E. Broussard, C. E. Broussard and J. E. Broussard, Jr., Trustees of the Broussard Trust, owners of all tb.e :property located in Blocks Itienty-two (22) and Twent, -four :(24) of the Parkdale Addition to the City of Beaumont, Jefferson County, Teas, abutting on -the street between said two blocks has been presented to the City Commission of the City of BeaiuIiont requesting that said street be vacated and closed; and WHEREAS, said street has never been opened nor-gra.d- ed for the use of the public; and 1HEREAS, said street is in direct line with the alley running through Blocks 20, 21 and 23 of said Parkdale Addition and is in the exact position of an alley and not the position_ of a street; and WHEREAS, the lots in Blocks 22 and 24 of said Parkdale Addition are very short lots and that there appears no need for said street and no use or advantage to the public or the citizens of the City of Beavra.ont; NO11"11, THE HFORE, BE IT ORDAINED BY THE CITY COr!IJISSION OF THE CITY OF BEAUMONT That said street between Blocks 22 and 24 of the Parkdale Addition to the City of Beaumont be, and the same is,, hereby authorized to be vacated and closed and that the title to said street shall revert to and become the property of the respective amners of the land in said two blocks bordering on said street, as provided by law; provided, however, that the closing of this street shall in no way affect the rights of the City of Beaumont as to the placing and maintaining therein any sewer or water lines, or telephone, telegraph, or electric 17_nes, wires, poles or cables, or any other service or utility of the City, or the right to grant franchises to persons or corporations to place and maintain_ therein any such severer or water lines, or telephones, telegraph, or electric lines, wires, poles or cables, or any ocher service or utility of the City, all of which rights are hereby reserved. r s PASSED this the 10 day of January, A. MTAYOR APPROVED AS 10 FORM: - City Attorney W All ORDINANCE ENTITLED AN ORDINANCE At;ENDING, "AN ORDINANCE AUTHORIZING THE VACATING ARID CLOSING OF THE STREET BETWEEN BLOCKS 22 AND 24 OF THE PARKDALE ADDITION TO THE CITY OF BEAUPtiONT, JEFFERSON COUNTY, TEXAS," REPEALING THAT PORTION OF SAID ORDINANCE FINALLY PASSED BY THE CITY C0I21ISSION ON JANUARY 18, 1938, READING AS FOLLOWS, "PROVIDED, HOV'TEVER, THAT THE CLOSING OF THIS STREET SHALL IN NO 'TAY AFFECT THE RIGHTS OF THE CI'T'Y OF BEAUMONT AS TO THE PLACING AND MAINTAINING THEREIN ANY SEER OR a°TATER LINES, OR TELE- PHONE, TELEGRAPH, OR ELECTRIC LINES, .'TIRES, POLES, OR CABLES, OR .11NY OTHER SERVICE OR UTILITY OF THE CITY, OR THE RIGHT TO GRANT FRAliCHISES TO PERSONS OR CORPORATIONS TO PLACE AND MAINTAIN THERE- IN ANY SUCH SEINER OR :'TATER LINES, OR TELEPHONE, OR TELE- GRAPH, OR ELECTRIC LINES, :"TIRES, POLEIS,.OR CABLES, OR ANY OTHER SERVICE OR U`T'ILITY OF THE CITY, ALL OF WHICH RIGHTS ARE HEREBY RESERVED"; AND REENACTING THAT PORTION THEREOF VACATING AND CLOS- ING SAID STREET. MHEREAS, on petition duly signed by J. E. Broussard, C. E. Broussard, and J. E. Broussard, Jr., Trustees of the Broussard Trust, owners of all the pro - petty located in Blocks 22 and 24 of the Parkdale 'Addition to the City of Beaumont, Jefferson County, Texas, abutting on the street between said two blocks, request- ing that said street be vacated and closed, the City Commission did' on January 18, 1938, finally pass and enact an Ordinance closing the same, in which Ordinance, however, there was reserved to the City of Beaumont, the rights of the City of Beaumont as to the placing and maintaining therein any sever or water lines, or telephone, telegraph, or electric lines, wires, poles, or cables, or any other service or utility of the City, Qnd the right to grant franchises to persons or corporations to place and maintain therein any such sewer or water lines,' a, or telephone, or telegraph, or electric lines, wires, poles, or cables, or any other service or utility of the City; and, 114HEREAS, said street has never been opened or graded for use of the public and the same is not in line with any other street of the City of Beaumont and is not needed as a street, nor is there presently existing in said street any sewer or viater line, or telephone, or telegraph, or electric lines, or any other utility of the City, and there is no necessity for any such sewer or water lines, or telephone, telegraph, or electric lines, wires, or any other utility to be placed therein, nor will there be any such necessity in the future since there is ample space available for such at other places in said vicinity; and TNIHEREAS, the lots in Blocks 22 and 21. of said Parkdale Addition are very short lots, and there appears no need for said street or for an alley there- in and no use or advantage to the public or the citizens of the City of Beaumont therefor, and that by closing the same the property comprising Blocks 22 and 24 j i of said Parkdale Addition, together with said street, will form a desirable industrial site and will encourage the use of said property for industrial pur- poses, to which otherwise it would not be suitable or available. id0d, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT: 1. That that portion of the Ordinance entitled, "An Ordinance authoriz- ing the vacating and closing of the street between Blocks 22 and 24 of the Park - dale Addition to the City of Beaumont, Jefferson County, Texas," reading as follows, "Provided, however, that the closing of this street shall in no way affect the rights of the City of Beaumont as to the placing and maintaining therein any severer or water lines, or telephone, telegraph, or electric lines, wires, poles, or cables, or any other service or utility of the City, or the right to grant franchises to persons or corporations to place and maintain there- in any such sewer or water lines, 112*?, or telephone, or telegraph, or electric lines, wires, poles, or cables, or any other service or utility of the City, all of which rights are hereby reserved", is hereby repealed, canceled, and held for naught. 2. Be it further ORDAINED by the City Commission of the City of Beaumont that said street between Blocks 22 and 24 of the Parkdale Addition to the City of Beaumont be, and the same is hereby authorized to be vacated and closed, and the same is hereby vacated and closed, and that the title to said street -4hall revert to and become the property of the respective ovmers of the land in said two blocks bordering on said street, as provided by law.
