Authorize the acceptance of a fifteen foot wide Exclusive Sewer Line Easement located on Farrah Street L1 BEAUMONT TEXAS TO: City Council FROM: Kyle Hayes, City Manager PREPARED BY: Todd Simoneaux, Chief Financial Officer MEETING DATE: October 2, 2018 REQUESTED ACTION: Council consider a resolution approving the purchase of trash cans for use in the Solid Waste Department. BACKGROUND The ;City plans to purchase 1,160 trash cans from Cascade Engineering Inc. of Grand Rapids, MI. in the amount of $58,520.00. The new 96 gallon cans will replace old and damaged cans and will also be issued to new customers. Pricing was obtained through the Houston -Galveston Area Council (HGAC), a cooperative purchasing association providing cities and political subdivisions with the means to purchase specialized equipment at volume pricing. HGAC complies with State of Texas procurement statutes. FUNDING SOURCE Solid Waste Fund. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Council hereby approves the purchase of one thousand, one hundred sixty (1,160), ninety-six (96) gallon trash carts for use by the Solid Waste Department from Cascade Engineering, Inc., of Grand Rapids, Michigan, in the amount of $58,520.00 through the Houston -Galveston Area Council (H -GAC) Cooperative Purchasing Program. The meeting at which this resolution was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. BACKGROUND This matter was presented and discussed in Executive Session held on September 25, 2018. The City Attorney is requesting authority to settle this claim in the amount of $16,500.00. FUNDING SOURCE General Liability Fund. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, the claim of George W. Brown III was discussed in Executive Session properly called and held Tuesday, September 25, 2018; and, WHEREAS, the City Attorney is requesting authority to settle this claim; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Attorney be, and he is hereby, authorized to settle the claim of George W. Brown III for the sum of Sixteen Thousand Five Hundred and 00/100 Dollars ($16,500.00); and, BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby authorized to execute all documents related to settlement of the claim. Exclusive Sanitary Sewer Line Easement. BACKGROUND Mickey Phelan B Land, LP has agreed to convey a fifteen foot (15') wide exclusive Sanitary Sewer Line Easement to the City of Beaumont. The easement is described as being a 0.2699 acre of land situated in the C. Williams Survey, Abstract No. 59, Jefferson County, Texas. The sanitary sewer line easement is for the new development of residential homes located on Farrah Street in Champions Subdivision. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of the resolution. RESOLUTION NO. WHEREAS, Mickey Phelan B. Land, LP has agreed to convey one (1) fifteen foot (15') wide exclusive sewer line easement, said easement being a 0.2699 acre of land situated in the C. Williams Survey, Abstract No. 59, Jefferson County, Texas as described and shown in Exhibit "1," attached hereto, to the City of Beaumont for a development of residential homes located on Farrah Street in Champions Subdivision; and, WHEREAS, the City Council has considered the purpose of said conveyance and is of the opinion that the acceptance of said conveyance is necessary and desirable and is in the best interest of the City of Beaumont and that same should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT one (1) fifteen foot (15') wide exclusive sewer line easement conveyed by Mickey Phelan B. Land, LP, being a 0.2699 acre of land situated in the C. Williams Survey, Abstract No. 59, Jefferson County, Texas as described and shown in Exhibit "1," attached hereto, be and the same is hereby, in all things, accepted for the stated purposes. Grantor reserves the right to continue to use and enjoy the surface of the Easement Area for all purposes that do not interfere with or interrupt the use or enjoyment of the Easement by Grantee for the purposes provided herein, including but not limited to the right to place surfacing materials over and across the Easement Area and to use the, same for parking areas, driveways, walkways or sidewalks, landscaping and/or lighting; provided, however, no permanent buildings may be placed on the Easement Area. Notwithstanding the foregoing, Grantee shall not be responsible for the repair and replacement of any improvements placed by Grantor within the Easement Area and the same shall be repaired and maintained by Grantor, at Grantor's sole cost and expense. The conveyance of the Easement granted herein is made by Grantor and accepted by Grantee subject to any and all existing easements, covenants, rights-of-way, conditions, restrictions, outstanding mineral interests and royalty interests, if any, in the Easement Area of record in the office of the County Clerk of the County of Jefferson (collectively, the "Permitted Exceptions"). This Easement may be amended or terminated only by the written consent of the parties hereto, or their respective successors and assigns. BACKGROUND The Texas Department of Transportation (TxDOT) performed a traffic survey of Major Drive from Folsom Drive to Dishman Road due to multiple residents requesting an evaluation of the speed limit. The 2017 crash rate for this section of road described above is 158.57, nearly three (3) times the statewide average of 55.88 for similar roadways. Administration and TxDOT propose the speed zone boundaries and speed limit for these sections of Major Drive be amended under the schedule Chapter 20 Section 20.03.003 to read as follows: Street Limits of Zone Direction of Travel Major Drive (c) From the centerline of State North and South Highway 105 to a point 225 feet north of the centerline of Folsom Drive. (d) From a point 225 feet north North and South of the centerline of Folsom Drive to a point 158 feet south of the centerline of Dishman Road. FUNDING SOURCE Not applicable.
