BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute a Letter Agreement
between the City of Beaumont and Jefferson County Drainage District No. 6 (JCDD6)
for drainage improvements along the Washington Boulevard Phase II Project and
JCDD6 Ditch No. 110-C. The Agreement is substantially in the form attached hereto as
Exhibit "A" and made a part hereof for all purposes.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 19th day of
June, 2018.

LETTER OF AGREEMENT
DITCH NO. 110-C DRAINAGE IMPROVEMENTS
This Agreement ("the Agreement") is entered between the City of Beaumont, a
municipal corporation of Jefferson County, Texas (hereinafter called "City") and
Jefferson County Drainage District No. 6, a special district of the State of Texas
(hereinafter called "DD6")
The City and DD6 will be working together to support the City of Beaumont's
Washington Blvd. Project and the DD6's Elinor Street Relief Grant Project. Both of
these projects will improve drainage of the area. DD6 and the City have agreed to the
following:
1. DD6 will install a 60 -inch HDPE culvert from the Washington Blvd. north
right of way line northerly into JCDD6 Ditch No. 110.
2. The proposed 60 -inch culvert will be installed generally as shown on the
attached sketch near Washington and tie into the existing concrete lined
JCDD6 Ditch No. 110.
3. DD6 will construct a new box generally as shown on the attached sketch.
4. DD6 will demolish the existing manhole and extend the 54 -inch culvert
to the new box, as shown on the attached sketch.
5. The City will purchase and/or reimburse DD6 for all materials i.e.,
culvert, cement stabilized backfill, culvert bedding, concrete and rebar.

6. DD6 will supply all manpower and equipment and rent the trench box.
7. DD6 will dress and seed the disturbed areas at its expense.
8. DD6 will provide a survey and metes and bounds for the preparation of a
Drainage Easement for the 0.018 proposed easement, as shown on the
attached sketch.
9. The City will prepare the easement, contact the landowner, and negotiate
and acquire the 0.018 -acre easement.
10. Once the new culvert and box project is complete, the culvert will become
the responsibility of the City and, if possible, the existing easement will
be conveyed from DD6 to the City; between Washington Blvd. and
JCDD6 Ditch No. 110's south right of way line.
11. The City will construct the new 60 -inch culvert in the Washington Blvd.
