ENTITLED AN ORDINANCE VACATING AND ABANDONING THE ALLEY LOCATED BETWEEN LOT SIX (6), BLOCK FOUR (4), PERKINS ADDITION AND LOTS EIGHT (8), NINE (9), AND TEN '(10), BLOCK TWELVE (12), FOREST ADDITION TO THE CITY OF BEAUMONT AS MORE PARTICULARLY DESCRIBED HEREIN: PROVIDING THAT SUCH ABANDONING SHALL IN NO WAY EFFECT A CERTAIN EASEMENT FOR GENERAL UTILITY PURPOSES, DATED MAY 13,.1968, AS SET FORTH HEREIN. WHEREAS, E. A. Stephenson, M. D. and Mary Jo Heider, S. M. Doiron Estate by Woodrow Doiron Independent Executor, Gladys Doiron, Stella .Belle Doiron, Walter L. Doiron, and Woodrow Doiron, have requested that the alley located between Lot Six (6), Block Four .(4), Perkins Addition and Lots Eight (8), Nine (9), and Ten (10), Block Twelve (12), Forest Addition to The City of Beaumont; as more particularly des- cribed herein, be vacated and abandoned; and, WHEREAS, said request has been referred to the Planning and Zoning Commission of The City of Beaumont for examination and approval, and the same has been approved by said commission; and, WHEREAS, it appears to the City Council that it is to the best interest of The City of.Beaumont and benefit of the public that the hereinafter described.alley be vacated and abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: That the following alley located between Lot Six (6)', Block Four (4), Perkins Addition and Lots Eight (8), Nine (9), and Ten (10), Block Twelve (12), Forest Addition to The City of Beaumont, be and the same is hereby vacated.and abandoned and that title to said portion of said vacated and abandoned alley shall revert to and become the property of the person entitled thereto, as provided by law, said portion being des- cribed as follows: C9' 7 A.., q_T _/['1 �t:3-.Io�'i/ BEING the dedicated length of the twenty -foot (20') wide north -south alley bounded on the west by Lot six (6), Block four (4), Perkins Addition to the City of Beaumont, Jefferson County, Texas, and on the east by Lots eight, nine, and ten (8, 9, & 10), Block twelve (12), Forest Addition to The City of Beaumont, said alley being one hundred and forty feet (140') in length and extending from the south right-of-way line of Earl. Street south for one hundred and forty feet (140') to the south lot lines of Lot six (6), Block four (4), Perkins Addition, and Lot ten (10), Block twelve (12), Forest Addition, containing .066 acres, more or less. Provided, however, that the vacating and abandoning of said alley shall not be construed as abandoning and shall in no way affect the easement for general utility purposes granted on May 13, 1968, by E. A. Stephenson, M. D. and Mary Jo Heider, S. M. Doiron Estate by Woodrow Doiron Independent Executor, Gladys Doiron, Stella Belle Doiron, Walter L. Doiron, and Woodrow Doiron, to The City of Beaumont across property in the Perkins Addition and Forest Addition to The City of Beaumont, Jefferson County, Texas; the rights granted in said.easement for general utility purposes being expressly reserved.
