of Cole Road to the south right-of-way line of State Highway 105 (Sour Lake Road). . Calder Avenue (a) From the west right-of- way line of Main Street to the west right-of-way line of 18th Street. (b) From the west right-of- way line of 18th Street to a point 150' west of the center line of the Caldwood Cut-off Ditch bridge. Gladys Avenue (a) From the west right-of- way line of Interstate East Highway 10 to the west & 30 mph right-of-way line of West Howell Street. (b) From the west right-of- way line of Howell Street East to a point 1100' west of & 35 mph the center line of Dowlen West Road. (c) From a point 1100' west of the center line of East Dowlen Road to the east & 45 mph right-of-way line of FM West 364 (Major Drive) . 2. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 3. That if any section, subsection, sentence, clause or phrase of this ordinance or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall in no wise affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. -3- 4.
