Section 3. If it shall appear upon .the trial of any person accused under
the provisions of this Ordinance , that such reports were false 'and that no

bona fide effort was made by thedefendant ascertain .the truth or falsity
of such statements. or" reports before. the same were circulated by him.,
the same shall be deemed to have been done wilfully and maliciously, aid
subject to the penalties herein provided for:
