BACKGROUND Unit 5091 is a 2004 Caterpillar Dump Truck with 7,844 working hours. Emergency repairs, consisting of a total engine replacement and equalizer bar restoration, were completed by Mustang Cat of Houston in the amount of $76,566.12. Mustang Cat is a Sole Source Vendor. This work came with a 36 month/5,000-hour warranty. The unit is used at the landfill to haul dirt and cover debris to comply with TCEQ regulations. FUNDING SOURCE Fleet Fund. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the City Manager be, and he is hereby, authorized to pay an invoice in the amount of $76,566.12 to Mustang Cat, of Houston, Texas, a sole source vendor, for emergency repairs to a 2004 Caterpillar 725 Articulating Heavy Haul Dump Truck for the Solid Waste Division to haul dirt and continually cover debris in compliance with TCEQ regulations. BACKGROUND On October 11, 2007, a demolition lien was attached to property legally described as Cartwright Terrace Addition, Lots 5 through 11, Block 36 (595 4t' Street). The principal amount due is $20,755.00, total interest accrued since the filing of said lien is $21,647.75 and lien assessment fee of $16.00, for a total amount of $42,418.75. The owner of the property has offered to pay the principal balance to remove the lien. FUNDING SOURCE Not applicable. RECOMMENDATION Approval of resolution. BACKGROUND The Beaumont Convention and Visitors Bureau would like to apply for grant funds from the Texas Parks and Wildlife Department for a percentage of the cost to design and install educational signage to inform visitors of the diverse ecosystem at Cattail Marsh, including bird and habitat -specific information. The vision is to provide signage at entry and smaller marked points to direct trail access, highlight specific birds, trees, flowers and other elements of the environment. The objective is for visitors to understand and fully appreciate the significance of the unique 900 -acre wetland systems that harnesses the power of nature to clean the City's water and provides a natural habitat for hundreds of birds, animals, and vegetation. FUNDING SOURCE The grant amount being requested is $5,000. The Beaumont CVB plans to spend $10,000 towards the signage. RECOMMENDATION Approval of the resolution. Project Overview: Design educational signage with map of trails to inform visitors of the diverse ecosystem including bird and habitat -specific information. The vision is to provide signage at entry and smaller marked points to direct trail access, and highlight specific birds, trees, flowers or other elements of the environment. Funding from this project will be used to develop and install permanent educational signage, including maps and navigation through marked trails: The Objective is for visitors to understand and fully appreciate the significance of the unique 900 -acre wetland systems that harnesses the power of nature to clean the City's water and provides a natural habitat for hundreds of birds, animals, and vegetation. The signage will help inform and engage visitors as to what is around them. Signage to include: • Welcome to Cattail Marsh sign, welcoming visitors to Cattail Marsh and steps'on how to identify a bird. o Check-in to Facebook for free Wi-Fi service, encouraging visitors to lookout for bird species and utilize eBird application • Importance of the wetlands as one of the most diverse ecosystems and the role of the water purification within this natural habitat o Plant and animal wildlife within the ecosystem that promote growth and impact within the wetlands o Located on two migratory flyways, providing numerous bird species to our area. o Have URL link to more information on wetlands and system • Bird specific signage with statistical data of birds within Cattail Marsh as well as rare bird sightings. o Introduction to eBird application and how it can be used to submit bird sightings • Area specific signage indicating certain types of waterfowl attracted to the area. o 26-30 Waterfowl species have been sighted in one day • Directional signage and indication markers of mileage and alternative routes throughout wetlands o Include bird, vegetation and wildlife information within the area of each marker Priority habitats, important avian sites, and/or priority species benefited, including acreages where applicable (note: max. 500 characters): Priority habitats: Cattail Marsh Wetlands is home to more than 260 bird species, making this area a 900 -acre birding hotspot. Additional notes about contributions from funding partners, if applicable (use of existing equipment, tools, staff, etc.): The Beaumont Convention and Visitors Bureau understands that they are applying for a portion