Manager PREPARED BY: Todd Simoneaux, Chief Financial Officer MEETING DATE: July 3, 2018 REQUESTED ACTION: Council consider a resolution approving multiple contracts for the purchase of medical supplies used in the EMS Division. BACKGROUND Specifications required bidders to submit pricing for 162 line items, separated into eight specific categories. Bids were evaluated upon the lowest total price per category on an all or none basis which provides the best value to the City. Only bidders providing pricing for every itemwithin each category were considered. Pricing is to remain firm for the term of the contract. Bids were received from six vendors for an annual contract for medical supplies to be used by the EMS Division. The administration recommends entering an annual contract to the following vendors: Sections 1, 2, 4, 5, 7 and 8 - Bound Tree Medical of Dublin, Ohio for $12,017.49, $19,173.51, $50,476.83, $5,889.28, $8,999.32 and $555.04, respectively. Sections 3- Midwest Medical Supply Co., of Earth City, Missouri for $390.04. Section 6 — Southeastern Emergency Equipment of Youngsville, North Carolina for $1,421.40. The total cost for the three proposed contracts is $98,922.91. FUNDING SOURCE General Fund. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, bids were solicited for a one (1) year contract for medical supplies for use by Beaumont EMS; and, WHEREAS, Bound Tree Medical, of Dublin, Ohio, submitted a bid in the amount of $97,111.47 for line item Categories 1, 2, 4, 5, 7 and 8 as shown on and listed in Exhibit 'A" attached hereto; and, WHEREAS, Midwest Medical Supply Co., of Earth City, Missouri, submitted a bid in the amount of $390.04 for line item Category 3 as shown on and listed in Exhibit "A," attached hereto; and, WHEREAS, Southeastern Emergency Equipment, of Youngsville, North Carolina, submitted a bid in the amount of $1,421.40 for line item Category 6 as shown on and listed in Exhibit 'A" attached hereto; and, WHEREAS, City Council is of the opinion that the bids as submitted for the referenced categories by Bound Tree Medical, of Dublin, Ohio; Midwest Medical Supply Co., of Earth City, Missouri; and, Southeastern Emergency Equipment, of Youngsville, North Carolina, provides the best value to the City and should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, That the bids submitted by Bound Tree Medical, of Dublin, Ohio for line item Categories 1, 2, 4, 5, 7 and 8; Midwest Medical Supply Co., of Earth City, Missouri for line item Category 3; and, Southeastern Emergency Equipment, of Youngsville, North Carolina for line item Category 6 for a one (1) year contract for medical supplies for use by Beaumont EMS in the amounts shown on and listed in Exhibit "A" be accepted by the City of Beaumont. BACKGROUND On June 9, 2015, the City Council authorized the City's participation in a municipal health care provider participation program to support the payment of Medicaid supplemental hospital payments to Safety -Net Hospitals in the City. At the same time, the City Council authorized the execution of indigent care affiliation agreements with Baptist Hospitals of Southeast Texas and Christus Hospital. In addition, on July 28, 2015, the City Council approved model rules and procedures related to the City of Beaumont's facilitation of the program. The purpose of the amendment is to add a Christus sister facility, Christus Jasper Memorial Hospital, to the agreement. The amendment would allow the Beaumont Local Provider Participation Fund (LPPF) to help Christus Jasper receive Texas 1115 Waiver program payments in the event that they are unable to claim the full amount of those payments through their current government entity funding source. rY11►11] 1►[IIl.Y111T3�� Local Safety -Net Hospitals will make mandatory payments into the Beaumont Municipal Health Care Provider Participation Fund. RECOMMENDATION Approval of resolution. RESOLUTION NO. WHEREAS, on June 9, 2015, the City Council of the City of Beaumont, Texas passed Resolution No. 15-108 authorizing the City Manger to execute an Indigent Care Affiliation Agreement between the City of Beaumont and Christus Hospital to ensure that the indigent residents of the community continue to have access to and receive quality health care services; and, WHEREAS, an amendment to the Affiliation Agreement is necessary to add a Christus sister facility, Christus Jasper Memorial Hospital, to the agreement, and, WHEREAS, City Council is of the opinion that it is in the best interest