AUTHORIZING TBE VACATING ARID CLOSING OF
THE ALLEY LOCATED IN BLOCK TWENTY-EIGHT (28)
OF THE AVERILL SECOND ADDITION TO THE CITY OF
BEADM ON T, TEXAS.
WHEREAS, a petition duly signed by W. E.
Coates, owner of Lot No. 4; J. W. Newton, owner of Lot
No. 6; Henry H. Waller, owner of Lot No. 7; E. M.
Stallcup, owner of Lot No. 5; T. H. Mabry, owner of
Lot No. 1; Mrs. M. -McCreary, owner of Lot No. 2; 'and-
Mrs.
ndMrs. W. P. H. McFaddin, owner'of Lots Nos. 7-12, owners
of all the property located in Block Twenty-eight (28)
of the Averill Second Addition to the City of Beaumont,
abutting on said alley, has been presented to the City
Commission of the City of Beaumont requesting that the
said alley be vacated and closed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BEAUMONT;
That the alley located in Block Twenty-eight
(28) of the Averill Second Addition to the City of
Beaumont be, and the same is hereby authorized to be vacated
and closed and that the title to such alley shall revert
to and become the property of the respective owners of
the land in said block bordering on said alley, as pro-
vided by law; provided, however, that the closing of
this alley shall in no way affect the rights of the City
as to placing and maintaining therein any sewer or water
lines, or telephone, telegraph, or electric lines, wires,
poles or cables, or any other service or utility of the City,
or the right to grant franchises to persons or corporations
to place and maintain therein any such sevver or water
lines, or telephone, telegraph, or electric lines, wires,
poles or cables, or any other service or utility of the
City, all of which rights are hereby reserved.
