The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council
Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Rick White with Christian Fellowship Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz,
Sam, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City
Attorney; Tina Broussard, City Clerk.

CONSENT AGENDA
Approval of minutes — June 26, 2018
A) Confirmation of committee appointments — None

Councilmember Samuel moved to approve the Consent Agenda. Mayor Pro Tem Mouton
seconded the motion.

GENERAL BUSINESS
1. Consider a request for a Specific Use Permit to allow the expansion of a church in a HI
(Heavy Industrial) District for property located at the southwest corner of Rusk Street and
13th Street.
Richard Faust of Faust Engineering and Surveying, Inc. is requesting a Specific Use Permit
to allow the expansion of a church at the southwest corner of Rusk and 13th Street. The
property is zoned HI (Heavy Industrial) and requires a Specific Use Permit for a church.
Mr. Faust states that the church plans to add a fellowship hall, classrooms and related
parking. All utilities are available and a new fire hydrant will be installed by the city, at the
applicant's expense.
At a Joint Public Hearing held on June 18, 2018, the Planning Commission recommended
9:0 to approve a request for a request for a Specific Use Permit to allow the expansion of a
church in an HI (Heavy Industrial) District located at the southwest corner of Rusk and 13th
Street.
Approval of the ordinance.
Mayor Pro Tem Mouton moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE GRANTING A
SPECIFIC USE PERMIT TO ALLOW THE EXPANSION OF A CHURCH IN AN HI (HEAVY INDUSTRIAL)
DISTRICT AT THE SOUTHWEST CORNER OF RUSK STREET AND 13TH STREET IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Sam seconded the motion.

Ordinance 18-035
2. Consider amending the Code of Ordinances to facilitate the Trap -Neuter -Return (TNR) of
feral cats.
Minutes — July 3, 2018
Trap -Neuter -Return (TNR) is a program in which feral cats are trapped, vaccinated,
sterilized, ear tipped for identification purposes and then released to the location where they
were originally caught.
TNR is the only humane and effective way to reduce feral cat populations over time. By
returning sterilized cats back into the community, no new kittens are born, the cat population
stabilizes, and nuisance cat behaviors are reduced. Because feral cats are wild and not
socialized to humans, they cannot be adopted into new homes.
TNR is supported by many national animal welfare organizations, including the Humane
Society of the United States, the American Society for the Prevention of Cruelty to Animals,
the Best Friends Animal Society, Alley Cat Allies, The No Kill Advocacy Center and Maddie's
Fund.
The Animal Care Advisory Committee met on June 14, 2018 to discuss TNR and is in
support of the program.
On June 26, 2018, the Beaumont City Council held a work session to discuss TNR.
All sterilization surgeries will be provided by Beaumont Pets Alive at no cost to the City of
Beaumont.

COuncilmember Jordan moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING
CHAPTER 4, ARTICLE 4.09 AND ADDING A NEW CHAPTER 4.10 OF THE CODE OF ORDINANCES
RELATING TO TRAP -NEUTER -RETURN OF FERAL CATS AND ANIMAL CARE FEES, PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Getz
seconded the motion.

Ordinance 18-036
3. Consider a resolution approving the award of annual contracts for temporary personnel
services for various departments.
Specifications for the contract require temporary staffing agencies to provide pre-screened
and qualified individuals on an on-call and as -needed basis. Temporary employees must
pass a drug screen and a criminal background search prior to being assigned to the City.
The contract specifications requested firm hourly prices inclusive of wages, benefits, testing,
screening, workers compensations, taxes, and agency fees.
Ten (10) vendors were solicited and seven vendors submitted bids for an annual contract to
provide temporary employees_ to fill positions in business offices, skilled and unskilled
laborers, equipment operators, and Licensed Vocational Nurses (LVN).

Administration recommends awarding contracts to Advanced Staffing Inc. of Beaumont;
Lofton Staffing Services of Beaumont; Personnel Staffing Inc. of Beaumont; and American
Personnel & Temps of Beaumont.
Funds will come from General Fund (26%); Water Utilities Fund (52%) and Solid Waste
Fund (22%).
Approval of resolution.
Councilmember Jordan moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY
ADVANCED STAFFING, INC., LOFTON STAFFING SERVICES, AND PERSONNEL STAFFING, INC., AND
AMERICAN PERSONNEL AND TEMPS, ALL OF BEAUMONT, TEXAS, FOR AN ANNUAL CONTRACT TO
PROVIDE ON CALL AS NEEDED TEMPORARY PERSONNEL SERVICES FOR THE CATEGORIES AND AT THE
HOURLY RATES BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Sam seconded the
motion.

Mayor Ames read the announcement regarding Executive Session being held at the
conclusion of the General Business portion of the meeting.

