';iBEREAS, the Broussard Trust, a trust association and joint stock company of the City of Beaumont, Jefferson County, Texas, has heretofore purchased and become the sole owner in fee simple of the entire fractional Block !To. 23 of the Parkdale iLdd- ition to the City of Beaumont., said block being intersected by an alley belonging -to the said City of 3eaurrnont. By letter to the Honorable City Comr ission of the City of Beaumont dated the 10th day of July, n. D. 1934, the said Broussard 'rust, through J. E. 2roussard, in said letter set forth that it is his desire to close the said alley, that no other property owner, either in that section or elsewhere, could possibly be interested in the said alley -way, for the reason that the said Broussard Trust owns alb, of the prop- erty abutting on either side of said alley, and requests that the said alley be vacated and closed. NOVV, TH "HEFORE I BE IT ORDAINED BY THE CITY COIy-IMISS ION OF THE CITY OF BEAU24ONT : That the alley located in said fractional Block Number 23 of the-Parkdale Addition to the City of Beaumont, be and the same is hereby authorized to be vacated and closed, and that the title to such alley shall revert to and become the property of the said Broussard Trust, it owning all of the land abutting on either side of said' alley, as provided_ by law, provided, however, that the closing and vacating of said alley shall in no way affect the rights of the City as to placing and maintaining therein of any sevrer or water lines, telephone, telegraph, or electric lines, wires, poles, or cables, or any other service or utility of the City or perrnitted therein, or the right to grant franchises to persons or corporations to place and maintain therein any such sewer or water lines, telephone, telegraph, or electric lines, viires, poles or cables, or any other service or utility of the City or used therein, all of. which rights are hereby reserved. The short alley which is shovm, on townsite map is of no service to anyone,, and i.7e wria the entire fractional block 23 and all of block 22 ., and fract(1 conal block 241., immediately aca�oss Fourth Street from block 23. This alleyway as shoc.,,n on the city map serves no good purpose and there is a prospect of get -ting some improvements an this cd block 23., provided the alley is closed.
