HomeMy WebLinkAboutORD 38 I I/i lQ'U ORDINANCE NO. a ENTITLED AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF BEAUMONT, TEXAS, REFERRED TO IN SECTION 42-9 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS; DESIGNATING THE TRACT OF LAND DESCRIBED HEREIN AS A PLACE OF HISTORIC AND CULTURAL SIGNIFICANCE; REGULATING AND RESTRICTING CONSTRUCTION, ALTERATION, RECON- STRUCTION OR RAZING OF BUILDINGS AND STRUCTURES ON SAID LAND; REGULATING THE USE OF SAID LAND, THE SIZE OF YARDS AND OPEN SPACES; -PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. WHEREAS, the hereinafter described tract of land and the structure standing thereon is the John Jay French Trading Post which was built in the vicinity of the Old Opelousas Road before 1842 and was in operation in 1842; and, WHEREAS, this is the oldest commercial structure still standing in Beaumont and the Beaumont Heritage Society desires to restore it to its appearance during the time of the Republic o.f_..T.exas__and to.. operate same as a historic museum; and, WHEREAS, the hereinafter described tract of land and the struc- ture thereon is hereby found to be a place of historical and cultural importance and significance and these regulations are established to protect and preserve such place; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: 1. That the following described -tract of land, to wit: Being a tract of land out of and a part of the A. Williams Survey and that certain five acre tract of land, a part of the Percelia French Easters, 24.36 acre tract as described in deed dated February 2, 1948, C. C. Aldridge to M:A. Merchant et ux Wier Merchant and recorded in Volume 692, Page 523, of the Deed Records of Jefferson County, Texas: BEGINNING at an iron stake in the West line of French Road also being the most easterly corner of the lipid THENCE South 33055' West, along and with the East ,line of the said five acre tract 185.50 feet to a point for corner, said point being also,the most easterly corner of Westmont Addition to The City of Beaumont, Texas, as recorded in Volume 10, Page 139 of the Map Records of Jefferson County, Texas; THENCE North 54032' West, along and with the North line of the said Westmont Addition 239.10 feet to a steel pin for corner; THENCE North 33055' 00°' East, 225.00 feet to a steel pin for corner.in the West line of Arbor Lane; THENCE with the said West line of Arbor Lane South 56005' East 131,46 feet to a steel pin..for corner; THENCE South 59053'13°' West., 43.94 feet to a steel pin for corner; THENCE South 56005' East 126.88 feet to the PLACE OF BEGINNING, and one-half of the abutting right of way. is hereby designated as a place of historic and cultural importance and significance and after the completion of restoration of the original structure up.6n said land; there shall be no further structural alteration, enlargement or razing of said structure. 2. (a) The regulations set forth in this Section shall apply within the above described tract of land. (b) Use Regulations. 'The above described tract of land shall be used only for the purpose of an historic museum. Admission may be charged at said museum and historical information and related artifacts may be sold but nocther commercial use is permitted. Said museum shall be operated only during daylight hours. No buildings shall be constructed upon said tract other than the existing historical structure. (c) Area Regulations. The setbacks, yards, and open space that now exist upon said tract of land shall not be (d) Off Street Parking Regulations. Ten (10) Parking Spaces shall be provided off the streets and upon said tract of land for visitors. (e) Sign Regulations. No signs shall be located upon the above described tract of land other than one (1) indirectly illuminated or non -illuminated identification sign with a maximum surface or legend -area of twenty (20) square feet. 3. The Zoning Map of The City of Beaumont, referred to in Section 42-9 of the'Code of Ordinances of Beaumont, Texas, is hereby amended to reflect the zoning change above set forth. In all other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 `of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958, effective October 19, 1958, as amended. 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. 5. That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties as provided for in the said Chapter 42 of the Code of. Ordinances of Beaumont, Texas PASSED by the City Council tHs2a_n day of 1968.
