ENTITLED AN ORDINANCE AMENDING CHAPTER 42 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS,AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS AS INDICATED UPON THE ZONING MAP OF THE CODE OF ORDINANCES'OF BEAUMONT, TEXAS, BY CHANGING THE CLASSIFICATION OF A 40 ACRE TRACT OF LAND SITUATED IN THE S. STIVERS SURVEY, BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PRESENTLY ZONED ."R-3" TO "R-24"; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. That Chapter 42 of the Code of Ordinances of Beaumont, Texas, and in -.-.particular the boundaries of the zoning districts as indicated upon the Zoning Map of The City of Beaumont, referred to in Section 42-9 thereof, is hereby amended by changing the zoning classification of the following described tract of land, presently zoned Q"R-3" Modified two-family and multiple -dwelling District to "R-21" Two family and multiple dwelling District, to wit: All that certain tract or piece of land containing 40 acres:;, more or less, in the S. Stivers Survey and being located south of the north line of the S. Stivers Survey, the same being the south line of the C. Williams Survey, west of the center line of the 100 foot Santa Fe Railroad right of way, north of Walden Road right of way, and southeast of Interstate Highway 10, and being more fully described as follows: BEGINNING at the intersection of the southeast right of way line of Interstate Highway 10 and the south line of the Charles Williams Survey the same being the north line of the S. Stivers Survey; THENCE in an easterly direction along the south line of the C. Williams Survey same being the north line of the S. Stivers Survey to its intersection with the center line of the 100 foot Santa Fe Railroad right of way; THENCE in a southwesterly direction along the center line of the Santa Fe Railroad 100 foot right of way to its intersection with the north line of Walden Road right of way THENCE in a westerly direction along the most northerly right of way line of Walden Road right of way to its intersection with the southeast right of way line of the Interstate'Highway 10; THENCE in.a northerly direction along the southeast right of way line of Interstate Highway 10 to the place of beginning and one half of the abutting street rights of way. and the official zoning map of The City of Beaumont is hereby amended to reflect such change. Section 2. That in all.other respects the use of the property hereinabove described shall be subject to all of the applicable regulations contained in Chapter 42 of the Code of Ordinances of Beaumont, Texas, adopted August 19, 1958', effective October 19, 1958, as amended. ..'Prti nn I That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of the zoning affecting any portion of the property described hereinabove shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the property described herein. RPrrf inn G That any person or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in the said Chapter 42 of the Code of Ordinances of Beaumont, Texas. ENTITLED AN ORDINANCE FINDING THE BUILDING LOCATED AT 1798 CORLEY STREET, THE SAME BEING LOT SEVEN (7) BLOCK TWENTY-ONE (21) OF THE CARTWRIGHT ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, TO BE A PUBLIC NUISANCE, AND ORDERING IT TO BE DEMOLISHED WITHIN SIXTY(60) DAYS OR TO BE DEMOLISHED BY THE CITY OF BEAUMONT; MAKING FAILURE TO COMPLY A MISDEMEANOR; AND PROVIDING A PENALTY. WHEREAS, The City of Beaumont is now the owner of the hereafter described property by virtue of a Sheriff's Deed dated August 1, 1967, but does not yet have the right to possession of said property because the period of redemption has not yet expired; and, WHEREAS, the building upon said property is a fire hazard and is structurally unsafe and should be removed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT, TEXAS: Section 1. The City Council of The City of Beaumont, Texas, hereby finds and declares the building located at 1798 Corley Street, the same being Lot Seven (7) Block Twenty-one (21) of the Cartwright Addition to The City of Beaumont, Jefferson County, Texas, to be a public nuisance, in that said building constitutes a fire hazard and is structurally unsafe. Section 2. In accordance with Article XVII, Section 2 of the Charter and Section 13-20 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that the parties entitled to possession of the building located at 1798 Corley Street, the same being Lot Seven (7) B1ock.Twenty- one (21) of the Cartwright Addition in The City of Beaumont, Jefferson County, Texas; demolish said 1� �as 1.lC%s�I structure within sixty (60) days,.and if such action is not taken, the parties entitled to possession of said building shall be deemed guilty of.a misdemeanorc:and said building shall be demolished and removed at the expense of The City of Beaumont. 0--. , __ 13 That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas. 1967.