of the citizens of the City of Beaumont for the City to enter into a First Amendment to the City of Beaumont Indigent Care Affiliation Agreement to add Christus Jasper Memorial Hospital to the agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the City Manager be and he is hereby authorized to execute a First Amendment to the City of Beaumont Indigent Care Affiliation Agreement between the City of Beaumont and Christus Hospital to add Christus Jasper Memorial Hospital to the agreement, substantially in the form attached hereto as Exhibit "1" and made a part hereof for all purposes. PASSED BY THE CITY COUNCIL of the City of Beaumont this the 3rd day of July, 2018. - Mayor Becky Ames - FIRST AMENDMENT TO THE CITY OF BEAUMONT INDIGENT CARE AFFILIATION AGREEMENT This First Amendment to the Indigent Care Affiliation Agreement (the "First Amendment") is entered into this day of '2018 to amend the Indigent Care Affiliation Agreement (the "Agreement") by and among the City of Beaumont (the "City" or "Governmental Entity") and CHRISTUS Health, on behalf of its hospital, specified as "Christus Hospital" in the Agreement, and other hospitals specified in this First Amendment. RECITALS WHEREAS, the City and CHRISTUS Hospital entered into the Agreement effective July 9, 2015. WHEREAS, the Agreement was subsequently filed with the Texas Health and Human Services Commission ("HHSC"). WHEREAS, HHSC requires that each participating hospital submit to HHSC a fully executed indigent care affiliation agreement in order to be eligible to receive payments under the Texas Section 1115 Waiver. WHEARAS, "CHRISTUS Hospital," as used in the Agreement is intended to refer to the hospital formally named CHRISTUS Southeast Texas - St. Elizabeth and located at 2830 Calder Street, Beaumont, TX. WHEREAS, CHRISTUS Health, as the corporate parent for CHRISTUS Southeast Texas - St. Elizabeth is duly authorized to enter into agreements on behalf of CHRISTUS Southeast Texas - St. Elizabeth and other hospitals associated with CHRISTUS Health. WHEREAS, the City and CHRISTUS Health desire to amend the Agreement to add an additional hospital and to subsequently file with HHSC. NOW, THEREFORE, the parties agree as follows: 1. The first paragraph of the Agreement shall be deleted and the paragraph below added in its place This Indigent Care Affiliation Agreement (the "Agreement") is entered into as of 2018 ("Effective Date"), by and between the City of Beaumont, a unit of local government within the State of Texas (the "City" or "Governmental Entity"), and CHRISTUS Health on behalf of the hospitals listed in Exhibit C (the "Affiliated Hospitals"). All hospitals listed in Exhibit C are organized and licensed under the laws of the State of Texas and their principal offices are provided. The 1 of 4 AMENDMENT TO CITY OF BEAUMONT INDIGENT CARE AFFILIATION AGREEMENT EXHIBIT "1" City and Affiliated Hospitals may be referred to individually in this Agreement as a Party or collectively as the Parties. 2. Alf references to "Affiliated Hospital" in the Agreement shall be changed to "Affiliated Hospitals." 3. Section 1.03(c)(1) of the Agreement shall be deleted, and the following sentence added in its place This practice has favored communities with an adequate funding mechanism to supply the nonfederal share of the Medicaid supplemental hospital payments. 4. Section 1.03 (c) (2) of the Agreement shall be deleted. S. Section 1.04(b) of the Agreement shall be amended by removing the words "like Affiliated Hospital." 6. The agreement shall be further amended by adding Exhibit C, attached hereto and incorporated herein by reference. 7. All other terms and conditions of the Agreement shall remain unchanged and are fully incorporated herein by reference. 8. BACKGROUND The Beaumont Public Library System has provided Inter -Library Loan (ILL) services to the citizens of Beaumont through the State of Texas since 2011. Being one of the largest libraries in East Texas affords us the opportunity to be one of the top participants in the system. ILLS are received and sent daily through the TexExpress Courier service as well as the US Mail, and are managed by library personnel at the Main Library and the Miller Library. Submitting a request is initiated through the Navigator system that is managed by the Texas State Library and Archives Commission. Managed by the Texas State Library and Archives Commission, the statewide interlibrary loan program embodies several grant programs that work together to enable