of the funds needed for the proposed project and will pay outside of the grant for the project in its entirety. Please describe any plans you have to seek matching funds from other sources: We plan to submit a proposal for Jefferson County Hotel Tax Funds but are unable to make that request until September 2018. Expected Results and Benefit: Provide a brief statement of how the success of this project will be measured and monitoring plans associated with the project. Examples include: successfully addressing threats to habitat, educating the public, diverting human access to allow for habitat restoration, bird counts, checklist development, etc. (note: max. 1000 characters): Website to Cattail Marsh wetlands project would be displayed on signs for more information. Analytics would be obtained from traffic. Bird habitats would be features on additional website with introduction to birding and how they can help conserve species within the area. Trails throughout the wetlands encourage visitors to observe and not interfere with the habitats. With additional signage, the public can be more educated on how to interact with wildlife within the area. The increase in visitors and the eBird information provided will lead to more bird sightings, and presumably more bird species submitted. Introducing these tools and signage will help educate and increase awareness about birding, conservation and the importance of the wetlands to our area and its location on two migratory flyways. Provide description of avian monitoring and/or conservation measurement technique(s) used to evaluate this project (see project criteria for examples): All signage will include links for additional information hosted on the Beaumont CVB website that can be measured and monitored through Google Analytics. We would also monitor eBird submissions from Cattail Marsh wetlands. Facebook check -ins will allow for visitor count and provide geographical data. The Beaumont CVB plans to take an inventory bi-annually to do a check on bird counts and comparisons to previous years. The Beaumont CVB will work with Golden Triangle Audubon Society to host eBird submission tutorials at the Wetlands Educational Center opening Summer 2018. eBird workshops and additional birding collateral will be accessible at the Wetlands Educational Center. RESOLUTION NO. BACKGROUND On October 4, 1982, the City entered an inter -local agreement with Jefferson County for the assessment and collection of current and delinquent property taxes. That agreement authorized Jefferson County to conduct a Sheriff sale of property, a re -sale of property not sold at the initial Sheriff's sale, or to receive bids for the sale of property not sold at either the Sheriff's sale or a - re -sale. In instances where a property has been bid -in to Jefferson County in trust for the entities for whom it collects, and has been through one or more re -sales, and the period after the date on which the owner's right of redemption has terminated, then, each taxing unit authorizes Jefferson County to act on its behalf to sell such property at a private sale to any bidder at what it considers a reasonable price. Accordingly, the agreement shall be amended so that Jefferson County shall not be required to seek approval from a taxing unit's governing body to accept and transfer said property to a purchaser at a non-public sale. Payments to each taxing unit will be allocated as provided under the Texas Property Tax Code. Also, the agreement shall be amended so that Jefferson County, at its discretion, shall be permitted to sell the property at a private sale for an amount less than the lessor of - 1. £ 1. The market value specified in the judgment of foreclosure; or 2. The total amount of the judgment against the property. FUNDING SOURCE Not Applicable. RECOMMENDATION Approval of resolution. THE STATE OF TEXAS COUNTY OF JEFFERSON AMENDMENT TO CONTRACT FOR COLLECTION AND ASSESSMENT SERVICES Whereas Jefferson County, Texas hereinafter called "County" and the City of Beaumont hereinafter called "City", entered into a Contract for Collection and Assessment Services on the 4t' day of October, 1982, and the parties desire to amend that agreement; now therefore Section 8 of the contract is hereby amended as follows: SECTION 8 DELINQUENT TAX SUITS 8.3 This contract is being executed pursuant to Section 791.011 of the Texas Government code which allows an interlocal agreement to be established between local government entities to provide a governmental function or service that each party to the contract is authorized to perform individually. RECITALS: The parties agree as follows: Each party to this agreement is authorized to collect