Spoke to Council regarding a call that was made to the City about an inoperable car in his
driveway, the car has been there four years, stated that he hasn't had an opportunity to work
on the vehicle, also spoke regarding the proposed ordinance where citizens will not be able
to park on the grass in their yards, asked that Council enforce the Ordinance that is already
in place and not create a new Ordinance

Made comments regarding street repairs, stated that he has lived at his address for 20 years
or more and the street has never been repaired, streets on the South side need repairs
badly, asked that Council take care of this problem as quickly as possible

Commented on the repairs that are needed on Sarah St. to Crockett and 4th St. to
Pennsylvania, stated that he's tired of patch work, wants overlay work done, asked when
something would be done

Spoke regarding the Trap -Neuter -Return Program, commented on bicycle safety, as well as
other issues that the City has, asked that the Council look out for the homeless, the roads
and all communities throughout the City

MAYOR PRO TEM MOUTON - GAVE CONDOLENCES TO THE FAMILY OF RUTH SORRELL,
COMMENTED ON THE STREETS AND STATED THAT SHE KNOWS
THE CONCERNS OF THE CITIZENS AND THE ISSUES WITH
STREETS IN HER WARD ALONG WITH WARD III
COUNCILMEMBER SAMUEL - INTRODUCED MS. SAMANTHA SAVOY WHO IS A RECENT
GRADUATE OF THE UNIVERSITY OF SOUTH FLORIDA, ASKED
THE CITY MANAGER QUESTIONS REGARDING THE STREETS AND
THE STREET REHABILITATION PROGRAM, DISCUSSED THE
EQUAL AMOUNT OF FUNDS THAT HAS BEEN ALLOCATED FOR
EACH WARD TOWARDS STREETS, STATED THAT HE WILL
CONTINUE TO LISTEN TO HIS CONSTITUENTS AND WHAT THEIR
CONCERNS ARE, ALSO STATED THAT HE ASKED QUESTIONS OF
THE CITY MANAGER ONLY TO TRY AND EDUCATE THE CITIZENS
AS TO THE PROCESS REGARDING THE STREET PROGRAM
COUNCILMEMBER PATE - APPRECIATES THE CITIZENS COMING FORWARD AND VOICING
THEIR CONCERNS REGARDING THE STREETS, ASKED THAT
CITIZENS PLEASE COME FORWARD AND LET STAFF KNOW
ABOUT THE STREETS, STAFF WILL DO EVERYTHING THAT THEY
CAN TO GET IT TAKEN CARE OF, THE ONLY WAY THAT COUNCIL
CAN GET ALL OF THE STREETS TAKEN CARE OF WOULD BE TO
RAISE TAXES OR CUT SERVICES WHICH IS SOMETHING THAT
THEY HAVE TRIED NOT TO DO, COUNCIL AT THIS POINT IS
TRYING TO TACKLE THE WORSE STREETS AND GET THEM DONE
WITH THE FUNDS THAT ARE ALLOTTED, COMMENTED ON THE

FUNDS FOR THIS PROGRAM ARE BEING DONATED BY

STREETS DONE, IT'S NOT AS SIMPLE AS CITIZENS THINK, IT
TAKES A LOT OF MONEY THAT THE CITY DOESN'T HAVE, ASKED

COUNCILMEMBER GETZ - MADE COMMENTS ON THE PROPOSED ORDINANCE REGARDING
PARKING VEHICLES ON THE GRASS, STATED THAT ON SOCIAL
MEDIA HE HASN'T SEEN ANYTHING CREATE MORE OF A FIRE
STORM THAN THIS PROPOSED ORDINANCE IN A LONG TIME,
THERE ARE THOSE THAT SAY THE ORDINANCE IS NEEDED,
OTHERS ARE SAYING THAT IT'S GOVERNMENT OVER REACH,
STATED HE DID SOME RESEARCH TO SEE IF THIS IS SOMETHING
UNIQUE TO BEAUMONT OR IF THIS IS SOMETHING COMMON,
STATED THAT HE DID THE RESEARCH AND THERE ARE OTHER
CITIES THAT HAVE THIS TYPE OF ORDINANCE, HE STATED THAT
HE DID FIND ONE THAT HE THOUGHT WOULD INTEREST COUNCIL
THAT IS BEING USED IN HOUSTON WHICH IS AN OPT -IN
ORDINANCE, COUNCILMEMBER GETZ GAVE AN EXPLANATION
AS TO WHAT AN OPT -IN ORDINANCE WAS, ALSO MADE
COMMENTS ON STREETS
COUNCILMEMBER JORDAN - COMMENTED ON THE PROPOSED ORDINANCE REGARDING

ORDINANCE THAT COUNCILMEMBER GETZ DISCUSSED THAT IS
USED IN HOUSTON, STATED THAT COUNCIL IS IN THE PROCESS
OF JUST TALKING ABOUT THIS SO NOTHING HAS BEEN PUT INTO
PLACE AS OF YET, DID WANT TO INFORM EVERYONE THAT THE
CITY HAS A 25 YEAR LONG PROTOTYPE OF NO PARKING IN THE
YARD IN THE OAKS HISTORIC DISTRICT AND IT HAS WORKED IN
THE OAKS DISTRICT AND THAT IT WOULD WORK CITY WIDE,
COMMENDED THE CITY MANAGERAND STAFF FOR THE MOWING
OF THE INTERSTATE, IT LOOKS WONDERFUL, MENTIONED THE
ELECTRICAL BOXES THAT ARE BEING PAINTED, THERE ARE
THREE LEFT THAT WILL BE PAINTED SOON, COMMENTED ON
THE STREET PROJECT

LIGHT SHOW AT 8:00 A.M., AND FIREWORKS AT 9:00 P.M.,
ASKED THAT EVERYONE COME OUT AND ENJOY THE
FESTIVITIES, ALSO COMMENTED ON THE STREET PROGRAM,
THANKED COUNCILMEMBER SAMUEL FOR ASKING THE
QUESTIONS OF THE CITY MANAGER SO THAT IT COULD BE
EXPLAINED FOR CITIZENS AS TO HOW THE STREET PROGRAM
