ORDINANCE.
An ordinance granting the right 'of way and other privileges on the
streets --"-the City of Beaumont th Eduard Kennedy, A --C. Rush, their
associates and assigns, for the building, equiping, maintainance and
operation of an Electric Street Railway.

Be it ordained by th'e City Counci`Y of the City of Beaumont.
First.- That the City Council of the City of Beaumont hereby grants
to Edward Kennedy, -A, C. Rush, and such other persons as may now or.
hereafter be associated with them in the orgiLnization and incorporaticrw
of a Company under the laws of the State of Texas, to construct,
maintain and operate an Electric Street Railway in the City of Beau-
mont, Texas, their heirs, successors or assigns, the right of way
ith the privilege ofIlaying, using, constructing and operating a
(� single. - : track railway and all necessary side tracks, turn-
outs, ._ and 'switches for the purpose of operating' an

`SECOAD.�hat said Street Railway Company shall be required to commence
/work upon the construction of said Electric Street Railway within
eight months from the taking effect of this ordinance and shall have
, said9Elect G Street Railway_ completed and in operation��thi.n -two -
years from the taking effect of the ordinance, provided however,that
for good cause shown, the said City Council may, by resolution extend
the .time within which said work must be commenced -or completed.And
said Electric 'Street Railway further agrees to put in all bridges or
culverts over which said Electric Street Railway may pass, on the
streets,of Beaumont, at its own expense and keep same in repair.
THIRD.- Said Electric Street Railway Company shall use this grant and

franchise in such manner, and shall so construct its road bed and lin%s
of Electric Street Railway and other improvements upon said streets,as
int to ?n*Arxere with the use same by- the public;shall, at all
times, keep the road bed and the portion of the street occupied by its
tracks, and for the distance of one foot on each side thereof in good
repair and condition, and conform the construction of its tracks and
grade thereof with the grades of the streets established by the City
Engineer, under the direction of the Oity Council, at all times, and n
shall keep its rails and the street on as nearly the same lever as the
.practical operation oil said Electric Street Railway wi11 permit;shall
construct, maintain and keep in good repair proper -and sufficient crossi

over its lines of road at the intersection of all streets through and
over which its lines may be constructed..
FOURUH-'That the said Electric Street Railway shall be constructed of
good and proper material and shall be equipped, maintained and.operatel�i
repair and condition, and conform the construction of its tracks and
grade,thereof with the grades,of the -streets established by the City
Engineer, under the direction of the city Council, at all times, and ,
shall keep its rails and the street on as nearly toe same leve,l'as the
.practical operation of said Electric Street Railway will permit;shall

over its lines of road at the intersection of all streets through and
over which its lines may be constructed.. -
FOURTH. That the said'Electric Street Railway shall be constructed of {i
good and'proper material and shall be'equipped, maintained and.operatel
in first class style with such steel rails, and weight of rails as may
be considered by the company as best adapted for the successful oper-
ation of first class, modern cars and the necessary roling stock of
said Electric street Railway and the said road shall be well built f,
and constructed in a thorough, neat and workman like

manner, and when the iity iouncil shall order the paving.or' macad-,
amising or any other system of street paving upon any street which
this street Railway may be occupying said Electric Street Railway
agrees that the space between its rails and for theydistance of one
foot on each side of its rails shall be paved with like material all

under the supervision of the City Engineer -or such other p9mg9n the— -
City Council may apoint to inspect the work.
FIFTH.- For the purpose of operating said Electric Street.Railwaysaid
Company is hereby authorized to erect a system of overhead wires sup-
ported by poles set along -the curbs of said streets( which said poles

shall not be less, than 20 feet higi) A for the purpose of conducting
the Electric current to operate motors and to propel cars from sue
electric currents generating power hoUse as,--maybZ required and its.. t
P+-Ais authorized to use the rails and earth for the return current,and
shall have the right to build -under ground conduits for the reception
of cables for the conveyance of elec.tricitym or may adopt such other _

` modern and approved system of currentasmay give more satisfactory
service. All such overhead Work, wires.1poles etc shall be fitted with
the usual safeguards and at all times kept in goad repair.
SI'UH... Said Railway Company shall not have the right to charge more
than five cents for one continuous ride over its tracks in any one
general direction between any two points on its said lines within the

in the time limited hereby on the part of the said Electric Street

in the time limited hereby on the part of the said Electric Street
Railway Company after due and reasonable notice of such failure then
and in that eventylt shall forfeit and terminate said franchise and aI1
rights thereunder shall lapse and revert to said City of Beaumont.
This ordinance shall be in force and take effect ten days k�o d