library users' access to materials not available at their local library. It also works with other programs in Texas, the Southwest, and the country to promote resource sharing and provide greater access to information for all Texans. FUNDING SOURCE Not applicable. BACKGROUND Trap -Neuter -Return (TNR) is a program in which feral cats are trapped, vaccinated, sterilized, ear tipped for identification purposes and then released to the location where they were originally caught. TNR is the only humane and effective way to reduce feral cat populations over time. By returning sterilized cats back into the community, no new kittens are born, the cat population stabilizes, and nuisance cat behaviors are reduced. Because feral cats are wild and not socialized to humans, they cannot be adopted into new homes. TNR is supported by many national animal welfare organizations, including the Humane Society of the United States, the American Society for the Prevention of Cruelty to Animals, the Best Friends Animal Society, Alley Cat Allies, The No Kill Advocacy Center and Maddie's Fund. The Animal Care Advisory Committee met on June 14, 2018 to discuss TNR and is in support of the program. On June 26, 2018, the Beaumont City Council held a work session to discuss TNR. FUNDING SOURCE All sterilization surgeries will be provided by Beaumont Pets Alive at no cost to the City of Beaumont. RECOMMENDATION Approval of the ordinance. ARTICLE 4.09 TRAP -NEUTER -RETURN Sec 4.09.001 Definitions Ear Tipped shall mean a surgical process performed on a cat during sterilization as part of a trap, neuter, return (TNR) program in which a diagonal cut is made on the left ear to remove the point of a cat's ear. Feral Cat shall mean any homeless, wild or untamed cat. Feral Cat Caretaker shall mean a person who participates in a trap neuter, return (TNR program by providing care, including food, shelter, and/or medical care to feral cats Feral Cat Colony shall mean a concentrated group or population of feral cats having a common food source. Tran, Neuter, Return (TNR) shall mean a program in which feral cats are trapped vaccinated, sterilized, and ear tipped (for identification purposes) and returned to the location where they were originally trapped. Sec 4.09.002 Feral Cat Colony Registration (a) A Feral Cat Caretaker who manages a feral cat colony with nine (9) or more cats shall be required to register the colony with the Animal Care Manager, but shall not be required to obtain a commercial kennel permit or a dog and cat fancier permit This registration will serve as a clearinghouse for information on current caretakers education for new caretakers, and assistance with abating nuisance complaints Sec 4.09.003 At -Large and Abandoned Cats (a) Any cat(s) involved in a TNR program shall not be considered to be at -large and shall not be impounded, unless they are causing a nuisance as defined in section 4.01.003 or are dangerous as defined in section 4.05.001. Feral cats impounded on a nuisance complaint may be relocated to another feral cat colony transferred to a barn cat program, returned to a feral cat caretaker, humanely euthanized or the nuisance may be abated by some other manner as determined by the Animal Care Manager. (b) A Feral Cat Caretaker who returns a feral cat to its original location as part of a TNR program is not deemed to have abandoned or dumped the animal as those terms are used in section 4.02.003. Sec. 4.09.004 Feral Cat Ownership A Feral Cat Caretaker who manages cats as part of a TNR program shall not be considered the owner, harborer, keeper, holder, or possessor of such cats. BACKGROUND Specifications for the contract require temporary staffing agencies to provide pre-screened and qualified individuals on an on-call and as -needed basis. Temporary employees must pass a drug screen and a criminal background search prior to being assigned to the City. The contract specifications requested firm hourly prices inclusive of wages, benefits, testing, screening, workers compensations, taxes, and agency fees. Ten (10) vendors were solicited and seven vendors submitted bids for an annual contract to provide temporary employees to fill positions in business offices, skilled and unskilled laborers, equipment operators, and Licensed Vocational Nurses (LVN). Administration recommends awarding contracts to Advanced Staffing Inc. of Beaumont; Lofton Staffing Services of Beaumont; Personnel Staffing Inc. of Beaumont; and American Personnel & Temps of Beaumont.
