Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Reverend Steven Balke with St. Stephens Church gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were MayorAmes, Councilmembers Getz, Sam, Pate and Samuel. Absent: Mayor Pro Tern Mouton and Councilmember Jordan. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "RED Day" - May 10, 2018 - Proclamation read by Councilmember Pate; accepted by Chelsea Kennedy with Keller Williams and others "National Transportation Week" - May 13-19, 2018 - Proclamation read by Councilmember Samuel; accepted by Janet Floyd, President of the Sabine District Transportation Club "National Travel and Tourism Week" - May 6-12, 2018 - Proclamation read by Mayor Ames; accepted by Dean Conwell, Director of the Beaumont Convention and Visitors Bureau "Public Service Recognition Week" - May 6-12, 2018 - Proclamation read by Councilmember Pate; accepted by Chris Catalina, Director of Human Resources forthe City of Beaumont "National Preservation Month"- May, 2018 - Proclamation read by MayorAmes; accepted . by Chelsea Kennedy with Keller Williams and others Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Minutes — May 8, 2018 Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda None CONSENT AGENDA * Approval of minutes — May 1, 2018 * Confirmation of committee appointments — None A) Approve a payment for the emergency repair of a dump truck used at the landfill — Resolution 18-101 B) Approve a resolution accepting a payment to remove a demolition lien attached to property at 595 4th Street — Resolution 18-102 C) Authorize the City Manager to execute all documents necessary for the Beaumont Convention and Visitors Bureau to apply for and accept grant funds from the Texas Parks and Wildlife Department — Resolution 18-103 D) Amend an inter -local agreement with Jefferson County for the assessment and collection of current and delinquent property taxes — Resolution 18-104 E) Amend an inter -local agreement with Jefferson County for the collection of business personal property taxes —Resolution 18-104 F) Authorize the acceptance of a ten -foot wide Exclusive Water Line Easement located at 7720 Park North Drive — Resolution 18-105 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Getz seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution approving a four-year lease purchase agreement with Signature Public Funding Corp. for a Fire Truck. On January 16, 2018, Council approved a reimbursement resolution for the lease purchase agreement to reimburse the City for the purchase of a Pierce Velocity Fire Pumper Truck in the amount of $691,000. Bids were requested for a fixed interest rate to finance the truck with the first payment in arrears following the date of purchase of the truck which was in October of 2017. The total lease purchase cost, including interest of $43,444.40, is $734,444.40. Minutes — May 8, 2018 Bids were solicited for a fixed interest rate lease purchase finance agreement from eighteen (18) vendors and three (3) responses received. The Administration is recommending an agreement with Signature Public Funding Corporation with an interest rate of 3.12%. Funds will come from the Capital Reserve Fund. Approval of the resolution. Councilmember Sam moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A FOUR (4) YEAR LEASE PURCHASE AGREEMENT WITH SIGNATURE PUBLIC FUNDING CORP., OF TOWSON, MARYLAND. Councilmember Getz seconded the motion. AYES: MAYOR AMES, COUNCILMEMBERS GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-106 WORK SESSION Review and discuss the stabilization of the riverbank at Riverfront Park Dr. Joe Majdalani, Public Works Director reviewed and discussed the stabilization of the riverbank at Riverfront Park. Dr. Majdalani, showed a Powerpoint of pictures before and after the storm of different areas of the park that were damaged. There were two options presented to Council, the first option was post storm stabilization and the second was pre - storm stabilization. Each option stabilizes approximately 1600' of the shoreline. Option 1, post storm stabilization, stabilizes the existing shoreline to the post storm location, it requires less fill than option two, requires a lighter bulkhead system than option two, and the estimated project cost range is from $19,500,000 to $26,500.000. Option 2, pre -storm stabilization, restores the existing shoreline to pre -storm location, requires more fill than Option 1, requires a heavier bulkhead system than option 1, the estimated project cost range is from $26,000,000 to $35,000,000. The funding options were discussed regarding Federal Emergency Management Agency (FEMA) Public Assistance versus United States Army Corps of Engineers (USACE). FEMA Public Assistance will pay 90% of federal funding with a 10% local match from the City for the project, FEMA will rebuild to pre -storm conditions and the City will have the opportunity for mitigation measures, the City will also lead the design solution. The USACE will fund 100% for project, they will rebuild to pre -storm or post - storm conditions (which is to be determined), USACE will lead the design solution and the City can pass on the proposed solution or veto the power. Council discussed the options and instructed staff to move forward with the FEMA option. COMMENTS Public Comments (Persons are limited to three minutes) Minutes — May 8, 2018 Dayna Rothenberger 3890 E. Lynwood Dr. Beaumont TX Stated that this month is National Bicycle month, commented on how it's difficult to get into the City by bicycle, bicyclists have to get on the Interstate to enter, commented on Riverfront Park, stated that it does need to be repaired, also made comments regarding the closure of Delaware off of the interstate Eric Bender 2770 I -H 10E Beaumont TX Stated that Historic Tyrrell Park, Cattail Marsh, recreation and fitness areas could be an attraction to the City, commented on transportation and tourism which includes bicycles, the City's transportation system is complete when it accommodates bicycles, Riverfront and Tyrrell Park are both waterway parks, one artificial and one natural, both could be great bicycle parks, requested that citizens be able to ride their bikes through Riverfront Park once the restoration is completed, announced that Moonlight Madness is coming up, this is one of the biggest bicycle event in Southeast Texas, there are so many people that come to Beaumont to take part in the event, encouraged everyone to come and be a part of the event this year Charles Paul 5615 Phelps Beaumont TX Spoke to Council regarding his neighborhood in Tyrrell Park, stated that there are a lot of citizens that would like to attend the City Council meetings, a lot of tax payers are working during the time the meetings take place, would like to know if there is a way that the meetings could be held after hours maybe once a month, also commented on the dilapidated building that is at Tyrrell Park that has been closed for about fifteen years, there have been other things that have been built at Tyrrell Park like the Botanical Gardens and the Golf Course, the citizens could utilize that dilapidate building if restored, it's also an eye sore when you enter the park Brenda Spivey 6010 Chandler Dr. Beaumont TX Thanked Council for all of their hard work they are putting into repairing Riverfront Park.
