BE I T O RDAINE D by the City Council of the -City- of Deaumont: SECTION 1. That it shall be unlawful for any l.,orson or passenger in or upon any car or coach of any street railvTay com- pany to use any profanze, vulgar or abusive language or to be guilty of any indescent, lascivious or disorderly conduct, or to smoke ant pine, cigar or cigarette, or to drink any intoxi- cating liquor or to spit on the floor, seat, inside walls or platforms, or to throw avVy peelings or trash of any kind upon the floor of any car, or to place their feet on the seats df x any car or coach of any street railway company, or to willfully ;disturb.- the peace_-jor convenience of any other passeng.er or pas- . .serigers- being -transported-in-or -upon--a-n eaw- OT- -coach-y provided that smoking upon the platforms is not herein prohibited. SECTION 2. It shall be unlawful for children under the age of 16 years to catch or attempt to catch onto or board any street car while the same is in motion. It shall be unl-.wful for any person to throw lace or leave any impediment or obstruction of any kind upon the tracks of any street railway coml)any within the limits of the City of Beamont, or to deface displace or disturb in any m9nner any car or coach, switch,track or other Froperty belong- ing to said company, without the consent of the owners or agent: thereof. �° SWTION -6; _ It shall be unlawful for any person to, by Tiding or driving upon the street railway company's track, or by leaving any vehicle thereon, to unnecessarily delay or irapedE the operation of a street car, but the car shall be entitled to the track and any vehicle upon the track shall -Le turned out, when any car approaches, so as to leave the track unobstructed; provided that persons moving any article to or from any vehicle shall be allowed a sufficient and reasonable time to load. or unload the salve. Provided that in care of fire the fire s shall have. the right of way and. upon the approach o& the fire department, the street car shall be brought to a dead ,stop -except when on a croro.,tng, when the -car-shall m if possible - clear the crossing and. stop. SECTION 7. Any person who shall violate any of the pro- visions of the six pr>>ceeding sections, shall upon conviction thereof, be fined in any sum not less than one dollar nor more than Twenty-five Dollars. SECTION 8. No street car shall be propelled or operated within the limits of the City of Beaumont without having one conductor and one Motorman thereon, provided that in, case of wmeWency the Mayor shall h?.ve authority to issue a periAt to opert�-te cars without a conductor, said permit to contain such condm.tions or restrictions as the mayor may deem necessary or expedient. No car shall be propelled or n n at a greater rate of speed thatvten miles per hour within any portion of thefol- lowing preseribed limits of the City of Beaumont, to wit': SMITH. "-It shall be unlawful for any -person- Tiding erson riding or driving upon the street railway company's track, or by leaving any vehicle thereon, to unnecessarily delay or iraped the operation of a street car, but the car shall be entitled tol the track and any vehicle upon the track shall '�e turned out, when any car approaches, so as to leave the track unobstructed; provided that persons moving any article to or from any vehicle shall be allowed a sufficient and reasonable time to load.or unload the same. SECTION 7. SECTION 8. No street car shall be propelled or operated within the limits of the City of Beaumont without, having one conductor and one Inotornian thereon, provided that i1i- case of 33.meXency the Mayor shall have authority to issue a penait to oper-ate cars without a conductor, said permit to contain such Fr condmtions or restrictions aa_ the mayor inay• deem riecessary or-- expedient. r -expedient. No car shall be propelled or run at a greater rate of speed thatAen miles per hour within any portion of thefol lowing Tesecibed limits of the City of Beaumont, to wit: SMITH, The entire, length of Pearl Street and from Pearl street CRAWFORD & SONFIELD. to Sabine street on College street and Pearl street to Sabine Street, on Milani street; and at no greater rate of speed than twenty miles per hour within the corporate limits of the Ci ty of Beaumont, and outside of the limits hereinabove described, SMITH - 3- �nd no cax,.,. shall be propelled at a greater rate of speed than three miles per hour around any curve x := at street corners, within the corporate limits of the City of Beaumont. Ise' Any street railway company, lessee.. receiver or any - aoent superintendent or employee of such company who shall.vio- late ay:y of the provisions. of this rection, shall upon convin- tion be fined in any sum not less than Five Dollars nor more than One Hundred Dollars. 