HomeMy WebLinkAboutORD 40-JEntitled an Ordinance carrying into effect the provisions of Article 873, Code of Criminal Procedure of the State of Texas (1925), fixing the items of costs and the amount thereof which shall be taxed against each defendant convicted in the Corpora- tion Court of the City of Beaumont, on pleas of Guilty, Not Guilty, and when judgment of the Court is appealed from; and declaring an emergency. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAMITONT, TEXAS: SECTION 1. - Providing for Costs of Court In accordance with the provisions of Article 873, Revised Code of Criminal Procedure of the State of Texas (1925) there shall hereafter be taxed against each defendant convicted in the Corpora- tion Court of the City of Beaumont the following items of costs of Court, and the respective amounts set opposite each of said items shall be collected from each defendant so convicted, and together with the fine imposed when collected shall be deposited with the City Tax Assessor and Collector of the City of Beaumont. SECTION 2. - Pleas of Guilty Whenever the defendant in any prosecution had in the Corporation Court shall plead "Guilty" to the charge, the follow- ing items of costs shall be taxed against and be paid by any such defendant: Arrest with or without warrant . . . 2 00 Commitment . . . . . . . . . . . . . 1 00 Release . . . . . . . . . . 0 1 00 Trial fee . . . . . . . . . . 1 00 Filing and docketing . . . . . . . 10 Taxing costs . . . . . . . . . . . 10 Total 5 20 SECTION 3. - Pleas of Not Guilty Whenever the defendant in any prosecution had in the Corporation Court shall plead "Not Guilty" to the charge, the following items of costs shall be taxed against and paid by any such defendant upon conviction: Arrest with or without warrant . . . $ 2 00 Commitment . . . . . . . . . . . . . 1 00 Release . . . . . . . . . . . . . 1 00 Trial Fee . . . . . . . . .. . . . 3 50 Filing and docketing . . . . . 10 Taxing costs . . . . . . . . . 10 Total $� 7 70 SECTION 4. - Jury Trials and Appeals Whenever the defendant in any prosecution had in the Corporation Court shall plead "Not Guilty" to the charge and demand a trial by Jury, and if found guilty, shall prosecute an appeal to the County Court, the following items of costs shall be taxed against and be paid by any -such defendant, in addition to the costs taxed by the provisions of Section 3 hereof: C Amount of costs on pleas not guilty . . $ 7 70 Summoning Jury . . . . . . . . . 1 00 Jury fee e s . . 9 3 00 $ 11 70 Filing and approving Bond of Appeal 1 50 Preparing and filing transcript of Appeal 1.50 Total $ 14 70 SECTION 5. - Costs on Appeal - Fee Bill Whenever any appeal is prosecuted from a judgment of the Corporation Court, it shall be the duty of said Clerk to include in his fee bill, -incorporated in the transcript of appeal, the total amount of costs hereinabove provided for in Sections 3 and 4. SECTION 6. - Emergency Clause The'fact that the present Ordinances of the City of Beau- mont do not clearly and specifically carry into effect -the provi- sions of Article 873 of the Revised Code of Criminal Procedure of the State of Texas, creates an emergency and an imperative public necessity for the passage of this Ordinance. It is, therefore, ordered that the rule requiring ordinances to be read on three separate days, be and the same is hereby suspended and that this Ordinance shall take effect from and after the date of its passage and lawful publication.
