ENTITLED AN ORDINANCE REPEALING ORDINANCE

TEXAS, ON MARCH 12, 1968; AND IN LIEU THEREOF,
VACATING AND ABANDONING AN EASEMENT IN SECOND
STREET FROM..SOUTH.STREET TO THE TEXAS & NEW
ORLEANS _RAILROAD. RIGHT OF WAY. IN THE CITY OF
BEAUMONT, TEXAS.
WHEREAS, by Ordinance 68-13 dated and passed on March 12, 1968,
The Citycof Beaumont vacated and.abandoned an easement.in Second
Street from Laurel Avenue to the Texas & New .Orleans Railroad
right of way in The City of Beaumont, except where Second Street
intersects South Street, and the true intent of the City Council
was to vacate and abandon an easement in Second Street from
South Street to the Texas & New Orleans Railroad right of way
in The City of Beaumont; and,
WHEREAS, it has been determined by the City Council that
Ordinance 68-13 should be repealed and a new ordinance enacted
showing the true intent of the City Council;
NOW, THEREFORE., -BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT:
1.
That Ordinance 68-13 passed on.March 12, 1968, be and the
same is hereby in all things, repealed;
2.
In lieu thereof that the easement and all rights to maintain
water, sewer, and drainage or utility facilities as reserved in an
ordinance passed on August 13, 1929, in Second Street from South
Street to the Texas & New Orleans Railroad right of way in The
City of Beaumont, are hereby -..in all things vacated and abandoned.
PASSED by the City Council this 4,574day of March, 1968.