delinquent taxes. Each party agrees that is entitled to receive proceeds from a sheriff or constable sale. Thus, each party to this contract agrees that JEFFERSON COUNTY, a party to a judgment, taken for the collection of delinquent taxes is authorized to conduct a sheriff sale of property, a re -sale of property not sold at the initial Sheriff's Sale, or to receive bids for the sale of property not sold at either the Sheriff s sale or a re -sale. In instances where a property has been bid -in to Jefferson County in trust for the entities for whom it collects, and has been through one (1) or more re -sales, and the period after the date on which the owner's right of redemption has terminated, then, each taxing unit authorizes JEFFERSON COUNTY to act on its behalf to sell such property at a private sale to any bidder at what it considers a reasonable price. Accordingly, JEFFERSON COUNTY shall not be required to seek approval from a taxing unit's governing body to accept and transfer said property to a purchaser at a non-public sale. Payments to each taxing unit will be allocated as provided under the Texas Property Tax Code. At JEFFERSON COUNTY'S discretion, each party further agrees that where necessary JEFFERSON COUNTY shall be permitted to sell the property at a private sale for an amount less than the lesser of 1) The market value specified in the judgment of foreclosure; or 2) The total amount of the judgment against the property. Each party understands and agrees that a property that is sold for an amount equal to or lesser than the judgment, its market or appraised value discharges and extinguishes all liens foreclosed by the judgment. EACH PARTY AGREES THAT ANY ENTITY THAT DOES NOT CONSENT TO A SALE FOR AN AMOUNT EQUAL TO OR LESSER THAN THE JUDGMENT AND/OR ITS MARKET OR APPRAISED VALUE WILL BE LIABLE TO JEFFERSON COUNTY FOR A PRO RATA SHARE OF THE COSTS INCURRED IN PURCHASING AND MAINTAINING PROPERTY, INCLUDING THE COSTS OF PREVENTING THE PROPERTY FROM BECOMING A PUBLIC NUISANCE, A DANGER TO THE PUBLIC OR A THREAT TO PUBLIC HEALTH. The amended provisions supersede all prior oral and written agreements between the parties regarding Delinquent Tax Suits as provided in Section 8 of the Original agreement. All other terms and provisions of the original Contract for Assessment and Collection Services shall remain in full force. BACKGROUND On January 16, 2018, Council approved a reimbursement resolution for the lease purchase agreement to reimburse the City for the purchase of a Pierce Velocity Fire Pumper Truck in the amount of $691,000. Bids were requested for a fixed interest rate to finance the truck with the first payment in arrears following the date of purchase of the truck which was in October of 2017. The total lease purchase cost, including interest of $43,444.40, is $734,444.40. Bids were solicited for a fixed interest rate lease purchase finance agreement from eighteen (18) vendors and three (3) responses received. The Bid tab is attached. WHEREAS, on January 16, 2018, the City Council of the City of Beaumont, Texas adopted Resolution No. 18-015 approving a lease purchase agreement to reimburse the City for the purchase of one (1) Fire Pumper Truck in the amount of $691,000.00; and, WHEREAS, bids were requested for a fixed interest rate to finance the truck with the first annual payment in arrears following the purchase of the truck which was in October, 2017; and, WHEREAS, the total lease purchase cost including interest of $43,444.40 is $734,444.40; and, WHEREAS, bids were received for a four (4) year lease purchase agreement for the lease purchase of a Pierce Velocity Fire Pumper Truck; and, WHEREAS, Signature Public Funding Corp., of Towson, Maryland, submitted a bid at a fixed interest rate of 3.12%; and, WHEREAS, the City Council is of the opinion that the bid submitted by Signature Public Funding Corp., of Towson, Maryland, is in the best interest of the City of Beaumont and should be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: THAT the statements and findings set out' in the preamble to this resolution are hereby, in all things, approved and adopted; and, THAT the bid submitted by Signature Public Funding Corp., of Towson, Maryland, for a four (4) year lease purchase agreement at a fixed interest rate of 3.12% and a total lease purchase cost of $734,444.40, as shown on Exhibit "A," attached hereto, for the lease purchase of a Pierce Velocity Fire Pumper Truck, be accepted by the City of Beaumont. THAT the City Manager be and he is hereby authorized to execute a four (4) year lease purchase agreement with Signature Public Funding Corp., of Towson, Maryland, for the purposes described herein.