1t7- The said c?.rs shall be provided with a good and suffi- cient headlight, which shall be kept burning from dark until so long as said cars are operated in the night. l� Any street railway company or any agent, superintendent or employee of such co;upany violating the provisions of this section shall upon conviction be fined in any sun not less than Five icor more than One Hundred Dolla-s. And the motor,_,an and conductor as well as the railway- company shall each be -liable_ .-. if the car in their charge is not provided with a headlight as in this section provided, and every trip made without a head- light as herein provided, shall constitute a separate offence. ,�' SECTION II. No street car shall stop on any street cross;= ing or any railroad track,except to avoid accidents: All street cars shall be stopped and the gong or bell sounded at a distance other of five feet from the intersection,of any street railway company track or any steam railroad company's track ,and any motorma.n,con- ductor or other person violating the provisions of this section shall upon convictionobe fined in any sum not less than five nor _ - lmo_re th. -an - One Hundred Dollars-. - T IISECTION I2:. Each c.ompartment or division of a car parti- tioned, divided or screened in a substantial way and plainly eparating the portions of the car to be used by each race shall De deemed a separate car within the meaning of this ordinance, nd each separate car shall have in some conspicious tlace, prropriate words in plainletters indicating the race for which Lt is set apart. SECTION 14. The term onegroll as defined herein, includes every person of African descent as the same is defined by the Statutes of the State of Texas. All persons not included in the definition Ilnegroll as above defined shall be deemed a white person, within the meaning of this ordinance. SECTION 15. Any street railway company, lessee, manager or receiver thereof, which shall .fail to equip and operate its system or road with separate cars for passengers as above pro- vided for,. shall -be -liable, for each -and--every failure, - to a pe. -a- alty of not less than Twenty Five Ibllars nor more than One Hundred Dollars , to be _recovered by the Ctty of Beaumont.. in a suit to be brought in the name of the City of Beaumont, in an7 court having coiiipetent jurisdiction, and each trip run with such car or string of cars, without separate cars as herein de- fined , shall be deemed a separate offence. SE'CTION.16. Conductors on all separate cars as hereinbe- fore defined shall have the authority to _refuse -'.any- passenger: or I1person the right to stand or sit in any separate car in which said passenger or person is not entitled to ride, under the Iipr-ov -ons-- and-wrth3�n the tffean ng of tlii ordinance. `-- SECTION 17.. If any passenger upon any street car,provided with separate cars within the meaning of this ordinance shall ride in any car not designated for his race, after having been e deemed a separate car within the meaning of this ordinance, nd each separate car shall have in some conspicious-jlace, opriate words in plainletters indicating the race for which t is set apart. SECTION 14. The term "negro« as defined herein, includes every person of African descent as the same is defined by the Statutes of the State of Texas. SECTION 15, Any street railway company, lessee, manager or receiver thereof, which shall fail to equip and operate its system or road with separate cars for ?passengers as above pro- -vided for, shall -be liable, for each - -and -every -failure,- to --a piers alty of not less than Twenty Five Dollars nor more than One Hundred Do-Ilars , to be recovered by the Cttn7 of Beawnont , in a suit to be brought in the naine of the City of Beaumont, in any court having competent juri bdiction, and each trip run with such car or string of cars, without separate cars as herein de- fined, shall be deemed a separate offence. SECTION.16. Conductors on all separate cars as hereinbe- fore defined shall have the authority to- refu.sa--any passenger`or person the right to stand or sit in any separate car in which (said passenger or person is not entitled to ride, under the ovisions- and -within -the lymeanireg of this, ordinance.- SECTION rdinance. SECTION 17.. If any passenger upon any street car ,provided with separate cars within the meaning of this ordinance shall ride in any car not designated for his race, after having been CRAWFORD forbidden to do so by the conductor in charge of said car,he & SONFIELD. shall be guilty of a misdemeanor and shall be fined upon convic- tion, not less than Five Dollars nor more than Twenty -Five Dol - ars. —5— SECTION 18. The provisions of this -ordinance shall not be construe*ed so as to prohibit nurses from riding in the same) car with their employers, or wi-�h the child or children under their care, even. though of --i if ftrent race. SECTION 19. The provisions of this ordinance relative to separate cars shall not apply to any excursion, extra or spec— ial cars run strictly as such, for the exclusive use or reriefit of either race, but in all -s=ch c�ase� said cars shall be plain— ly marked "Extra Carl or "Special Carts.
