W H E R E A S the City ,Council of the City of Be
riont did on gztobxx to wit, the 0 d,y of May, 190-1 pass an
ordinance granting to the Texas_ & New �rle�ns_ R�ilro�d�ompany� .I
a right of way across Tevis street, Cypress street, Travis street
Main Street, Pearl street, Crockett street and Orleans street
to construct and maintain a railroad track and to oper^te a
railroad thereon, subject to certain restrictions, c.uties and
obligations on the pact of the said railroad company, and
�W H E R E A S the charter of the City of Beaumont re-
quires.any railroad company occupying a street which has been
paved, iz#� shail become liable as therein provided, and that be-
fore rux any railroad company shall be uperrmitted to occupy
such improved street or portions of streets, it shall file withl
th o City Secretary in writing, prepared by the, City Attorney,'
an acceptance of the -_terms on which its occupancy shall be per-
mitted, and whereas the said right of way is over certain pav-
ed streets or` p.ortions of , treets in the City of Beaumont,
NOW THEREEOPE the said Texas & New Orleans Railroad Cor&-
--pany does by' 'thi:s instT_1araert prepared by the City attorney by
of the City.' 7of �Beaumorit, accept the franchise of right of way
granted by virtue of the said ordinance, with all of its terms
and provisions.

AN -ORDINANCE
GRANTING TO THE T. & N. 0, R. R. CO. A FRANCHISE TO
CROSS CERTAIN STREETS IN THE CITY OF BEAT MONT WITH
ADDITIONAL TRACKS.
Be it ordained by the City Council of the City of Beaumont,,:
SECTION 1.
THAT the Texas & New Orleans Railroad Company be
and it is hereby granted permission to construct another
main line track from a connection with its present main
line track at a point,at or near the west end of its trestle
over Neches River: thence in a westerly direction on the
north Bide of its present main track parallel with, and as
near thereto - as safety in -the operat-ion- -of--its - tr-ains--on- -both- ---- --
lines at the same time will permit, across Tevis Street, Cypress
Street, Travis Street, Main Street, Pearl Street, Crockett
Street and Orleans Street, to a connection with, its track
or tracks west of said Orleans Street, now or hereafter to be
constructed.
SECTION 2.
Be it further ordained that said Texas & New Orleans
,r}a�-ailroad Co. be, and it is hereby granted the right and per-
mission to construct two additional tracks from a point west
&.; of Orleans Street on the south side of and as near as practi-

cable to the tracks of said Company already located thereon,

across said Orleans Street, in an easterly direction,
but in no event to.extend as far east as Pearl Street, or the
side -walk along the west side of Pearl Street,
SECTION 3.
Be it further ordained that said Railroad Co. be and
it is he-rebv given the richt and -permission to so move or

re-arrange.its present side track across Pearl Street south
of its :rain track so as to properly connect- same with the
present.spur track, the western terminus of which is now be-
tween Pearl and Main Streets.
SECTION 4,
Said railroad Company shall be required to promptly
restore said streets at the place of each crossing provided
for herein to its former condition,' '.e�elysoas'ai
, and 't -o maintain same in good condition as provided by
lava.
SECTION 5.
Be it further ordained that this ordinance shall
take effect immediately upon its passage.
