HomeMy WebLinkAboutORD 14-A-2Be it Ordained by the City Council of the ity of Beaumont:- Sec.l. All male persons between twenty one and forty five years of age, who shall have resided within the corporate limits of the City of Beaumont for fifteen days next before being summoned to work on the roads' or streets of the said City, 'shall be liable and it is hereby made, their a duty,to work on the streets,alleys and highways within the -said limits,when summoned and required to do so, or to furnish an able bodied substitute therefor,such substitute to be over eighteen years of age, and presented to and accepted by the Uity Marshall, br•to -pay the City Marshall at any time before the day appointed to work, the sum of one dollar for each day that they arr summoned for and fail to work,according to their summons; and they shall be exempt from payment of penalties for any portion of their I time thus substituted or' paid for: provided,however, that rl,.,Zinisters of the Gospel,sctually engaged in the discharge of ministerial duties,invalids, unable to work,active members of any Company of state Volunteer guards, xx organized under the provisions of the State I.,lilitia Law of said City, School Meachers,when actually engaged 'in teaching school; students and pupils whilst in attendance regularly upon school; all active members of organized fire companies ofthis city,not to exceed twenty members.to each one thousand inhabitants -shall be exempt of road and street work,or pay- ment'of penalties therefor; provided further,that they to be thus exempt and must beactually and in good faith of the conditionsAcharacter.s aforesaid, at the time they shall be summoned for such i-rork; and provided further, went of penalties therefor; provided further,that they to be thus ekempt and must beactually and in good faith of the conditionsmcharacter-s aforesaid, at the time they shall be summoned for such work; and provided further, that to be deemed ac�ive members of the militia or fire companies,they must have been reported to the City Secretary, as'such,within three months before being -required to work, and must have been members thereof more than fifteen days -before being summoned to work, and must continue to be such at the time for which they arp summoned; and provided further that those persons who have ilrorked,paid or substitutes to work on the _7^JJ �: -7-J_ 7.C:i'i:7 TC _ J'9 Tr J '.. Sec.2 The City Marshalt shall have power to call out all or any number of persons liable to work on the roads or streets of said City at any time the Street and Bridge Conunittee may deem it necessary to Work on or repair the same or any portion thereof. Sec.3. Sec.ar. The riarshal may employ and substitute some other suitable and competent person or persons to.summon the hands to perform rTork on the streets, and exempt such person or persons of road duty for the length of time they shall be actually and necessarily engaged therein; provided that any extra expense incurred therein shall be paid by the City Marshall and provided further, that not more than six persons shall be thus exempted for -any one year, and the Aarshal may assign any of the hands he deems.neces -nary to duty as overseers_ of any portion of the work.. proinlded,that I there.shall not be more' than one to each sp respective piece of work. i Sec.5. Sec. G. Each person summoned to work on the streets shall take frith him an ax,hoe,pick,spade or such other tool or tools, as he may be directed by the: Marshal, and If he has no such toolss as he is desired and directed by the MOshal- to take with him, he shall take such other suitable tools that he may have, if any. Sec.7. All monies collected or received by the said Mayor or Marshal% from respectively, or those under them, q& those liable to street gork under." this OrdinancVas payments in lieu of work, or as fines under the penal ordinance, against defaulting street workers, shall be by them paid into the City treasury, and receipted for by the treasurer,to constitute a portion of the Road,Street and "ridge Fund, of the City,,and all of said officers shall be required in their reports -to show the amounts thereof„df whom and When the same was received, and when and to whom they paid the same, and.exhibit vouchers thereffV2and may required by the City Council at any time ta make a report thereof. Sec. -S. The Marshal shall secure,and retain in his hands ten per cent of all `.ghm the street fund he may collect,receive and pay over in the dischwrge of his duties under this Ordinance. Sec -9 All ordinances and resolutions heretofore enacted insofar as. they are in conflict with this ordinance, are hereby repealed. Adopted.
