ENTITLED AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD IN THE CITY OF BEAUMONT., TEXAS, ON THE 13TH DAY OF JANUARY,1968, TO DETERMINE WHETHER THE PROPOSED MINIMUM SALARY OF $550.00 PER MONTH FOR FIREMEN AND POLICEMEN SHALL BE ADOPTED; NAMING THE PLACES WHERE SAID ELECTION SHALL BE HELD; APPOINTING OFFICERS TO PRESIDE OVER SAID ELECTION; PROVIDING.FOR THE FORM OF NOTICE THEREOF;'PROVIDING FOR THE FORM OF BALLOT FOR USE IN SAID ELECTION; AND PROVIDING THE MANNER OF HOLDING SAID ELECTION. WHEREAS, on October 16, 1967, a petition waa filed with the City Council proposing a minimum salary of $550.00 per.month for firemen and policemen and calling for an election to -determine whether such proposed minimum sal>ary shall be adopted; and, WHEREAS, said petition was signed by a sufficient number of qualified voters of The City ofBeaumont; and, WHEREAS, Article 1583-2 of Vernon's Texas Penal Code, as amended, provides that if such a petition is filed, the City Council shall call an election within ninety -(90) days after said petition has been so filed to determine whether said proposed minimum salary shall be adopted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY.OF BEAUMONT, TEXAS: Section 1. That in accordance with the provisions of the laws of the State of Texas, a special election within the corporate limits of The City of Beaumont is hereby ordered to be held on the 13th day of January, 1968; to determine whether the proposed minimum salary of $550.00 per month for firemen and policemen shall be adopted. Section 2. Legally qualified voters residing within the corporate limits of The City of Beaumont shall be entitled to vote at said election. Section 3. That the Jefferson County Election Precincts heretofore established within The City of Beaumont are hereby combined into municipal election precincts as hereinafter set forth for said election and each qualified voter shall vote in the municipal election precinct of his residence. Said election shall be conducted and held in the several municipal election precincts so desginated and at the respective polling places hereinafter stated, and the following named persons are hereby appointed officers to conduct said election in said municipal election precincts, respectively, COUNTY PRECINCT NO. The presiding judge for each municipal election precinct shall appoint two clerks and as many additional clerks as he deems necessary for the proper:.;, conduct of the election; provided not more than a total of five clerks shall be appointed for any municipal election precinct, who shall be selected from different political parties when practicable. Section 4. That notice of said election shall be given: (a) by posting the notice of election hereinafter prescribed, together with a copy of this ordinance at.each of the places herein designated for holding said election, at least twenty (20) days prior to the date of holding said election; and (b) by placing said notice together with a copy of this ordinance in the Beaumont Journal, a newspaper of general circulation in this city and county, not more than thirty (30) nor less than ten (10) days before said election. Said notice shall be in the following form: "NOTICE OF SPECIAL ELECTION IN THE CITY OF BEAUMONT, TEXAS, TO DETERMINE WHETHER THE PROPOSED MINIMUM SALARY -OF $550.00 PER MONTH FOR FIREMEN AND POLICEMEN SHALL BE ADOPTED. "Notice is hereby given that a special election will be. -:held in The City of Beaumont, Texas, on the 13th day of January, 1968, from 7:::00 a.m. to 7:00 p.m. to determine whether the proposed �1 ` - 4 - minimum salary of $550.00 per month for firemen and policemen shall be adopted, all as is more particularly set forth in the copy of the election ordinance passed by the City Council and attached hereto." s r Section 5. The form of ballot which shall be used in said special election shall be substantially as follows-: OFFICIAL BALLOT INSTRUCTIONS: Place and "X" in the square beside the statement indicating the -way you wish to vote: FOR the,proposed minimum salary of five hundred fifty ($550) dollars per month for firemen and policemen. AGAINST the proposed minimum salary of five hundred fifty ($550) dollars per month for firemen and policemen. Section 6. That said election shall be -held under and controlled by the provisions of the state laws governing elections. Section 7. That in accordance with the provisions of the laws of the State of Texas, voting.machines shall be used for voting on the day of election and also for the casting of absentee votes by personal appearance at the City Clerk's office.. In accordance with the provisions of the laws of the State of Texas absentee votes by'mail shall be counted by a special canvassing board which - 5 - shall be composed of Buel N. Kiker, Woodrow Doiron and Ray Gay. Ray Gay is hereby appointed Presiding Judge of said Special Canvassing Board and Buel N. Kiker and Woodrow Doiron are hereby appointed clerks.
