ENTITLED AN ORDINANCE VACATING AND ABANDONING
A PORTION OF LIBERTY AVENUE BETWEEN LOT 16,
BLOCK 49 OF THE AVERILL ADDITION TO THE CITY
OF BEAUMONT) TEXAS, AND LOT 15, BLOCK 48 OF
SAID ADDITION, AS MORE PARTICULARLY DESCRIBED
HEREIN; AND AUTHORIZING THE PROPER OFFICIALS
OF THE CITY OF BEAUMONT TO EXECUTE AND DELIVER
FOR AND ON BEHALF OF THE CITY OF BEAUMONT THE
DEED WITHOUT WARRANTY, EXPRESS OR IMPLIED,
CONVEYING TO HEADS, INC. A PORTION OF SAID
ABANDONED LIBERTY AVENUE AND A PORTION OF LOT
16, BLOCK 49 OF SAID AVERILL ADDITION AS MORE
FULLY DESCRIBED HEREIN.
WHEREAS, the location of Liberty Avenue as shown on the
plat of Averill Addition to The City oT_ Beaumont,•Texas, recorded
in Vol. 1, Page 131-132 of the Map Records of Jefferson County,
Texas, at its intersection with Eleventh Street has been revised
and a portion of said Liberty Avenue has been relocated; and,
WHEREAS, it appears to the City Council that there is no
further need for the portion of said Liberty Avenue described
in Section 1 of this ordinance and that it is to the best interest
of The City of Beaumont and benefit to the public that same be
vacated and abandoned; and,
WHEREAS, Heads, Inc., a Texas Corporation, has offered The
City of Beaumont Seven Thousand Six Hundred Two and No/100 ($7,602)
Dollars f& thetract of land described in Section 2 of this
ordinance, same being a part of Liberty Avenue as abandoned in
Section 1 of this ordinance and a part of Lot 16, Block 49 of
the Averill Addition to The City of Beaumont, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF
BEAUMONT, TEXAS:
Section 1.
That the following described portion of Liberty Avenue in
The City of Beaumont, Texas, be and the same is hereby vacated
being described as follows. to wi
BEING that portion of the. present Liberty Avenue
60 foot right of way, as shown on the plat of
Averill Addition to The City of Beaumont, recorded
in Vol. 1, Page 131-32, of the Map Records of Jefferson
County, Texas, bounded on the west by the east line of
the 11th Street 80 foot right of way, on the east by
the southerly projection of the common lot line of Lots
16 and 17, B ock 49, Averill Addition to The City of
Beaumont, and.the northerly projection of the common
lot line of Lots 14 and 15, Block 48, of said addition,
bounded on the north by the north right of way of the
said Liberty Avenue 60 foot right of way, said line
being the south line of Lot 16, Block 49, of said
addition, bounded on the south by the south line of
the said Liberty Avenue 60 foot tight of way, said line
being the north line of Lot 15, Block 48, of said
addition, save and except that portion being more
particularly described'as follows:
BEGINNING at a point in the north line of the said
Liberty Avenue 60 foot right of way, said point being
the southeast corner of Lot 16, and the -southwest corner
of Lot 17, Block 49, of said addition;
THENCE South 00017' East along the southerly projection
of the common lot lines of Lots 16 and 17, Block 49,
of said addition, a distance of 14.29 feet to a point
for corner;
THENCE in a northwesterly direction along the arc of a
curve to the left, said curve having a radius of 167.12
feet and a central angle of 10032`, a distance of 30.73
feet to a point for corner, said point lying in the north
line of the said Liberty Avenue 60 foot right of way;
THENCE North 89043` East along the north line of the said
Liberty Avenue 60 foot right of way, a distance of 26.42
feet to the place of beginning;
Containing 72 thousandths (0.072) acres, more or less.
Section 2.
That Jack M. Moore, Mayor, be and he:l-is hereby authorized
to execute and deliver for and on behalf of The City of Beaumont
the deed without warranty express or implied to Heads, Inc., a
Texas Corporation, conveying the following described tract of
land, to wit:
BEING a 0.043 acre tract of land out of the Noah Tevis
League, said tract being a part of Liberty Avenue, as
shown ori the plat of Averill Addition to The City of
Beaumont, recorded in Vol. 1, Page 131-32 of the Map
Records of Jefferson County, Texas, and Lot 16, Block 49
of the Averill Addition to The City of Beaumont,
Jefferson County, Texas, and being more particularly
described as follows:

on the southerly projection of the common lot line
between Lots 16 and 17, Block 49, of said addition,

corner of Lot 16 and the southwest corner of Lot;.

THENCE in a southerly direction along the arc of a
curve to the right, said curve having a radius of
