HomeMy WebLinkAboutORD 32-JAN ORDINANCE ENTITLED.AN ORDINANCE GRANTING GULF, COLORADO AND SANTA FE RAILWAY COMPANY AND THE GULF AND INTERSTATE RAILWAY COMPANY OF TEXAS, THE RIGHT TO BUILD, CONSTRUCT AND OPERATE AN INDUSTRY TRACK FROM A POINT ON THEIR MAIN LINE TRACK(AT CHAINING STATION 3696*62 IN BLOCK NO. 44 OF THE VAN WOlUIER ADDITION TO THE CITY OF BEAUMONT, RUNNING EASTWARD ACROSS VICTORIA STREET DOWN WHAT IS COMMONLY KNOWN ANDDESIGNATED AS "JEFFERSON ALLEY," ENTERING THE ALLEY BETWEEN BON - HAM AND CROCKETT STREETS AND CONTINUING DOWN JEFFERSON ALLEY 945 FEET ACROSS RAILROAD AVENUE AND HOLMES AVENUE TO THE WEST LINE OF ARCHIE STREET, A DISTANCE OF 1282 FEET IN ALL, AS IS SHOWN BY THE BLUE PRINT ATTACHED TO THIS ORDINANCE, PROVIDING ALSO THAT SAID TRACK IS AND MALL BE USED ONLY AS AN INDUSTRY TRACK, AND PROVIDING FURTHER THAT THE RIGHTS AND PRIVILEGES HEREIN GRANTED SHALL BE ACCEPTED IN WRITING BY GULF, COLORADO AND SANTA FE RAILWAY COMPANY AND THE GULF AND INTERSTATE RAILWAY COMPANY OF TEXAS, WITHIN THIRTY (30) DAYS AFTER THE PASSAGE AND APPROVAL OF THIS ORDINANCE,; AN THAT SAID INDUSTRY TRACK SHALL BE COMPLETED WITHIN TWELVE MONTHS AFTER THE FINAL PASSAGE AND PUBLICATION OF THIS ORDINANCE, ALSO PROVIDING THAT GULF, COLORADO AND SANTA FE RAILWAY COMPANY AND THE GULF AND INTERSTATE RAILWAY COMPANY OF TEXAS, SHALL PAY TO THE CITY OF BEAU- MONT ANNUALLY ON THE FIRST DAY OF JULY OF EACH YEAR THE SUM OF TWENTY- `� FIVE (25.00) AND NO/100 DOLLARS AS REASONABLE COMPENSATION FOR THE PRIVILEGE AND FRANCHISE HEREBY GRANTED, AND PROVIDING FURTHER THAT THE FRANCHISE SHALL BE SUBJECT TO THE TERMS AND CONDITIONS OF THE CZ'11Y CHARTER OF THE CITY OF BEAUMONT AND SHALL EXIST FOR A PERIOD OF TEN (10) YEARS. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY- OF BEAUMONT: Section 1. Gulf, Colorado and Santa Fe Railway Company and The Gulf and Interstate Railway Company of Texas, its and their successors and assigns, are hereby granted the right and franchise to lay, build, construct, maintain:?.and operate at their own expense, a stan- dard gauge railroad track across Victoria Street and over, along and upon Jefferson alley in said City of Beaumont, beginning at a point on the main track of the Gulf and Interstate Railway Company of Texas at Track Chaining Station 3696462 in Block 44, Van Wormer Addition to the City of Beaumoat,.Texas, and running eastward tangent 162 feet; thence on a 15 degree curve to the left, 175 feet crossing Victoria Street and entering alley between Bonham and Crockett Streets, con- tinuing tangent down the center line of the said alley 945 feet across Railroad Avenue and Holmes Avenue to the west line of Archie Street, 1282 feet in all, as shown on blue print attached hereto, r #2. marked "Exhibit A° and made a part hereof, the line of said. proposed railroad track being indicated by the red line drawn on said blue prints Section 2. The track to be laid, built, constructed, maintained and operated under the terms and conditions of this ordinance shall be used only as an industrial track, that is for the purpose of afford- ing loading, unloading and switching facilities to commercial and industrial enterprises now located or hereafter to be located in the vicinity of said track. Section 3. The foregoing rights and privileges are granted upon the expressed condition that the said grantees shall, within thirty (30) days after the passage and approval of this ordinance, file with the City Clerk of theCity of Beaumont their written acceptance of this ordinance. Section 4. Unless Gulf, Colorado and Santa Fe Railway Company and The Gulf.and Interstate Railway Company of Texas, its and their successors and assigns, shall construct, build, lay and complete for the purpose of operating the track herein contemplated within twelve (12) months after the final passage, acceptance and publication of this ordinance, then to the extent of the track not so completed, this ordinance shall become null and void and of no force and effect. Section 5. This ordinance and the rights and privileges therein granted are subject to all of the terms and provisions of the Charter of the City of Beaumont, and said privileges and franchise hereby granted shall continue in force for a period of ten (10) years from and after the date of said grantees' acceptance of the terms hereof. Section 6. As reasonable compensation for the rights and privileges granted by this ordinance, grantees agree and obligate themselves and their successors and assigns, to pay to the City of Beaumont on or before the first day of July of each year after the taking effect of this ordinance, the sum of Twenty-five and No/100 Dollars (025.00).
